Decreto n.º 12/2026
O Acordo entre a República Portuguesa e o Reino dos Países Baixos Relativo à Troca e Proteção Mútua de Informação Classificada foi feito na Haia, em 11 de dezembro de 2024.
Com o referido Acordo, pretende-se garantir a proteção mútua da informação classificada trocada entre as Partes, entre uma Parte e um Contratante sob a jurisdição da outra Parte, entre Contratantes sob a jurisdição das respetivas Partes, ou gerada no âmbito de um programa bilateral ao abrigo deste Acordo. O presente Acordo define, também, a equivalência entre os sistemas de classificação de segurança e as regras para acesso e transmissão de informação classificada, e para emissão de credenciação de segurança, entre outros assuntos neste âmbito.
Considerando as excelentes relações entre a República Portuguesa e o Reino dos Países Baixos, o Acordo visa facilitar e desenvolver as relações bilaterais existentes entre os dois Estados, estabelecendo os procedimentos e disposições de segurança necessários ao garantir da proteção mútua da informação classificada.
Assim:
Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição, o Governo aprova o Acordo entre a República Portuguesa e o Reino dos Países Baixos Relativo à Troca e Proteção Mútua de Informação Classificada, feito na Haia, em 11 de dezembro de 2024, cujo texto, nas versões autênticas, em português, inglês e neerlandês, se publica em anexo.

Acordo entre a República Portuguesa e o Reino dos Países Baixos Relativo à Troca e Proteção Mútua de Informação Classificada
A República Portuguesa e o Reino dos Países Baixos, doravante designadas conjuntamente por «Partes», e cada uma individualmente por «Parte»:
Reconhecendo o importante papel da sua cooperação conjunta na garantia da paz, da segurança internacional e da confiança mútua;
Considerando que partilham normas de segurança equivalentes para a proteção de Informação Classificada; e
A fim de garantir a proteção mútua de Informação Classificada:
Acordam, nos interesses da segurança nacional, o seguinte:
Artigo 1.º
Objetivo e âmbito
1 - O objetivo do presente Acordo é assegurar a proteção da Informação Classificada trocada entre as Partes, entre uma Parte e um Contratante sob a jurisdição da outra Parte, entre Contratantes sob a respetiva jurisdição das Partes, ou gerada no âmbito de um programa bilateral ao abrigo do presente Acordo. O presente Acordo estabelece os procedimentos e instrumentos de segurança para tal proteção.
2 - As Partes tomam todas as medidas adequadas ao abrigo do seu Direito Interno para assegurar a proteção da Informação Classificada em conformidade com o presente Acordo.
3 - O presente Acordo não constitui uma base para obrigar as Partes a fornecer ou trocar Informação Classificada.
Artigo 2.º
Definições
Para efeitos do presente Acordo:
a) «Acordo» designa o presente documento, incluindo o seu anexo;
b) «Contrato Classificado» designa qualquer instrumento juridicamente vinculativo para fornecimento de bens e/ou prestação de serviços a celebrar por uma das Partes ou por um Contratante sob a sua jurisdição com um Contratante sob a jurisdição da outra Parte, que contenha Informação Classificada ou cuja execução exija acesso ou potencial acesso a Informação Classificada. Este termo inclui a atividade pré-contratual;
c) «Informação Classificada» designa qualquer informação, independentemente da sua forma, à qual seja atribuída um grau de classificação de segurança por uma Parte e cuja divulgação, alteração, comprometimento ou perda não autorizados possa causar diversos graus de danos ou prejuízos aos interesses de uma ou de ambas as Partes. Esta informação pode incluir reproduções, traduções e materiais em fase de desenvolvimento;
d) «Autoridade de Segurança Competente» designa a autoridade governamental de uma Parte responsável pela aplicação e supervisão do presente Acordo. A Autoridade de Segurança Competente pode delegar parte das suas responsabilidades numa autoridade de segurança competente delegada;
e) «Contratante» designa qualquer indivíduo (que não seja contratado por uma Parte ao abrigo de um contrato de trabalho), pessoa coletiva ou outras formas de organização sob a jurisdição de uma Parte, que celebrem ou estejam vinculados por um Contrato Classificado. Este termo inclui um subcontratante;
f) «Credenciação de Segurança Industrial» designa a determinação administrativa pela Autoridade de Segurança Competente de que, do ponto de vista da segurança, uma instalação pode proporcionar proteção de segurança adequada à Informação Classificada, em conformidade com o seu Direito Interno;
g) «Necessidade de Conhecer» designa o requisito para um indivíduo, pessoa coletiva ou outra forma de organização autorizados aceder, ter conhecimento ou possuir Informação Classificada a fim de poder desempenhar as suas funções ou tarefas oficiais;
h) «Parte Originadora» designa a Parte sob cuja autoridade a Informação Classificada foi criada;
i) «Credenciação de Segurança do Pessoal» designa a determinação administrativa pela Autoridade de Segurança Competente de que um indivíduo obteve uma credenciação de segurança para aceder e manusear Informação Classificada até e incluindo um determinado grau de classificação, em conformidade com o seu Direito Interno;
j) «Instrução de Segurança do Programa/Projeto» designa uma compilação de regras e procedimentos de segurança baseados nos normativos de segurança nacional e diretrizes de apoio, que são aplicados a um programa ou projeto específico a fim de padronizar os procedimentos de segurança;
k) «Parte Transmissora» designa a Parte ou o Contratante sob sua jurisdição, que fornece Informação Classificada à Parte Recetora ao abrigo do presente Acordo;
l) «Parte Recetora» designa a Parte ou o Contratante sob sua jurisdição, que recebe Informação Classificada da Parte Transmissora ao abrigo do presente Acordo;
m) «Guia de Classificação de Segurança» designa um documento associado a um Contrato Classificado que especifica os graus de classificação de segurança aplicáveis a cada parte desse Contrato Classificado;
n) «Incidente de Segurança» designa qualquer divulgação, alteração, comprometimento, perda, acesso, manuseamento, armazenamento ou destruição não autorizados de Informação Classificada, contrária ao Direito Interno da Parte Recetora e/ou ao presente Acordo;
o) «Terceira Parte» designa qualquer organização internacional, governo ou Estado, incluindo indivíduos, pessoas coletivas ou outras formas de organização sob a sua jurisdição, que não seja Parte no presente Acordo.
