Considerando a necessidade de estabelecer um elemento estruturante na sedimentação do relacionamento jurídico bilateral entre a República Portuguesa e a Sérvia e Montenegro para o desenvolvimento e progresso dos respectivos habitantes;

Tendo em conta a necessidade de proceder a uma definição em relação aos acordos bilaterais vigentes entre a República Portuguesa e a antiga República Socialista Federativa da Jugoslávia e como meio de garantir uma maior segurança jurídica nas relações entre Estados:

Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição, o Governo aprova o Acordo entre a República Portuguesa e a Sérvia e Montenegro sobre a Sucessão dos Tratados Vigentes entre a República Portuguesa e a Antiga República Socialista Federativa da Jugoslávia, assinado em Lisboa em 3 de Novembro de 2003, cujo texto, nas versões autenticadas nas línguas portuguesa, sérvia e inglesa, é publicado em anexo.

ACORDO ENTRE A REPÚBLICA PORTUGUESA E A SÉRVIA E MONTENEGRO SOBRE A SUCESSÃO DOS TRATADOS VIGENTES ENTRE A REPÚBLICA PORTUGUESA E A ANTIGA REPÚBLICA SOCIALISTA FEDERATIVA DA JUGOSLÁVIA.

A República Portuguesa e a Sérvia e Montenegro, doravante designadas como Estados Contratantes:

Desejando aprofundar as suas relações de amizade;

Reconhecendo que os princípios do livre consentimento, da boa fé e a regra Pacta Sunt Servanda são universalmente reconhecidos;

Considerando os objectivos de promover as relações em espírito de cooperação com base nos princípios de mútuo respeito, soberania e igualdade;

Tendo em conta a necessidade de proceder a uma definição em relação aos acordos bilaterais vigentes entre a República Portuguesa e a antiga República Socialista Federativa da Jugoslávia e como meio de garantir uma maior segurança jurídica nas relações entre Estados;

Tendo presente os princípios contidos na Convenção de Viena sobre o Direito dos Tratados de 1969:

acordam no seguinte:

Artigo 1.º

Objecto

Dos tratados vigentes entre a República Portuguesa e a antiga República Socialista Federativa da Jugoslávia, mantêm-se em vigor os constantes do anexo ao presente Acordo, que dele faz parte integrante.

Artigo 2.º

Renegociação

1 - Os tratados constantes do anexo ao presente Acordo serão renegociados, caso se afigure necessário, num curto espaço de tempo.

2 - Para o efeito previsto no número anterior, e em virtude da diversidade de matérias envolvidas, serão efectuadas consultas mútuas ao nível técnico e político.

Artigo 3.º

Vigência

O presente Acordo entrará em vigor 30 dias após a data de recepção da última das notificações, por via diplomática, de que se encontram preenchidos os respectivos requisitos constitucionais e legais para a sua entrada em vigor.

Assinado em Lisboa em 3 de Novembro de 2003, nas línguas portuguesa, sérvia e inglesa, sendo os textos igualmente autênticos. Em caso de divergências de interpretação, prevalecerá o texto em língua inglesa.

ANEXO

1 - Acordo sobre Cooperação no Domínio do Turismo entre Portugal e a Antiga República Socialista Federativa da Jugoslávia, assinado em 9 de Maio de 1975.

2 - Acordo de Cooperação Económica, Científica e Tecnológica entre Portugal e a Antiga República Socialista Federativa da Jugoslávia, assinado em 18 de Outubro de 1977.

3 - Acordo entre o Governo de Portugal e o Conselho Executivo Federal da Assembleia da Jugoslávia sobre Cooperação no Domínio da Comunicação Social, assinado em 11 de Julho de 1984.

MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF FOREIGN AFFAIRS OF THE PORTUGUESE REPUBLIC AND THE MINISTRY OF FOREIGN AFFAIRS OF SERBIA AND MONTENEGRO.

Convinced of the importance of establishing a legal framework in specific areas between both countries;

Conscious of the interest of negotiating agreements in the fields of air and land transport formerly covered by bilateral agreements of which Portugal and the former Socialist Federal Republic of Yugoslavia were parties;

Considering that these aforementioned agreements ceased to be in force with the extinction of the Socialist Federal Republic of Yugoslavia;

The Ministry of Foreign Affairs of the Portuguese Republic and the Ministry of Foreign Affairs of Serbia and Montenegro, hereinafter referred to as «the signatories»;

Desiring to pursue the issues of mutual interest;

Have reached the following understanding:

Article 1

The signatories undertake to initiate negotiations towards the conclusion of bilateral agreements in the fields of air transport and land transport, as soon as possible.

Article 2

The signatories will also undertake to speed ongoing negotiations on other bilateral agreements, namely in, the fields of culture, investment protection and to avoid double taxation.

Article 3

The signatories will endeavour to maintain close cooperation concerning the negotiations through the appropriate diplomatic channels.

Article 4

This Memorandum will cease to produce effects as soon as the afore mentioned agreements have been concluded.

AGREEMENT BETWEEN THE PORTUGUESE REPUBLIC AND SERBIA AND MONTENEGRO ON THE SUCCESSION TO THE TREATIES WHICH WERE IN FORCE BETWEEN THE PORTUGUESE REPUBLIC AND THE FORMER SOCIALIST FEDERAL REPUBLIC OF YUGOSLAVIA.

The Portuguese Republic and Serbia and Montenegro hereinafter referred to as he Contracting Parties:

Desiring to intensify their friendly relationship;

Recognising that the principles of free consent and of good faith and the Pacta Sunt Servanda rule are universally recognised;

Considering their objectives to promote a relationship focused on a co-operation attitude with basis on principles of mutual respect, sovereignty, and equality;

Bearing in mind the necessity to proceed towards a definition with respect to bilateral agreements which were in force between the Portuguese Republic and the former Socialist Federal Republic of Yugoslavia and as a means of ensuring greater legal safety in the relationship between the States;

Recalling the principles contained in the 1969 Vienna Convention on the Law of Treaties;

have agreed as follows:

Article 1

Purpose

Out of the treaties which were in force between the Portuguese Republic and the former Socialist Federal Republic of Yugoslavia, the treaties mentioned on the annex to the present Agreement, of which it is integral part, shall remain in force.

Article 2

Renegotiation

1 - The treaties contained in the annex to the present Agreement shall undergo renegotiation, should it be deemed necessary, within a short period of time.

2 - For the purpose of the previous paragraph, and taking into account the diversity of subjects involved, mutual consultation shall be effected both at technical and political level.

Article 3

Entry into force

The present Agreement shall enter into force on the thirtieth day after the date of reception of the second notification, through diplomatic channels, stating that the domestic legal procedures of the Contracting Parties required to the effect have been accomplished.

Signed in Lisbon on the 3rd of November 2003 in the portuguese, serbian and english languages, all texts being equally authentic. In case of any divergence of interpretation, the english text shall prevail.

ANNEX

1 - Co-operation Agreement in the Field of Tourism between Portugal and the Former Socialist Federal Republic of Yugoslavia, signed on the 9th of May 1975.

2 - Agreement Relating to Economic, Scientific and Technological Co-Operation between Portugal and the Former Socialist Federal Republic of Yugoslavia, signed on the 18th of October 1977.

3 - Agreement between the Government of Portugal and the Federal Executive Council of the Assembly of Yugoslavia Relating to Co-Operation in the Media Field, signed on the 11th of July 1984.
