Por ordem superior se torna público que, por troca de notas de 31 de Outubro e 10 de Novembro de 1977, de que se remete cópia e respectiva tradução, foi concluído um acordo entre o Governo de Portugal e o dos Estados Unidos, nos termos do qual são repostos em vigor os programas de incentivo ao investimento autorizados pelo acordo por troca de notas de 22 e 25 de Maio de 1953, entre os Governos dos dois países, agora executados pela Overseas Private Investment Corporation (OPIC), relativamente a actividades autorizadas pelas competentes entidades oficiais portuguesas.

Excellency:

I have the honor to refer to the agreement effected by the exchange of notes on May 22 and 25, 1953, between our two governments on the subject of United States Government investment insurance and guaranties.

The United States Government is pleased to advise that if your government agrees, the United States investment incentive programs which are authorized by the aforementioned agreement and which are now administered by the Overseas Private Investment Corporation can be resumed in connection with activities authorized by the competent Portuguese authorities.

My government is pleased to advise, further, that it does not interpret the provisions of the aforementioned agreement relating to subrogation of the United States of America to imply an admission that the Government of Portugal is responsible in the amount paid under such insurance or guaranties. Rather, it is the understanding of my government that the amount of liability of the Government of Portugal, if any, with respect to any claim to which the Government of the United States of America might be subrogated pursuant to subparagraph A of said agreement would be based on the laws of Portugal, on applicable international law or agreements and on the terms of any arrangements or agreements entered into by the Goverment of Portugal involving the investment to which the claim relates.

If this proposal and understanding is acceptable to the Government of Portugal, it is suggested that you reply by note.

Excelência:

Tenho a honra de me referir ao acordo por troca de notas de 22 e 25 de Maio de 1953 entre os nossos dois Governos relativamente ao seguro e garantias de investimentos do Governo dos Estados Unidos.

O Governo dos Estados Unidos tem o prazer de informar que, se o Governo de V. Ex.ª estiver de acordo, os programas de incentivo ao investimento autorizados pelo citado acordo e agora executados pela Overseas Private Investment Corporation poderão ser retomados, relativamente a actividades autorizadas pelas competentes autoridades portuguesas.

O meu Governo tem ainda o prazer de comunicar que não interpreta as disposições do referido acordo relativas à sub-rogação dos Estados Unidos como significando que o Governo Português fica responsável até ao montante pago ao abrigo de tal seguro ou garantias. Mais é entendimento do meu Governo que o montante da responsabilidade do Governo Português, se existir, no que respeita a qualquer reclamação a que o Governo dos Estados Unidos da América possa estar sub-rogado, de acordo com o subparágrafo A do citado acordo, basear-se-á na lei portuguesa, nas leis ou acordos internacionais aplicáveis e nos termos de quaisquer arranjos subscritos pelo Governo Português relativos ao investimento a que se refere a reclamação.

Se esta proposta e este entendimento forem aceitáveis para o Governo Português, sugere-se que V. Ex.ª responda por nota.
