Decreto n.º 1/2009

de 27 de Janeiro

Considerando que o Acordo de Cooperação nos Domínios da Educação, Ciência, Ensino Superior, Cultura, Juventude, Desporto, Turismo e Comunicação Social permitirá promover a cooperação entre a República Portuguesa e a República Federal Democrática da Etiópia nas áreas da educação, ciência, ensino superior, cultura, juventude, desporto, turismo e comunicação social;

Atendendo a que a vigência do Acordo contribuirá para fomentar o intercâmbio de documentação, a cooperação entre instituições competentes nas matérias correspondentes ao seu objecto, a promoção do estudo das respectivas línguas e o conhecimento das diversas áreas da cultura dos dois países, a participação em eventos culturais, a salvaguarda do património nacional das Partes e a protecção dos direitos de autor;

Conscientes de que o Acordo estabelece bases jurídicas sólidas que permitirão que as Partes elaborem programas de cooperação com vista a empreender formas detalhadas de cooperação e intercâmbio:

Assim:

Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição, o Governo aprova o Acordo de Cooperação nos Domínios da Educação, Ciência, Ensino Superior, Cultura, Juventude, Desporto, Turismo e Comunicação Social entre a República Portuguesa e a República Federal Democrática da Etiópia, assinado em Adis Abeba em 28 de Janeiro de 2007, cujo texto, nas versões autenticadas nas línguas portuguesa e inglesa, se publica em anexo.

Acordo de Cooperação nos Domínios da Educação, Ciência, Ensino Superior, Cultura, Juventude, Desporto, Turismo e Comunicação Social entre a República Portuguesa e a República Federal Democrática da Etiópia.

A República Portuguesa e a República Federal Democrática da Etiópia, doravante designadas «As Partes»:

Animadas pelo desejo de assegurar, nos respectivos países, uma melhor compreensão e conhecimento mútuo da civilização e da cultura do outro país; e

Empenhadas em fortalecer os laços históricos e de amizade que unem os seus povos e em desenvolver a cooperação nas áreas da educação, ciência, ensino superior, cultura, juventude, desporto, turismo e comunicação social;

acordam o seguinte:

CAPÍTULO I

Disposições gerais

Artigo 1.º

Domínios de cooperação

As Partes comprometem-se a promover e a encorajar todas as actividades que possam contribuir para a cooperação mútua nos domínios da educação, ciência, ensino superior, cultura, juventude, desporto, turismo e comunicação social.

Artigo 2.º

Troca de informações e participação em eventos

1 - As Partes informar-se-ão sobre as reuniões, seminários, conferências, exposições, simpósios, encontros e concursos, actividades de investigação, eventos científicos, educacionais, culturais e artísticos, bem como festivais internacionais, que tenham lugar nos seus países.

2 - Cada uma das Partes convidará representantes da outra Parte e concederá as facilidades necessárias para a sua participação nos eventos mencionados no número anterior.

Artigo 3.º

Bolsas de estudo

1 - As Partes envidarão esforços para conceder bolsas de estudo de pós-graduação, mestrado e doutoramento no âmbito do presente Acordo.

2 - Os beneficiários destas bolsas de estudo serão designados pelas autoridades competentes de cada um dos países.

CAPÍTULO II

Educação, ciência e ensino superior

Artigo 4.º

Cooperação na área da educação básica e ensino secundário

As Partes promoverão a troca de informações e experiências sobre orientação escolar e profissional, bem como a troca de documentação sobre os diferentes níveis e tipos de ensino.

Artigo 5.º

Cooperação entre instituições de ensino superior

As Partes, de acordo com a sua legislação, promoverão a cooperação entre instituições do ensino superior em domínios de interesse mútuo.

CAPÍTULO III

Cultura

Artigo 6.º

Cooperação na área da cultura

Cada Parte, em conformidade com a respectiva legislação, promoverá as seguintes iniciativas:

a) Organização de exposições, nomeadamente de livros, de arte, cultura e feiras de artesanato;

b) Intercâmbio de grupos culturais e artísticos, especialistas e artistas, concedendo as facilidades necessárias para as respectivas visitas;

c) Intercâmbio de livros, publicações, fotografias, diapositivos, gravações áudio, filmes e microfilmes;

d) Cooperação entre as bibliotecas e arquivos nacionais, museus e teatros.

Artigo 7.º

Restauro e preservação de arquivos e monumentos históricos

As Partes tomarão todas as medidas necessárias para assegurar o restauro e a preservação dos arquivos e dos monumentos históricos que sejam de interesse comum.

Artigo 8.º

Estágios de curta duração

As Partes procederão ao intercâmbio de experiências na área cultural, organizando, para esse fim, estágios de curta duração nos respectivos países.

Artigo 9.º

Direitos de autor e direitos conexos

As Partes comprometem-se a proteger os direitos de autor e direitos conexos de que sejam titulares os seus cidadãos, nos termos do seu direito interno e das convenções internacionais de que sejam parte.

