Considerando a assinatura do Acordo de Cooperação entre a República Portuguesa e a Federação da Rússia no Domínio do Turismo;
Consciente de que este Acordo permitirá incrementar o desenvolvimento da cooperação no domínio do turismo, possibilitando um melhor entendimento da vida, história e património cultural dos dois Estados;
Atendendo a que a sua entrada em vigor irá contribuir para a promoção do intercâmbio de informações nos mais diversos domínios, como, por exemplo, a troca de experiências na formação profissional e a oportunidades de investimento:
Assim:
Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição, o Governo aprova o Acordo de Cooperação entre a República Portuguesa e a Federação da Rússia no Domínio do Turismo, cujo texto, nas versões autenticadas nas línguas portuguesa, russa e inglesa, se publica em anexo.

ACORDO DE COOPERAÇÃO ENTRE A REPÚBLICA PORTUGUESA E A FEDERAÇÃO DA RÚSSIA NO DOMÍNIO DO TURISMO
A República Portuguesa e a Federação da Rússia, doravante designadas por Partes:
Acolhendo as disposições da Declaração de Manila sobre Turismo Mundial (1980) e da Declaração da Haia sobre Turismo (1989);
Desejando contribuir para o alargamento dos laços de amizade entre os povos da República Portuguesa e da Federação da Rússia para um melhor conhecimento da sua vida, história e herança cultural;
Considerando o turismo um meio importante para o reforço da compreensão mútua, da expressão de boa vontade e da consolidação das relações entre os povos;
acordam no seguinte:
Artigo 1.º
Objecto
As Partes desenvolverão e reforçarão a cooperação no domínio do turismo, com base no princípio da igualdade e de benefícios mútuos, em conformidade com a respectiva legislação e acordos internacionais em vigor dos quais sejam Partes.
Artigo 2.º
Desenvolvimento da actividade turística
As Partes:
a) Encorajarão o turismo organizado em grupo ou individual;
b) Apoiarão o desenvolvimento da cooperação entre organizações turísticas dos dois países, particularmente através do intercâmbio de informação sobre oportunidades de investimento na área do turismo;
c) Apoiarão os empreendimentos conjuntos no domínio de prestação de serviços a turistas.
Artigo 3.º
Intercâmbio turístico
As Partes procurarão, em conformidade com a respectiva legislação em vigor, simplificar as formalidades relacionadas com o intercâmbio turístico entre os dois países.
Artigo 4.º
Turismo especializado
As Partes incentivarão o intercâmbio de grupos de turistas especializados, particularmente o que tenha como fins a comparência em exposições, simpósios e congressos sobre turismo.
Artigo 5.º
Intercâmbio de informação e documentação
As Partes incentivarão, através das administrações nacionais de turismo, o intercâmbio de informação promocional e estatística no domínio do turismo, incluindo:
a) Legislação que regula a actividade turística nos dois países;
b) Legislação nacional que regula a protecção e a preservação dos recursos naturais e culturais considerados atracções turísticas;
c) A experiência em gestão de hotéis e de outros meios de alojamento para turistas.
Artigo 6.º
Informação ao viajante
As Partes informarão os cidadãos que viajem para cada um dos países sobre a legislação vigente relativa à entrada, permanência e partida de estrangeiros.
Artigo 7.º
Intercâmbio de peritos
1 - As Partes promoverão, através das administrações nacionais de turismo, a assistência mútua no intercâmbio de peritos e jornalistas especializados em questões do turismo e encorajarão os contactos e a cooperação entre as organizações que executam, na República Portuguesa e na Federação da Rússia, pesquisas no domínio do turismo.
2 - O apoio financeiro a ser dado ao intercâmbio de peritos será coordenado, em cada caso concreto, entre as administrações nacionais de turismo.
Artigo 8.º
Organizações internacionais
As administrações nacionais de turismo das Partes desenvolverão a cooperação no âmbito da Organização Mundial do Turismo e de outras organizações internacionais de turismo.
Artigo 9.º
Representações oficiais de turismo
As Partes facilitarão a abertura de representações oficiais das administrações nacionais de turismo nos seus territórios em conformidade com a respectiva legislação.
Artigo 10.º
Aplicação
As Partes darão conhecimento, mutuamente e por via diplomática, das autoridades de turismo responsáveis pela aplicação do presente Acordo.
Artigo 11.º
Comissão mista
1 - Será instituída uma comissão mista constituída por responsáveis dos organismos do sector do turismo de cada uma das Partes.
2 - A comissão mista será presidida por um representante de cada Parte.
3 - A comissão mista terá as seguintes competências:
a) Garantir a integral aplicação do presente Acordo;
b) Contribuir para a resolução de eventuais divergências resultantes da aplicação do presente Acordo;
c) Elaborar o programa de trabalho para períodos de três anos, determinando as prioridades da cooperação.
4 - As administrações nacionais de turismo das Partes elaborarão um relatório anual de análise e de avaliação da execução do presente Acordo.
5 - A primeira reunião da comissão mista terá lugar três meses depois da entrada em vigor do presente Acordo, devendo esta reunir-se uma vez em cada três anos.
6 - As Partes poderão convidar peritos e representantes do sector privado dos respectivos países a participar nas actividades da comissão mista.