Artigo 3.º
Autoridades de segurança competentes
1 - As Autoridades de Segurança Competentes das Partes estão elencadas no anexo do presente Acordo.
2 - As Autoridades de Segurança Competentes comunicam entre si os dados de contacto oficiais e quaisquer alterações aos mesmos.
Artigo 4.º
Graus de classificação de segurança
1 - As seguintes classificações de segurança das Partes são equivalentes e correspondem aos graus de classificação de segurança especificados no Direito Interno das Partes. O equivalente em inglês é uma tradução informal, não fazendo parte do Direito Interno das Partes e não é utilizado para marcar Informação Classificada.

2 - Os Contratos Classificados no domínio militar com o grau de classificação de segurança equivalente a «DEPARTEMENTAAL VERTROUWELIJK» são tratados como «CONFIDENCIAL» para efeitos de emissão de uma Credenciação de Segurança Industrial, nos termos do artigo 7.º
Artigo 5.º
Medidas de segurança
1 - A Parte Originadora atribui um grau de classificação de segurança à Informação Classificada e marca a Informação Classificada em conformidade com o seu Direito Interno.
2 - A Parte Recetora marca toda a Informação Classificada que tenha recebido da Parte Transmissora com a classificação de segurança da Parte Recetora que corresponde à classificação de segurança atribuída pela Parte Originadora em conformidade com o artigo 4.º e, quando aplicável, em conformidade com o n.º 5 do presente artigo.
3 - A Parte Recetora não modifica nem desclassifica a classificação de segurança de Informação Classificada recebida ou gerada ao abrigo do presente Acordo sem a aprovação por escrito da Parte Originadora.
4 - A Parte Originadora assegura que a Parte Recetora é informada de qualquer alteração do grau de classificação de segurança da Informação Classificada fornecida.
5 - A Parte Originadora pode adicionalmente marcar a Informação Classificada com requisitos de manuseamento, a fim de especificar quaisquer limitações à sua utilização, disponibilização, divulgação e acesso pela Parte Recetora.
6 - À Informação Classificada gerada conjuntamente pelas Partes é atribuída uma classificação de segurança mutuamente determinada pelas Partes.
7 - As Partes conferem à Informação Classificada trocada ou gerada ao abrigo do presente Acordo pelo menos a mesma proteção que conferem à sua própria Informação Classificada no grau de classificação de segurança correspondente.
8 - Nos termos do n.º 2 do artigo 1.º do presente Acordo, as Partes tomam todas as medidas adequadas para garantir que a Parte Transmissora:
a) Marca a Informação Classificada com a classificação de segurança adequada, em conformidade com o seu Direito Interno;
b) Informa a Parte Recetora de quaisquer condições de divulgação ou limitações à utilização da Informação Classificada fornecida.
9 - Nos termos do n.º 2 do artigo 1.º do presente Acordo, as Partes adotam todas as medidas adequadas para garantir que a Parte Recetora:
a) Concede à Informação Classificada o mesmo grau de proteção que o concedido à sua Informação Classificada nacional de grau de classificação de segurança equivalente;
b) Assegura que a Informação Classificada não é divulgada ou transmitida a uma Terceira Parte sem o consentimento prévio, por escrito, da Parte Originadora e, se considerado necessário, mediante condições;
c) Utiliza a Informação Classificada exclusivamente para os fins para que foi divulgada e em conformidade com os requisitos de manuseamento da Parte Originadora.
Artigo 6.º
Acesso a informação classificada
1 - O acesso à Informação Classificada só é concedido a indivíduos que tenham Necessidade de Conhecer, tenham sido informados das suas responsabilidades em matéria de proteção da Informação Classificada e tenham assinado uma declaração de confidencialidade em conformidade com o Direito Interno da Parte Recetora.
2 - Para além dos requisitos previstos no n.º 1 do presente artigo, o acesso à Informação Classificada com grau de classificação de segurança equivalente a «CONFIDENCIAL» e superior, como referido no artigo 4.º do presente Acordo, só é concedido a indivíduos que possuam uma Credenciação de Segurança do Pessoal no grau correspondente ou que estejam de outro modo devidamente autorizados a aceder à Informação Classificada em virtude das suas funções, em conformidade com o Direito Interno da Parte Recetora.
Artigo 7.º
Contratos classificados
1 - A pedido da Parte Originadora, a Autoridade de Segurança Competente da Parte Recetora informa a Autoridade de Segurança Competente da Parte Originadora se foi emitida ao Contratante sob jurisdição da Parte Recetora e que participa num Contrato Classificado, uma Credenciação de Segurança Industrial no grau de classificação de segurança exigido. Se o Contratante não possuir, nesse momento, uma Credenciação de Segurança Industrial, ou se a Credenciação de Segurança Industrial que possui for de grau inferior ao exigido, a Autoridade de Segurança Competente que recebe o pedido informa desse facto a Autoridade de Segurança Competente requerente.