Artigo 10.º

Salvaguarda do património cultural e natural

1 - As Partes concordam em cooperar na preservação e restauro do património cultural.

2 - As Partes comprometem-se a respeitar e a fazer cumprir as disposições legais respeitantes ao tráfico ilícito dos bens pertencentes ao património cultural e natural e promoverão o retorno de objectos de natureza histórica e cultural perdidos ou ilegalmente transferidos aos respectivos territórios.

Artigo 11.º

Importação e exportação temporárias

1 - As Partes concederão, em regime de reciprocidade, todas as facilidades para a importação e exportação temporária de objectos arqueológicos e artísticos destinados a exposições culturais organizadas sob a sua responsabilidade, uma vez cumpridas as formalidades legais aplicáveis.

2 - A Parte que recebe a exposição assegurará a protecção e restituição dos objectos expostos à Parte que os enviou.

CAPÍTULO IV

Juventude e desportos

Artigo 12.º

Cooperação na área da juventude

As Partes apoiarão e incentivarão a cooperação na área da juventude, nomeadamente através da troca de informação e documentação, com vista ao aprofundamento do conhecimento da realidade juvenil dos dois Estados.

Artigo 13.º

Cooperação na área dos desportos

As Partes promoverão a cooperação entre federações e organizações desportivas dos dois Estados, através do intercâmbio de equipas e grupos desportivos, bem como de informação nos domínios da documentação desportiva e do apoio à investigação na área dos desportos.

CAPÍTULO V

Turismo

Artigo 14.º

Cooperação na área do turismo

As Partes encorajarão o turismo entre os dois países, o qual constitui um meio efectivo de promoção para uma melhor compreensão mútua.

CAPÍTULO VI

Comunicação social

Artigo 15.º

Cooperação na área da comunicação social

As Partes favorecerão a cooperação em todas as áreas de actividade do sector da comunicação social, nomeadamente entre as empresas com missões do serviço público nessas áreas, com vista ao conhecimento mútuo das respectivas identidades culturais e ao intercâmbio de experiências.

CAPÍTULO VII

Disposições diversas

Artigo 16.º

Obrigações financeiras

As obrigações financeiras relativas às actividades previstas no presente Acordo serão reguladas entre as Partes, em conformidade com a respectiva legislação em vigor.

Artigo 17.º

Comissão mista

1 - Para os efeitos do presente acordo é criada uma comissão mista com composição paritária.

2 - A comissão mista estabelecerá os programas plurianuais de cooperação reunindo, para o efeito, alternadamente, em Portugal e na Etiópia, pelo menos uma vez em cada três anos.

Artigo 18.º

Solução de controvérsias

As Partes resolverão, por via diplomática, eventuais divergências de interpretação ou de execução do presente Acordo.

Artigo 19.º

Conformidade com convenções multilaterais

As convenções multilaterais sobre a matéria objecto do presente Acordo que vinculem as Partes prevalecerão sobre as disposições deste.

Artigo 20.º

Entrada em vigor

O presente Acordo entrará em vigor na data da recepção da última notificação, por escrito e por via diplomática, de que foram cumpridos os requisitos de direito interno de ambas as Partes necessários para o efeito.

Artigo 21.º

Vigência e denúncia

1 - O presente Acordo vigorará por um período de cinco anos, renovável automaticamente por iguais períodos, salvo se qualquer das Partes o denunciar, por escrito e por via diplomática, com uma antecedência mínima de seis meses, antes do término de cada período.

2 - A denúncia do presente Acordo não afectará qualquer projecto ou actividade em curso ao abrigo do presente Acordo.

Artigo 22.º

Revisão do Acordo

1 - Qualquer uma das Partes poderá requerer à outra a revisão do presente Acordo.

2 - A revisão do Acordo entrará em vigor nos termos do artigo 20.º

Feito em Adis Abeba, aos 28 de Janeiro de 2007, em dois originais, nas línguas portuguesa e inglesa, fazendo ambos os textos igualmente fé. No caso de divergência na interpretação, o texto em inglês deverá prevalecer.

Cooperation Agreement in the Fields of Education, Science, Higher Education, Culture, Youth, Sports, Tourism and Media between the Portuguese Republic and the Federal Democratic Republic of Ethiopia.

The Portuguese Republic and the Federal Democratic Republic of Ethiopia, hereafter referred to as the «Parties»:

Endeavouring to ensure a better understanding and knowledge of the civilisation and culture in their respective countries;

Pledged to the strengthening of the historical and friendship bonds that unite their peoples and wishing to implement co-operation in the fields of education, science, higher education, culture, youth, sports, tourism and media;

have agreed as follows:

CHAPTER I

General provisions

Article 1

Co-operation scope

The Parties commit themselves to promote and encourage all the activities which might contribute towards mutual co-operation in the fields of education, science, higher education, culture, youth, sports, tourism and media.

Article 2

Exchange of information and participation in events

1 - The Parties shall mutually inform one another on meetings, seminars, conferences, exhibitions, symposiums, meetings and contests, research activities, scientific, educational, cultural and artistic events, as well as on international festivals, which take place in their countries.

