Por ordem superior se torna público que o Conselho Misto da Associação da E. F. T. A. e da Finlândia adoptou na 36.ª reunião simultânea, realizada em 4 de Dezembro de 1969, a decisão n.º 11 de 1969, cujo texto em inglês e a respectiva tradução para português são os seguintes:

Origin of materials taken into stock prior to the accession of Iceland to the Convention and the Agreement of association

The Joint Council,

Having regard to decision of the Council no. 18 of 1969 (ver nota *),

Having regard to paragraph 6 of article 6 of the Agreement,

decides:

Decision of the Council no. 18 of 1969 (ver nota *) shall be binding also on Finland and apply in relations between Finland and the other Parties to the Agreement.

Origin of materials taken into stock prior to the accession of Iceland to the Convention

The Council,

Having regard to paragraph 5 of article 4 of the Convention,

decides:

1. For the purpose of determining the eligibility for area tariff treatment of goods produced within the area from materials to which this decision applies, those materials shall be regarded as wholly produced within the area unless there is evidence that they underwent their last process of production outside the area.

2. This decision applies to:

a) Materials taken into stock in Iceland between 1st March 1969 and the day preceding the date of entry into force of this decision, inclusive, if they can be shown to have been obtained from a producer of such materials in another Member State;

b) Materials taken into stock in a Member State, other than Iceland, between 1st March 1969 and the day preceding the date of entry into force of this decision, inclusive, if they can be shown to have been obtained from a producer of such materials in Iceland.

3. This decision shall enter into force on the date of entry into force of the Convention in relation to Iceland.

O Conselho Misto,

Tendo em consideração a decisão do Conselho n.º 18 de 1969 (ver nota *),

Tendo em consideração o parágrafo 6 do artigo 6 do Acordo,

decide:

A decisão do Conselho n.º 18 de 1969 (ver nota *) será também obrigatória para a Finlândia e aplicar-se-á nas relações entre a Finlândia e as restantes Partes do Acordo.

Origem de materiais armazenados em «stock» antes da acessão da Islândia à Convenção

O Conselho,

Tendo em consideração o parágrafo 5 do artigo 4 da Convenção,

decide:

A fim de determinar a concessão do tratamento pautal da área a mercadorias produzidas dentro da área a partir de materiais a que se refere a presente decisão, tais materiais serão considerados como totalmente produzidos dentro da área, salvo se houver prova de o respectivo último processo de fabrico se ter realizado fora da área.

2. A presente decisão tem por objecto:

a) Materiais armazenados em stock na Islândia entre 1 de Março de 1969 e o dia anterior ao da data da entrada em vigor da presente decisão, inclusive, no caso de se provar que tais materiais foram obtidos de um produtor dos mesmos em outro Estado Membro;

b) Materiais armazenados em stock num Estado Membro, que não seja a Islândia, entre 1 de Março de 1969 e o dia anterior à data da entrada em vigor da presente decisão, inclusive, no caso de se provar que os mesmos foram obtidos de um produtor de tais materiais na Islândia.

3. A presente decisão entrará em vigor na data da entrada em vigor da Convenção em relação à Islândia.