2 - Se uma Parte ou um Contratante sob sua jurisdição se propuser celebrar um Contrato Classificado com um Contratante sob jurisdição da outra Parte num grau de classificação de segurança equivalente a «CONFIDENCIAL» ou superior, como referido no artigo 4.º do presente Acordo, obterá previamente a confirmação escrita da Autoridade de Segurança Competente da outra Parte de que foi concedida ao Contratante uma Credenciação de Segurança Industrial no grau de classificação de segurança adequado. No caso de Contratos Classificados no grau de classificação de segurança equivalente a «RESERVADO», como referido no artigo 4.º do presente Acordo, pode ser exigida uma Credenciação de Segurança Industrial, se tal for exigido pelo respetivo Direito Interno do Contratante.
3 - Nos termos do n.º 2 do artigo 1.º do presente Acordo, a Parte sob cuja jurisdição o Contrato Classificado seja executado assegura que o Contratante:
a) Assegura que todos os indivíduos a quem for concedido acesso a Informação Classificada sejam informados das suas responsabilidades de proteção da Informação Classificada, em conformidade com as condições definidas no presente Acordo e em conformidade com o seu Direito Interno;
b) Monitoriza o comportamento de segurança nas suas instalações;
c) Notifica prontamente a sua Autoridade de Segurança Competente de qualquer Incidente de Segurança relacionado com o Contrato Classificado.
4 - Para além do disposto nas alíneas a), b) e c) do n.º 3 do artigo 7.º do presente Acordo, no caso de Contratos Classificados nos graus de classificação de segurança equivalentes a «CONFIDENCIAL» ou superior, como referido no artigo 4.º do presente Acordo, a Autoridade de Segurança Competente assegura que o Contratante possui uma Credenciação de Segurança Industrial no grau de classificação de segurança adequado, a fim de proteger a Informação Classificada, e que os indivíduos que necessitem de aceder à Informação Classificada possuem uma Credenciação de Segurança do Pessoal no grau de classificação de segurança adequado.
5 - Cada Contrato Classificado inclui requisitos de segurança que identificam os seguintes aspetos:
a) Um Guia de Classificação de Segurança;
b) Um procedimento para a notificação de alterações ao grau de classificação de segurança;
c) Os canais e procedimentos a utilizar para o transporte e/ou transmissão de Informação Classificada;
d) Instruções para manuseamento, armazenamento, destruição e devolução de Informação Classificada;
e) Dados de contacto das Autoridades de Segurança Competentes responsáveis pela supervisão da proteção de Informação Classificada relacionadas com o Contrato Classificado;
f) A obrigação de notificar quaisquer Incidentes de Segurança à Autoridade de Segurança Competente do Contratante e a obrigação de os Contratantes tomarem todas as medidas razoáveis para ajudar a mitigar o efeito de tal violação de segurança, em consulta com a Autoridade de Segurança Competente;
g) No caso de um Contrato Classificado ser subcontratado, no todo ou em parte, a obrigação de impor ao subcontratado todas as estipulações do presente Acordo relativas aos Contratantes;
h) Uma referência ao presente Acordo;
i) Uma declaração que a Informação Classificada trocada ou gerada no âmbito do Contrato Classificado é protegida pelo Contratante em conformidade com o presente Acordo.
6 - A Autoridade de Segurança Competente da Parte ou do Contratante sob sua jurisdição que adjudica o Contrato Classificado envia uma cópia dos requisitos de segurança à Autoridade de Segurança Competente da Parte Recetora, a fim de facilitar a supervisão da segurança do Contrato Classificado.
7 - Quando a dimensão ou a complexidade de um programa ou projeto e a Informação Classificada envolvida exigirem a aplicação de requisitos de segurança adicionais, as Partes, através das respetivas Autoridades de Segurança Competentes, determinam em conjunto uma Instrução de Segurança do Programa/Projeto e incluem-na no Contrato Classificado como um anexo.
8 - Os procedimentos para a aprovação de visitas internacionais associadas a atividades do Contrato Classificado por pessoal de uma Parte ou de um Contratante sob sua jurisdição à outra Parte ou a um Contratante sob a jurisdição da outra Parte têm de estar em conformidade com o artigo 8.º do presente Acordo.
Artigo 8.º
Visitas internacionais
1 - As visitas que requeiram o acesso a Informação Classificada num grau de classificação de segurança equivalente a «CONFIDENCIAL» ou superior, como referido no artigo 4.º do presente Acordo, estão sujeitas a consentimento prévio, por escrito, da Autoridade de Segurança Competente da Parte anfitriã, salvo acordo em contrário entre as Autoridades de Segurança Competentes. Esse consentimento só é dado a pessoas que tenham Necessidade de Conhecer e que possuam uma Credenciação de Segurança do Pessoal válida no grau adequado ou que estejam de outro modo devidamente autorizadas a aceder à Informação Classificada em virtude das suas funções, em conformidade com o Direito Interno da Parte Recetora. Se exigido pelo Direito Interno da Parte anfitriã, as visitas do grau «RESERVADO» podem estar sujeitas a consentimento prévio, por escrito, da Autoridade de Segurança Competente da Parte anfitriã.
2 - O visitante submete o pedido de visita, com a antecedência de pelo menos dez dias seguidos em relação à data proposta para a visita, à sua Autoridade de Segurança Competente, a qual o transmite à Autoridade de Segurança Competente da outra Parte. Em casos urgentes, as Autoridades de Segurança Competentes podem acordar um prazo mais curto.
