O Governo decreta, nos termos da alínea c) do artigo 200.º da Constituição, o seguinte:

Artigo único. É aprovado para ratificação o Protocolo referente ao Texto Autêntico Quadrilingue da Convenção sobre Aviação Civil Internacional, concluído em Montreal em 30 de Setembro de 1977, cujo texto em inglês e a respectiva tradução para português vão anexos ao presente decreto.

Protocol on the Authentic Quadrilingual Text of the Convention on International Civil Aviation (Chicago, 1944).

The undersigned Governments:

Considering that the 21st Session of the Assembly of the International Civil Aviation Organization requested the Council of this Organization «to undertake the necessary measures for the preparation of the authentic text of the Convention on International Civil Aviation in the Russian language, with the aim of having it approved not later than the year 1977»;

Considering that the English text of the Convention on International Civil Aviation was opened for signature at Chicago on 7 December 1944;

Considering that, pursuant to the Protocol signed at Buenos Aires on 24 September 1968 on the authentic trilingual text of the Convention on International Civil Aviation done at Chicago, 7 December 1944, the text of the Convention on International Civil Aviation (hereinafter called the Convention) was adopted in the French and Spanish languages and, together with the text of the Convention in the English language, constitutes the text equally authentic in the three languages as provided for in the final clause of the Convention;

Considering accordingly, trat it is appropriate to make the necessary provision for the text of the Convention to exist in the Russian language;

Considering that in making such provision account must be taken of the existing amendments to the Convention in the English, French and Spanish languages, the texts of which are equally authentic and that, according to article 94 (a) of the Convention, any amendment can come into force only in respect of any State which has ratified it;

have agreed as follows:

ARTICLE I

The text of the Convention and of the amendments thereto in the Russian language annexed to this Protocol, together with the text of the Convention and of the amendments thereto in the English, French and Spanish languages, constitutes a text equally authentic in the four languages.

ARTICLE II

If a State party to this Protocol has ratified or in the future ratifies any amendment made to the Convention in accordance with article 94 (a) thereof, then the text of such amendment in the Russian, English, French and Spanish languages shall be deemed to refer to the text equally authentic in the four languages, which results from this Protocol.

ARTICLE III

1) The States Members of the International Civil Aviation Organization may become parties to the present Protocol either by:

a) Signature without reservation as to acceptance; or

b) Signature with reservation as to acceptance followed by acceptance; or

c) Acceptance.

2) This Protocol shall remain open for signature at Montreal until the 5th of October 1977 and thereafter at Washington, D. C.

3) Acceptance shall be effected by the deposit of an instrument of acceptance with the Government of the United States of America.

4) Adherence to or ratification or approval of this Protocol shall be deemed to be acceptance thereof.

ARTICLE IV

1) This Protocol shall come into force on the thirtieth day after twelve States shall, in accordance with the provisions of article III, have signed it without reservation as to acceptance or accepted it and after entry into force of the amendment to the final clause of the Convention, which provides that the text of the Convention in the Russian language is of equal authenticity.

2) As regards any State which shall subsequently become a party to this Protocol in accordance with article III, the Protocol shall come into force on the date of its signature without reservation as to acceptance or of its acceptance.

ARTICLE V

Any adherence of a State to the Convention after this Protocol has entered into force shall be deemed to be acceptance of this Protocol.

ARTICLE VI

Acceptance by a State of this Protocol shall not be regarded as ratification by it of any amendment to the Convention.

ARTICLE VII

As soon as this Protocol comes into force, it shall be registered with the United Nations and with the International Civil Aviation Organization by the Government of the United States of America.

ARTICLE VIII

1) This Protocol shall remain in force so long the Convention is in force.

2) This Protocol shall cease to be in force for a State only when that State ceases to be a party to the Convention.

ARTICLE IX

The Government of the United States of America shall give notice to all States Members of the International Civil Aviation Organization and to the Organization itself:

a) Of any signature of this Protocol and the date thereof, with an indication whether the signature is with or without reservation as to acceptance;

b) Of the deposit of any instrument of acceptance and the date thereof;

c) Of the date on which this Protocol comes into force in accordance with the provisions of article IV, paragraph 1).

ARTICLE X

This Protocol, drawn up in the English, French, Russian and Spanish languages, each text being equally authentic, shall be deposited in the archives of the Government of the United States of America, which shall transmit duly certified copies thereof to the Governments of the Stats Members of the International Civil Aviation Organization.

In witness whereof, the undersigned plenipotentiaries, duly authorized, have signed this Protocol.

Done at Montreal this thirtieth day of September, one thousand nine hundred and seventy-seven.

Protocolo Relativo ao Texto Autêntico Quadrilingue da Convenção sobre Aviação Civil Internacional (Chicago, 1944).