2 - Either Party shall invite representatives of the other Party and shall grant the necessary facilities for their participation in the events mentioned in the previous number.

Article 3

Scholarships

1 - The Parties shall endeavour to grant post-graduation masters and doctoral scholarships in the scope of the present Agreement.

2 - The beneficiaries of these scholarships shall be nominated by the competent authorities of either country.

CHAPTER II

Education, science and university education

Article 4

Cooperation in the elementary and secondary education field

The Parties shall promote the exchange of information and experience on school and vocational guidance, as well as the exchange of documentation on the different levels and types of teaching.

Article 5

Cooperation between higher education institutions

In conformity with their legislation, the Parties shall promote cooperation between higher education institutions, within the areas of mutual interest.

CHAPTER III

Culture

Article 6

Cooperation in the cultural field

Either Party shall promote, in accordance with their legislation, the following initiatives:

a) Organisation of exhibitions, namely books, art, cultural and handicraft fairs;

b) Exchange of cultural and artistic groups, experts and artists, granting them the necessary facilities for their respective visits;

c) Exchange of books, publications, photographs, slides, audio recordings, films and microfilms;

d) Cooperation between libraries and national archives, museums and theatres.

Article 7

Restoration and preservation of archives and historical monuments

The Parties shall take the necessary measures to guarantee the restoration and preservation of archives and historical monuments that are of mutual interest.

Article 8

Short term training

The Parties shall exchange experience in the cultural area organising, to that end, short term training periods in their respective countries.

Article 9

Copyright and related rights

The Parties shall commit themselves to protect copyright and related rights of which their citizens are holders, in conformity with their domestic law in force and with the international conventions to which they are Parties.

Article 10

Safeguard of the cultural and natural heritage

1 - The Parties agree in co-operation in the preservation and restoration of the cultural heritage.

2 - The Parties commit themselves to abide by the legal provisions, as regards the illicit trafficking of property belonging to the natural and cultural patrimony, and shall ensure the return of historical and cultural objects, which were lost or illegally removed, to their respective territories.

Article 11

Temporary import and export

1 - On a reciprocity basis, the Parties shall grant all the facilities required for the temporary import and export of archaeological and artistic objects destined for cultural exhibitions they are to organise, as soon as the legal formalities in force have been fulfilled.

2 - The Party hosting the exhibition shall ensure the safety and return of the objects on display to the country that sent them.

CHAPTER IV

Youth and sports

Article 12

Cooperation in the youth field

The Parties shall support and encourage cooperation in the field of youth, namely through the exchange of information and documentation, contributing towards a better acquaintance with the youth realities of both countries.

Article 13

Cooperation in the sports field

The Parties shall promote co-operation between the sports federations and organisations of both countries by means of interchanging sports teams and groups, as well as information in the field of sports documentation and research support in the sports field.

CHAPTER V

Tourism

Article 14

Cooperation in the tourism field

The Parties shall encourage tourism between both countries since this constitutes an efficient means for promoting a better understanding between them.

CHAPTER VI

Media

Article 15

Cooperation in the media field

The Parties shall foster the cooperation in all the areas pertaining to the media sector, namely between companies responsible for public service missions in such areas with the aim of becoming mutually acquainted with the respective cultural identities and for exchanging experiences.

CHAPTER VII

Final provisions

Article 16

Financial obligations

The Parties shall settle financial obligations incurred with the activities indicated in this Agreement, in accordance with their respective legislation in force.

Article 17

Joint committee

1 - For the purposes of the present Agreement, a joint committee shall be established, composed of an equal number of representatives from both Parties.

2 - The joint committee shall elaborate multi-annual cooperation programs and, for that purpose, shall meet alternately in Portugal and Ethiopia, at least once in every three years.

Article 18

Disputes settlement

Disputes running from this Agreement shall be settled by the Parties, through diplomatic channels.

Article 19

International obligations

The obligations arising from multilateral treaties binding for both Parties regarding the same subject-matter of the present Agreement shall prevail over the obligations herewith contained.

Article 20

Entry into force

This Agreement shall enter into force on the date of receipt of the last communication, in writing and through the diplomatic channels, indicating that all the legal procedures required for the purpose have been fulfilled.

Article 21

Duration and denunciation

1 - The present Agreement shall remain in force for a period of five years and shall continue automatically in force for subsequent equal periods, unless either Party denounces it, in writing and through the diplomatic channels, at least six months before the date of expiry of each period.

2 - The denunciation of the present Agreement shall not impair any project or activity initiated within its duration.

Article 22

Revision of the Agreement

1 - Either Party may request the other Party, in writing, the revision of this Agreement.

2 - The revision shall enter into force under article 20.

Done at Addis Ababa on the 28th of January of two thousand and seven in two original copies, in the English and Portuguese languages, both texts being equally authentic. In case of any divergence of interpretation, the English text shall prevail.