3 - O pedido de visita inclui:
a) Nome completo do visitante, data e local de nascimento, nacionalidade e número do passaporte/cartão do cidadão;
b) Título oficial e cargo atual do visitante e nome da organização que o visitante representa ou à qual pertence;
c) Confirmação da Credenciação de Segurança do Pessoal do visitante e do seu grau e validade;
d) Data e duração da visita. No caso de visitas recorrentes, é indicado o período total abrangido pelas visitas;
e) Finalidade da visita e o grau de classificação de segurança mais elevado previsto para a Informação Classificada a ser discutida ou acedida;
f) Nome, endereço, número de telefone e endereço eletrónico do ponto de contacto do estabelecimento a visitar;
g) Assinatura datada e carimbada de um representante da Autoridade de Segurança Competente do visitante.
4 - As Autoridades de Segurança Competentes podem acordar uma lista de visitantes autorizados a visitas recorrentes por um período não superior a doze meses. As Autoridades de Segurança Competentes acordar sobre os detalhes adicionais das visitas recorrentes.
5 - A Autoridade de Segurança Competente da Parte anfitriã informa os encarregados de segurança da organização a visitar relativamente aos dados dos indivíduos cujo pedido de visita tenha sido aprovado. Uma vez obtida a aprovação, os preparativos para a visita dos indivíduos, a quem foi dada aprovação para visitas recorrentes, podem ser feitos diretamente com a entidade, instalação ou organização em causa.
6 - A Informação Classificada fornecida a um visitante ou por ele obtida é manuseada em conformidade com o disposto no presente Acordo.
7 - As Partes asseguram, de acordo com o seu Direito Interno, a proteção dos dados pessoais dos indivíduos que solicitem uma visita que requeira acesso a Informação Classificada. Estes dados pessoais não serão utilizados para qualquer outro fim que não seja decidir sobre o pedido de visitas (recorrentes).
Artigo 9.º
Transmissão de informação classificada
1 - A Informação Classificada é transmitida em conformidade com o Direito Interno da Parte Originadora ou conforme acordado entre as Autoridades de Segurança Competentes.
2 - A transmissão eletrónica de Informação Classificada só pode ser efetuada mediante a utilização de meios criptográficos, em conformidade com procedimentos a aprovar conjuntamente pelas Autoridades de Segurança Competentes.
3 - A pedido da Parte Originadora, a Parte Recetora confirma-lhe, por escrito, que recebeu a Informação Classificada.
4 - As Partes, através da sua respetiva Autoridade de Segurança Competente, informam o Contratante dos meios e das normas de embalagem que as Partes aprovaram conjuntamente para a transmissão de Informação Classificada.
5 - Se a Informação Classificada for demasiado volumosa para ser transmitida por correio aprovado, as Partes, através da sua respetiva Autoridade de Segurança Competente, aprovam conjuntamente um plano de transporte que descreva a forma como pretendem transmitir a Informação Classificada. Esse plano pode incluir o tipo de transporte, o itinerário e o tipo de escolta para a Informação Classificada.
Artigo 10.º
Reprodução, tradução e destruição da informação classificada
1 - As reproduções e traduções de Informação Classificada são marcadas e colocadas sob a mesma proteção que a Informação Classificada original.
2 - As reproduções e traduções estão limitadas ao número mínimo necessário para utilização nos termos do presente Acordo.
3 - As traduções contêm uma anotação adequada no idioma da tradução, indicando que contêm Informação Classificada da Parte Originadora.
4 - A Informação Classificada marcada no grau de classificação de segurança equivalente a «MUITO SECRETO», como referido no artigo 4.º do presente Acordo, não é reproduzida ou traduzida sem o consentimento prévio, por escrito, da Parte Originadora.
5 - A Informação Classificada marcada no grau de classificação de segurança equivalente a «MUITO SECRETO», como referido no artigo 4.º do presente Acordo, é devolvida à Parte Originadora após deixar de ser considerada necessária pela Parte Recetora, ou pode ser destruída exclusivamente com o consentimento prévio, por escrito, da Parte Originadora.
6 - A Informação Classificada marcada até e incluindo o grau de classificação de segurança equivalente a «SECRETO», como referido no artigo 4.º do presente Acordo, é destruída após deixar de ser considerada necessária pela Parte Recetora.
7 - Se uma situação de crise tornar impossível para uma Parte Recetora proteger a Informação Classificada fornecida ao abrigo do presente Acordo, a Informação Classificada é imediatamente destruída. A Parte Recetora notifica prontamente, por escrito, a Autoridade de Segurança Competente da Parte Originadora sobre a destruição desta Informação Classificada.
Artigo 11.º
Cooperação em matéria de segurança
1 - As Autoridades de Segurança Competentes informam-se mutuamente das alterações no seu Direito Interno, políticas e práticas para proteção de Informação Classificada.
2 - A pedido da Autoridade de Segurança Competente de uma Parte, a Autoridade de Segurança Competente da outra Parte emite uma confirmação por escrito de que foi emitida uma Credenciação de Segurança do Pessoal ou uma Credenciação de Segurança Industrial válida.
3 - As Autoridades de Segurança Competentes das Partes reconhecem as Credenciações de Segurança do Pessoal e as Credenciações de Segurança Industrial emitidas em conformidade com o Direito Interno da outra Parte e no âmbito do presente Acordo.
4 - As Autoridades de Segurança Competentes auxiliam-se mutuamente na realização de investigações de Credenciação de Segurança Industrial e de Credenciação de Segurança do Pessoal, mediante pedido e em conformidade com o seu Direito Interno.
5 - As Autoridades de Segurança Competentes notificam-se mútua e prontamente, por escrito, das alterações às Credenciações de Segurança do Pessoal e às Credenciações de Segurança Industrial reconhecidas que tenham sido objeto de confirmação.
6 - A cooperação ao abrigo do presente Acordo é efetuada em inglês.