Os Governos abaixo assinados:

Considerando que a 21.ª Sessão da Assembleia da Organização da Aviação Civil Internacional solicitou ao Conselho da Organização «que tomasse as medidas necessárias à elaboração de um texto autêntico da Convenção sobre Aviação Civil Internacional em língua russa, a fim de que o mesmo fosse aprovado até ao termo do ano de 1977»;

Considerando que o texto em língua inglesa da Convenção sobre Aviação Civil Internacional foi aberto à assinatura em Chicago em 7 de Dezembro de 1944;

Considerando que, em conformidade com o Protocolo assinado em Buenos Aires em 24 de Setembro de 1968 relativo ao texto autêntico trilingue da Convenção sobre Aviação Civil Internacional concluída em Chicago em 7 de Dezembro de 1944, o texto da Convenção sobre Aviação Civil Internacional (daqui em diante designada por «a Convenção») foi adoptado nas línguas espanhola e francesa e que, conjuntamente com o texto em língua inglesa da Convenção, constitui o texto igualmente autêntico nas três línguas, conforme definido na cláusula final da Convenção;

Considerando que, nesta conformidade, se torna necessário incluir no texto da Convenção uma disposição destinada a que a mesma exista em língua russa;

Considerando que, ao elaborar tal disposição, deverão ser tomadas em consideração as emendas feitas à Convenção nas línguas espanhola, francesa e inglesa, cujos textos são igualmente autênticos, e que, em conformidade com o artigo 94.º (a) da Convenção, qualquer emenda apenas entrará em vigor para os Estados que a tenham ratificado;

acordaram no seguinte:

ARTIGO I

O texto em língua russa da Convenção e respectivas emendas, anexo ao presente Protocolo, conjuntamente com o texto da Convenção e respectivas emendas nas línguas espanhola, francesa e inglesa, constitui o texto igualmente autêntico nas quatro línguas.

ARTIGO II

Se um Estado parte no presente Protocolo tiver ratificado, ou vier a ratificar, qualquer emenda à Convenção, em conformidade com o artigo 94.º (a) da mesma, considerar-se-á que o texto de tal emenda, nas línguas espanhola, francesa, inglesa e russa, se refere ao texto igualmente autêntico nas quatro línguas. resultante do presente Protocolo.

ARTIGO III

1) Os Estados Membros da Organização da Aviação Civil Internacional poderão tornar-se partes no presente Protocolo mediante:

a) Assinatura sem reserva de aceitação;

b) Assinatura sob reserva de aceitação, seguida de aceitação;

c) Aceitação.

2) O presente Protocolo permanecerá aberto à assinatura em Montreal até 5 de Outubro de 1977 e, a partir desta data, em Washington, D. C.

3) A aceitação será efectuada mediante depósito de um instrumento de aceitação junto do Governo dos Estados Unidos da América.

4) A adesão ao presente Protocolo ou a sua ratificação ou aprovação serão consideradas como aceitação do mesmo.

ARTIGO IV

1) O presente Protocolo entrará em vigor trinta dias após a data em que doze Estados, em conformidade com as disposições do artigo III, o tenham assinado, sem reserva de aceitação, ou o tenham aceite, e após a entrada em vigor da emenda à disposição final da Convenção que estabelece a igual autenticidade do texto da Convenção em língua russa.

2) No que se refere a qualquer Estado que posteriormente se torne parte no presente Protocolo, em conformidade com o artigo III, o presente Protocolo entrará em vigor na data da sua assinatura, sem reserva de aceitação, ou na data da sua aceitação.

ARTIGO V

A adesão de um Estado à Convenção após a entrada em vigor do presente Protocolo será considerada como aceitação do presente Protocolo.

ARTIGO VI

A aceitação do presente Protocolo por um Estado não será considerada como ratificação por esse mesmo Estado de qualquer emenda à Convenção.

ARTIGO VII

Imediatamente após a entrada em vigor do presente Protocolo, o Governo dos Estados Unidos da América registá-lo-á junto das Nações Unidas e da Organização da Aviação Civil Internacional.

ARTIGO VIII

1) O presente Protocolo permanecerá em vigor enquanto vigorar a Convenção.

2) O presente Protocolo deixará de estar em vigor, para um determinado Estado, apenas quando esse Estado deixar de ser parte na Convenção.

ARTIGO IX

O Governo dos Estados Unidos da América notificará todos os Estados Membros da Organização da Aviação Civil Internacional, e a própria Organização do seguinte:

a) Assinaturas do presente Protocolo e datas das mesmas, com a indicação de as assinaturas terem sido feitas com ou sem reserva de aceitação;

b) Depósitos de quaisquer instrumentos de aceitação e datas dos mesmos;

c) Datas da entrada em vigor do presente Protocolo, em conformidade com a disposição do prágrafo 1) do artigo IV.

ARTIGO X

O presente Protocolo, redigido nas línguas espanhola, francesa, inglesa e russa, cada um dos textos fazendo igualmente fé, será depositado nos arquivos do Governo dos Estados Unidos da América, o qual enviará cópias autenticadas aos Governos dos Estados Membros da Organização da Aviação Civil Internacional.

Em testemunho do que os plenipotenciários abaixo assinados, devidamente autorizados, assinaram o presente Protocolo.