Artigo 12.º
Vigência e denúncia
1 - O presente Acordo vigorará por um período de cinco anos, renovável automaticamente por iguais períodos.
2 - Ambas as Partes poderão denunciar o presente Acordo com uma antecedência mínima de seis meses, antes do término de cada período.
3 - A denúncia será efectuada por escrito e por via diplomática.
4 - A cessação do presente Acordo não afectará a execução dos programas e projectos acordados no período da sua vigência, salvo se as Partes acordarem em contrário.
Artigo 13.º
Entrada em vigor
O presente Acordo entrará em vigor 30 dias após a data de recepção da última notificação, por escrito e por via diplomática, de que foram cumpridos todos os requisitos legais necessários para o efeito.
Feito em Lisboa, aos 27 de Fevereiro de 2007, em dois exemplares originais, nas línguas portuguesa, russa e inglesa, fazendo todos os textos igualmente fé. Em caso de divergência de interpretação, prevalecerá a versão inglesa.

AGREEMENT BETWEEN THE PORTUGUESE REPUBLIC AND THE RUSSIAN FEDERATION ON COOPERATION IN THE FIELD OF TOURISM
The Portuguese Republic and the Russian Federation hereinafter referred to as the Parties:
Sharing the provisions of the Manila Declaration on World Tourism (1980) and of the Hague Declaration on Tourism (1989);
Expressing the willingness to facilitate friendly relations between the peoples of the Russian Federation and the Portuguese Republic, for the better acquaintance with the life, history and their cultural heritage;
Realizing that the tourism is an important means of strengthening the mutual understanding, the expression of goodwill and consolidation of the relations between the peoples;
agree as follows:
Article 1
Object
The Parties shall strengthen and develop cooperation within the sphere of tourism on the basis of equality and mutual benefit in accordance with the national legislation of the Parties and international agreements in force they are parties to.
Article 2
Development of tourist activity
The Parties shall:
a) Encourage tourism, organized either in group or individually;
b) Support the development of cooperation between touristic organizations of both countries, particularly by means of exchange of information about investment opportunities in the field of tourism;
c) Support the joint venture in the area of services provided to tourists.
Article 3
Tourist exchange
The Parties, according to the national legislation in force, shall agree to simplify the formalities connected with tourist exchange between both countries.
Article 4
Special tourism
The Parties shall encourage the exchange of specialized tourist groups, particularly those arriving with the purpose of visiting exhibitions, symposia and congress on tourism.
Article 5
Exchange of information and documentation
The Parties shall encourage, through the National Tourism Administrations, the exchange of promotion and statistical information in the field of tourism, including:
a) Legislation regulating tourism activity in both countries;
b) National legislation regulating the protection and preservation of natural and cultural resources considered touristic attractions;
c) Management experience on hotel and other types of accommodation for tourists.
Article 6
Travel advisory service
The Parties shall inform the citizens travelling to either country on the legislation in force regulating the entry, stay and departure of foreigners.
Article 7
Exchange of experts
1 - The Parties shall facilitate through the National Tourism Administrations, mutual assistance in the exchange of experts and journalists, with touristic expertise, and shall encourage contacts and co-operation between the organizations, which are carrying out researches in the field of tourism in the Russian Federation and the Portuguese Republic.
2 - Financial support to visit exchange of experts will be coordinated, in each case, between the National Tourism Administrations.
Article 8
International organizations
The National Tourism Administrations of the Parties shall develop cooperation within the framework of the World Tourism Organization and other international tourism organizations.
Article 9
Tourism representative offices
The Parties shall facilitate the opening by National Tourism Administrations of official representations on both territories according to the legislation of the Parties.
Article 10
Application
The Parties shall notify each other, through diplomatic channels, of the tourism authorities responsible for the application of the present Agreement.
Article 11
Joint commission
1 - The Parties shall establish a joint commission composed by tourism officials of both Parties.
2 - The joint commission shall be headed by a representative of each Party.
3 - The joint commission shall have the following competences:
a) To guarantee the full application of the present Agreement;
b) To contribute towards the resolution of issues emerged from the application of the present Agreement;
c) To elaborate a working programme for a three year period determining the priorities of the co-operation.
4 - National Tourism Administrations of the Parties shall prepare a report every year regarding the analysis and evaluation of the performance and execution of the present Agreement.
5 - The joint commission's first meeting shall be held three months after the entry into force of this Agreement, and subsequently every three years.
6 - The Parties may invite experts and representatives of the private sector from both countries to participate in the activities of the joint commission.
Article 12
Duration and termination
1 - The present Agreement shall remain in force for a period of five years, automatically renewed for identical periods.
2 - Both Parties can terminate the present Agreement no latter than six months prior to its expiration.
3 - The termination shall be made by a written notification, through diplomatic channels.
4 - The termination of this Agreement shall not affect the execution of any programmes or projects that have been agreed upon whilst the present Agreement was in force unless the Parties agree to otherwise.
Article 13
Entry into force
The Agreement shall enter into force 30 days after the date of reception of the last written notification, through diplomatic channels, indicating that all the legal procedures required for the purpose have been fulfilled.
Done in Lisbon, on the 27th of February 2007, in two original copies in portuguese, russian and english languages, all the texts being equally authentic. In case of divergence of interpretation the English text shall prevail.