Artigo 12.º
Incidente de segurança
1 - Caso a Parte Recetora suspeite ou confirme um Incidente de Segurança com a Informação Classificada da Parte Originadora, informará, com a maior brevidade possível, por escrito, a sua Autoridade de Segurança Competente. A notificação tem de conter os detalhes suficientes para que a Parte Originadora possa avaliar as consequências e circunstâncias da violação suspeita ou efetiva.
2 - As Autoridades de Segurança Competentes informam-se mútua e imediatamente, por escrito, de qualquer Incidente de Segurança, efetivo ou potencial, que envolva Informação Classificada da outra Parte.
3 - A Parte Recetora investiga imediatamente qualquer Incidente de Segurança, efetivo ou potencial. A Autoridade de Segurança Competente da Parte Originadora, se requerido, coopera na investigação.
4 - A Autoridade de Segurança Competente da Parte Recetora toma as medidas adequadas, em conformidade com o seu Direito Interno, para limitar as consequências e evitar a repetição do Incidente de Segurança. A Autoridade de Segurança Competente da Parte Originadora é informada do resultado da investigação e, se houver, das medidas adotadas.
Artigo 13.º
Custos
Cada Parte suporta os próprios custos incorridos no decurso da aplicação e execução das suas obrigações ao abrigo do presente Acordo, salvo determinação mútua das Partes em contrário.
Artigo 14.º
Resolução de litígios
Qualquer litígio decorrente da interpretação, execução ou aplicação do presente Acordo será resolvido através de consultas ou negociações entre as Partes, por via diplomática.
Artigo 15.º
Instrumentos de aplicação
As Autoridades de Segurança Competentes das Partes podem concluir instrumentos de aplicação nos termos do presente Acordo. Estes instrumentos ficam subordinados ao presente Acordo.
Artigo 16.º
Disposições finais
1 - O presente Acordo é celebrado por tempo indeterminado.
2 - Cada Parte notifica a outra Parte, por via diplomática, da conclusão dos respetivos procedimentos nacionais necessários para a entrada em vigor do presente Acordo. O presente Acordo entra em vigor no primeiro dia do segundo mês seguinte ao da receção da última notificação.
3 - No que diz respeito ao Reino dos Países Baixos, o presente Acordo aplica-se à parte europeia dos Países Baixos e à parte caribenha dos Países Baixos (ilhas de Bonaire, Santo Eustáquio e Saba).
4 - O presente Acordo, incluindo o seu anexo, pode ser revisto em qualquer momento por consentimento mútuo escrito das Partes. Qualquer Parte pode, a qualquer momento, propor emendas ao presente Acordo, por via diplomática. Essas emendas entram em vigor nas condições previstas no n.º 2 do presente artigo, com exceção de uma emenda ao anexo, que entra em vigor numa data a ser acordada pelas Partes.
5 - Qualquer das Partes pode denunciar o presente Acordo, por escrito, em qualquer momento, por via diplomática. Neste caso, o Acordo cessa a sua vigência seis meses após a receção da notificação.
6 - Em caso de denúncia do presente Acordo, toda a Informação Classificada trocada, divulgada ou gerada ao abrigo do presente Acordo permanece protegida em conformidade com os termos do presente Acordo antes de ter sido denunciado, enquanto a Informação Classificada permanecer classificada, salvo acordo mútuo das Partes em contrário.
7 - Após a entrada em vigor do presente Acordo, a Parte em cujo território o mesmo for assinado submetê-lo-á para registo junto do Secretariado das Nações Unidas, nos termos do artigo 102.º da Carta das Nações Unidas e do artigo 80.º da Convenção de Viena sobre o Direito dos Tratados, devendo, igualmente, notificar a outra Parte da conclusão deste processo, indicando o respetivo número de registo.
Em fé do que os representantes das Partes, devidamente autorizados para o efeito, assinaram o presente Acordo.
Feito na Haia, em 11 de dezembro de 2024, em dois originais, nas línguas portuguesa, neerlandesa e inglesa, sendo todos os textos igualmente autênticos. Em caso de divergência de interpretação, prevalece o texto inglês.

Agreement between the Portuguese Republic and the Kingdom of the Netherlands concerning the Exchange and Mutual Protection of Classified Information
The Portuguese Republic and the Kingdom of the Netherlands, hereinafter jointly referred to as “Parties”, and each individually as “Party”,
Recognizing the important role of their joint co-operation in ensuring peace, international security, and mutual confidence,
Considering that they share equivalent security standards for the protection of classified information and
In order to ensure the mutual protection of Classified Information,
Have, in the interests of national security, agreed upon the following:
Article 1
Purpose and scope
1. The purpose of this Agreement is to ensure the protection of Classified Information exchanged between the Parties, between one Party and a Contractor under the jurisdiction of the other Party, between Contractors under the respective Parties’ jurisdiction, or generated in the framework of a bilateral program under this Agreement. This Agreement sets out the security procedures and arrangements for such protection.
2. The Parties shall take all appropriate measures under their internal law to ensure the protection of Classified Information in accordance with this Agreement.
3. This Agreement does not constitute a basis to compel the provision or exchange of Classified Information by the Parties.
Article 2
Definitions
For the purpose of this Agreement:
a) “Agreement” means this document, including its Annex;
b) “Classified Contract” means any legally binding instrument to provide goods and/or services to be entered into by one of the Parties or a Contractor under its jurisdiction with a Contractor under the jurisdiction of the other Party, which contains Classified Information or the performance of which requires access or potential access to Classified Information. This term includes pre-contractual activity;
c) “Classified Information” means any information regardless of its form that is assigned a security classification level by a Party, the unauthorised disclosure, alteration, compromise or loss of which could cause varying degrees of damage or harm to the interests of one or both of the Parties. This information may include reproductions, translations, and material in the process of development;
d) “Competent Security Authority” means the government authority in a Party responsible for the implementation and supervision of this Agreement. The Competent Security Authority may delegate part of its responsibilities to a delegated competent security authority;
e) “Contractor” means any individual (other than those engaged by a Party under a contract of employment), legal entity or other forms of organisation under the jurisdiction of a Party, entering into or bound by a Classified Contract. This term includes a sub-contractor;
f) “Facility Security Clearance” means the administrative determination by the Competent Security Authority that, from a security viewpoint, a facility can afford adequate security protection to Classified Information, in accordance with its internal law;
g) “Need to Know” means the requirement for an authorised individual, legal entity or other form of organisation to access, have knowledge of, or possess Classified Information in order to be able to perform their official duties or services;
h) “Originating Party” means the Party under whose authority Classified Information has been created;
i) “Personnel Security Clearance” means the administrative determination by the Competent Security Authority that an individual has been security cleared to access and handle Classified Information up to and including a specified classification level, in accordance with its internal law;
j) “Program/Project Security Instruction” means a compilation of security regulations and procedures based on national security policy and supporting directives, which are applied to a specific program or project in order to standardize security procedures;
k) “Providing Party” means the Party or Contractor under its jurisdiction, which provides Classified Information to the Receiving Party under this Agreement;
l) “Receiving Party” means the Party or Contractor under its jurisdiction, which receives Classified Information from the Providing Party under this Agreement;
m) “Security Classification Guide” means a document associated with a Classified Contract specifying the applicable security classification levels of each part of that Classified Contract;
n) “Security Incident” means any unauthorised disclosure, alteration, compromise, loss, access, handling, storage or destruction of Classified Information, contrary to internal law of the Receiving Party and/or this Agreement;
o) “Third Party” means any international organisation, government or state, including individuals, legal entities or other forms of organisation under its jurisdiction, which is not a Party to this Agreement.
Article 3
Competent security authorities
1. The Competent Security Authorities of the Parties are listed in the Annex of this Agreement.
2. The Competent Security Authorities shall provide each other with official contact details and any changes thereof.
Article 4
Security classification levels
1. The following security classifications of the Parties are equivalent and correspond to the security classification levels specified in the Parties’ internal law. The English equivalent is an informal translation, not part of the internal law of the Parties and shall not be used to mark Classified Information.

2. Classified Contracts within the military domain at the security classification level equivalent to “DEPARTEMENTAAL VERTROUWELIJK” shall be treated as “CONFIDENCIAL” for the purpose of issuing a Facility Security Clearance pursuant to article 7.
Article 5
Security measures
1. The Originating Party shall assign a security classification level to Classified Information and shall mark the Classified Information according to its internal law.
2. The Receiving Party shall mark all the Classified Information that it has received from the Providing Party with the Receiving Party’s security classification that corresponds to the security classification given by the Originating Party in accordance with article 4 and, where applicable, in accordance with paragraph 5 of this article.
3. The Receiving Party shall not modify or revoke the security classification of received or generated Classified Information under this Agreement without the written approval of the Originating Party.
4. The Originating Party shall ensure that the Receiving Party will be informed of any change in the security classification level of the Classified Information provided.
5. The Originating Party may additionally mark the Classified Information with handling requirements, to specify any limitations on its use, disclosure, release and access by the Receiving Party.
6. Classified Information jointly originated by the Parties shall be assigned a security classification that is mutually determined by the Parties.
7. The Parties shall afford Classified Information exchanged or generated under this Agreement at least the same protection as they afford to their own Classified Information at the corresponding security classification level.
8. In accordance with article 1, paragraph 2 of this Agreement, the Parties shall take all appropriate measures to ensure that the Providing Party:
a) marks Classified Information with the appropriate security classification in accordance with its internal law;
b) informs the Receiving Party of any conditions of release or limitations on the use of the Classified Information provided.
9. In accordance with article 1, paragraph 2 of this Agreement, the Parties shall take all appropriate measures to ensure that the Receiving Party:
a) affords the same level of protection to Classified Information as afforded to its national Classified Information of an equivalent security classification level;
b) ensures that Classified Information is not disclosed or released to a Third Party without the prior written consent of the Originating Party and, if deemed necessary, on conditions;
c) uses Classified Information solely for the purpose it has been released for and in accordance with handling requirements of the Originating Party.
Article 6
Access to classified information
1. Access to Classified Information shall be granted only to those individuals who have a Need to Know, are briefed on their responsibilities for the protection of Classified Information, and have signed a statement of confidentiality in accordance with the internal law of the Receiving Party.
2. In addition to the requirements in paragraph 1 of this article, access to Classified Information at the security classification levels equivalent to “CONFIDENTIAL” and above as mentioned in article 4 of this Agreement, shall be granted only to those individuals who hold a Personnel Security Clearance at the corresponding level or who are otherwise duly authorised to access Classified Information by virtue of their function, in accordance with the internal law of the Receiving Party.
Article 7
Classified contracts
1. Upon request of the Originating Party, the Competent Security Authority of the Receiving Party shall inform the Competent Security Authority of the Originating Party whether a Contractor, under jurisdiction of the Receiving Party and participating in a Classified Contract, has been issued a Facility Security Clearance at the required security classification level. If the Contractor does not, at that point, hold a Facility Security Clearance, or the Facility Security Clearance is at a lower level than that required, the Competent Security Authority receiving the request shall inform the requesting Competent Security Authority of that fact.
2. If a Party or a Contractor under its jurisdiction proposes to grant a Classified Contract at a security classification level equivalent to “CONFIDENTIAL” or above as mentioned in article 4 of this Agreement, with a Contractor under the jurisdiction of the other Party, it shall first obtain written confirmation from the Competent Security Authority of the other Party that the Contractor has been granted a Facility Security Clearance at the appropriate security classification level. For Classified Contracts at the security classification level equivalent to “RESTRICTED” as mentioned in article 4 of this Agreement, a Facility Security Clearance may be required, if mandated by respective internal law of the Contractor.
3. In accordance with article 1, paragraph 2 of this Agreement, the Party under whose jurisdiction the Classified Contract is to be performed shall ensure that the Contractor:
a) ensures that all individuals granted access to Classified Information are informed of their responsibilities to protect Classified Information in accordance with the conditions defined in this Agreement and in accordance with their internal law;
b) monitors the security conduct within its facilities;
c) notifies promptly its Competent Security Authority of any Security Incident relating to the Classified Contract.
4. In addition to article 7, paragraph 3, subparagraphs a), b) and c) of this Agreement, for Classified Contracts at the security classification levels equivalent to “CONFIDENTIAL” or above as mentioned in article 4 of this Agreement, the Competent Security Authority shall ensure that the Contractor holds a Facility Security Clearance at the appropriate security classification level in order to protect the Classified Information and that the individuals requiring access to Classified Information hold a Personnel Security Clearance at the appropriate security classification level.
5. Every Classified Contract shall include security requirements which identify the following aspects:
a) a Security Classification Guide;
b) a procedure for notification of changes in the security classification level;
c) the channels and procedures to be used for the transport and/or transmission of Classified Information;
d) instructions for the handling, storage, destruction and returning of Classified Information;
e) contact details of the Competent Security Authorities responsible for overseeing the protection of Classified Information related to the Classified Contract;
f) the obligation to notify any Security Incidents to the Competent Security Authority of the Contractor and the obligation for Contractors to take all reasonable steps to assist in mitigating the effect of such a security violation, in consultation with the Competent Security Authority;
g) in case a Classified Contract in whole or in part is sub-contracted, the obligation to impose all the stipulations concerning Contractors in this Agreement to the sub-Contractor;
h) a reference to this Agreement;
i) a statement that Classified Information exchanged or generated pursuant to the Classified Contract shall be protected by the Contractor in accordance with this Agreement.
6. The Competent Security Authority of the Party or a Contractor under its jurisdiction awarding the Classified Contract shall forward a copy of the security requirements to the Competent Security Authority of the Receiving Party, to facilitate the security oversight of the Classified Contract.
7. When the size or complexity of a program or project and the Classified Information involved require the application of additional security requirements, the Parties, through their respective Competent Security Authorities, shall jointly determine a Program/Project Security Instruction and include it in the Classified Contract as an annex.
8. The procedures for the approval of international visits associated with Classified Contract activities by personnel of one Party or a Contractor under its jurisdiction to the other Party or a Contractor under the other Party’s jurisdiction shall be in accordance with article 8 of this Agreement.
Article 8
International visits
1. Visits requiring access to Classified Information at a security classification level equivalent to “CONFIDENTIAL” or above as mentioned in article 4 of this Agreement are subject to the prior written consent of the Competent Security Authority of the host Party, unless otherwise agreed between the Competent Security Authorities. Such consent shall be given only to persons who have a Need to Know and who hold a valid Personnel Security Clearance at the appropriate level or who are otherwise duly authorised to access Classified Information by virtue of their function, in accordance with the internal law of the Receiving Party. If mandated by internal law of the host Party, “RESTRICTED” level visits may be subject to the prior written consent of the Competent Security Authority of the host Party.
2. The visitor shall submit the request for visit at least ten calendar days in advance of the proposed date of the visit to his Competent Security Authority, which shall forward it to the Competent Security Authority of the other Party. In urgent cases, the Competent Security Authorities may agree on a shorter period.
3. Request for visit shall include:
a) full name of the visitor, date and place of birth, nationality and passport/ID card number;
b) official title and present position of the visitor and name of the organization the visitor represents or to which the visitor belongs;
c) confirmation of the visitor’s Personnel Security Clearance and its level and validity;
d) date and duration of the visit. In the case of recurring visits the total period covered by the visits shall be stated;
e) purpose of the visit and the anticipated highest security classification level of Classified Information to be discussed or accessed;
f) name, address, phone number, e-mail address of the facility’s point of contact to be visited;
g) dated and stamped signature of a representative of the visitor’s Competent Security Authority.
4. The Competent Security Authorities may agree on a list of visitors entitled to recurring visits for a period not exceeding twelve months. The Competent Security Authorities shall agree on the further details of the recurring visits.
5. The Competent Security Authority of the host Party shall inform the security officials of the organization to be visited, of the details of those individuals whose visit request has been approved. Once approval has been given, visit arrangements for individuals who have been given approval for recurring visits may be made directly with the agency, facility or organization concerned.
6. Classified Information provided to or obtained by a visitor shall be handled in accordance with the provisions of this Agreement.
7. The parties shall ensure, pursuant to their internal law, the protection of the personal data of the individuals requesting for a visit requiring access to Classified Information. This personal data shall not be used for any other purpose than determining on the request for (recurring) visits.
Article 9
Transmission of classified information
1. Classified Information shall be transmitted in accordance with internal law of the Originating Party or as otherwise agreed between the Competent Security Authorities.
2. Electronic transmission of Classified Information may take place only by using cryptographic means in accordance with procedures to be approved jointly by the Competent Security Authorities.
3. At the request of the Originating Party, the Receiving Party shall provide the Originating Party with confirmation, in writing, that it has received Classified Information.
4. The Parties, through their respective Competent Security Authority, shall advise a contractor of the means and the packaging standards that the Parties have jointly approved for the transmission of Classified Information.
5. If Classified Information is too voluminous to be transmitted by approved courier, the Parties, through their respective Competent Security Authority, shall jointly approve a transportation plan that describes how they intend to transmit the Classified Information. That plan may include the type of transport, the route, and the type of escort for the Classified Information.
Article 10
Reproduction, translation and destruction of classified information
1. Reproductions and translations of Classified Information shall be marked and placed under the same protection as the original Classified Information.
2. Reproductions and translations shall be limited to the minimum number required for use under this Agreement.
3. Translations shall contain a suitable annotation in the language of translation, indicating that they contain Classified Information of the Originating Party.
4. Classified Information marked at the security classification level equivalent to “TOP SECRET” as mentioned in article 4 of this Agreement, shall not be reproduced or translated without the prior written consent of the Originating Party.
5. Classified Information marked at the security classification level equivalent to “TOP SECRET” as mentioned in article 4 of this Agreement shall be returned to the Originating Party after it is no longer considered necessary by the Receiving Party, or it may be destroyed solely with the prior written consent of the Originating Party.
6. Classified Information marked up to and including the security classification level equivalent to “SECRET” as mentioned in article 4 of this Agreement, shall be destroyed after it is no longer considered necessary by the Receiving Party.
7. If a crisis situation makes it impossible for a Receiving Party to protect Classified Information provided under this Agreement, the Classified Information shall be destroyed immediately. The Receiving Party shall notify promptly in writing the Competent Security Authority of the Originating Party about the destruction of this Classified Information.
Article 11
Security co-operation
1. The Competent Security Authorities shall inform each other about changes in their internal law, policies and practices for protecting Classified Information.
2. On request of the Competent Security Authority of one Party, the Competent Security Authority of the other Party shall issue a written confirmation that a valid Personnel Security Clearance or Facility Security Clearance has been issued.
3. The Competent Security Authorities of the Parties shall recognize Personnel Security Clearances and Facility Security Clearances issued in accordance with the internal law of the other Party and in the scope of this Agreement.
4. The Competent Security Authorities shall assist each other in carrying out Facility Security Clearance and Personnel Security Clearance investigations on request and in accordance with their internal law.
5. The Competent Security Authorities shall promptly notify each other in writing about changes in recognised Personnel Security Clearances and Facility Security Clearances for whom or for which a confirmation has been provided.
6. The co-operation under this Agreement shall be effected in English.
Article 12
Security incident
1. In case a Security Incident of the Classified Information of the Originating Party is suspected or ascertained by the Receiving Party, it shall inform its Competent Security Authority in writing as soon as possible. The notice must contain sufficient details for the Originating Party to assess the consequences and circumstances of the suspected or actual violation.
2. The Competent Security Authorities shall immediately inform each other in writing of any actual or potential Security Incident involving Classified Information of the other Party.
3. The Receiving Party shall immediately investigate any actual or potential Security Incident. The Competent Security Authority of the Originating Party shall, if required, cooperate in the investigation.
4. The Competent Security Authority of the Receiving Party shall take appropriate measures in accordance with its internal law to limit the consequences and to prevent a recurrence of the Security Incident. The Competent Security Authority of the Originating Party shall be informed of the outcome of the investigation and, if any, of the measures taken.
Article 13
Costs
Each Party shall bear its own costs incurred in the course of implementing and executing its obligations under this Agreement, unless otherwise mutually determined by the Parties.
Article 14
Dispute resolution
Any dispute arising from the interpretation, implementation or application of this Agreement shall be settled through consultation or negotiations between the Parties, through diplomatic channels.
Article 15
Implementing arrangements
The Competent Security Authorities of the Parties may conclude implementing arrangements pursuant to this Agreement. These arrangements are subordinate to this Agreement.
Article 16
Final provisions
1. This Agreement is concluded for an indefinite period of time.
2. Each Party shall notify the other Party, through diplomatic channels, once the respective national procedures necessary for entry into force of this Agreement have been completed. This Agreement shall enter into force on the first day of the second month following the receipt of the latter notification.
3. With regard to the Kingdom of the Netherlands, this Agreement shall apply to the European part of the Netherlands and the Caribbean part of the Netherlands (the islands of Bonaire, Sint Eustatius and Saba).
4. This Agreement, including its Annex, may be amended at any time by mutual written consent of the Parties. Either Party may propose amendments to this Agreement at any time through diplomatic channels. Such amendments shall enter into force under the conditions laid down in paragraph 2 of this article, with the exception of an amendment to the Annex, which shall enter into force on a date to be agreed upon by the Parties.
5. Either Party may terminate this Agreement in writing at any time through diplomatic channels. In this case, the Agreement shall expire six months after the receipt of such notification.
6. In case of termination of this Agreement, all Classified Information exchanged, released or generated under this Agreement shall remain protected in accordance with the terms of this Agreement before it was terminated, for as long as the Classified Information remains classified, unless the Parties mutually agree otherwise.
7. After the entry into force of this Agreement, the Party in whose territory it is signed shall transmit it for registration to the Secretariat of the United Nations, according to Article 102 of the Charter of the United Nations and Article 80 of the Vienna Convention on the Law of Treaties and shall notify the other Party of the conclusion of this proceeding, indicating the respective number of registration.
In witness whereof the representatives of the Parties, duly authorised thereto, have signed this Agreement.
Done in The Hague, on the 11th of December 2024, in two original copies, in the Portuguese, Dutch, and English languages, all texts being equally authentic. In case of divergence of interpretation, the English text shall prevail.
