Nos termos da alínea c) do n.º 1 do artigo 200.º da Constituição, o Governo decreta o seguinte:

Artigo único. É aprovada a Nota de Entendimento entre o Governo da República Portuguesa e a Organização das Nações Unidas para o Desenvolvimento Industrial (UNIDO) para Cooperação no Estabelecimento do Centro para a Tecnologia, Formação, Informação e Desenvolvimento da Indústria Farmacêutica, celebrada em Lisboa a 7 de Abril de 1988, cujos textos originais, em português e inglês, vão anexos ao presente decreto.

NOTA DE ENTENDIMENTO ENTRE O GOVERNO DA REPÚBLICA PORTUGUESA E A ORGANIZAÇÃO DAS NAÇÕES UNIDAS PARA O DESENVOLVIMENTO INDUSTRIAL PARA COOPERAÇÃO NO ESTABELECIMENTO DO CENTRO PARA A TECNOLOGIA, FORMAÇÃO, INFORMAÇÃO E DESENVOLVIMENTO DA INDÚSTRIA FARMACÊUTICA.

A Organização das Nações Unidas para o Desenvolvimento Industrial, adiante designada «UNIDO», e o Governo da República Portuguesa, adiante designado «Governo»:

Tendo em atenção os objectivos da UNIDO e o Memorando de Acordo assinado entre eles em 7 de Abril de 1988;

Reconhecendo as recomendações das Segunda e Terceira Reuniões Consultivas sobre Indústria Farmacêutica, realizadas respectivamente de 21 a 25 de Novembro de 1983, em Budapeste, e de 5 a 9 de Outubro de 1987, em Madrid, e a declaração do Governo Português aí apresentada;

acordaram no seguinte:

1 - Será criado pelo Governo, no Laboratório Nacional de Engenharia e Tecnologia Industrial, adiante designado «LNETI», o Centro Nacional de Investigação, Desenvolvimento, Formação e Informação para a Indústria Farmacêutica. O Centro utilizará provisoriamente as instalações do LNETI em Queluz de Baixo, perto de Lisboa. Novas instalações serão construídas, quando necessário, no Lumiar, no novo campus do LNETI.

2 - A UNIDO e o Governo prepararão em conjunto os planos bianuais do Centro, tendo em atenção o desenvolvimento da indústria farmacêutica nos países em desenvolvimento. A participação das Partes será a seguinte:

2.1 - UNIDO e Governo:

a) Iniciar, em conjunto, a identificação e a promoção de actividades dirigidas ao desenvolvimento da indústria farmacêutica nos países em desenvolvimento;

b) Discutir, consultando os países em desenvolvimento interessados, o estabelecimento de centros nacionais, de forma a constituir-se uma rede de centros de investigação e desenvolvimento nos referidos países; e

c) Avaliar os progressos dos programas conjuntos e assegurar a conveniente identificação, a promoção efectiva e a implementação eficiente de futuros programas;

2.2 - UNIDO:

a) Identificar e encaminhar de forma apropriada, para o Centro, os pedidos recebidos de países em desenvolvimento para assistência técnica em investigação e desenvolvimento, transferências de tecnologia, formação, controlo de qualidade, ensaios, informação e documentação;

b) Organizar programas de formação em Portugal com especialistas portugueses e suportar os custos das suas deslocações realizadas no âmbito de projectos da UNIDO em países em desenvolvimento, de acordo com as regras e regulamentos da UNIDO;

c) Preparar programas bianuais, para implementação pelo Centro, de acordo com as solicitações dos países em desenvolvimento no campo farmacêutico, os quais serão considerados nas reuniões da Comissão Mista (ref. parágrafo 3); e

d) Implementar projectos de assistência técnica a realizar com os especialistas do Centro. Os especialistas serão utilizados como consultores do Centro, suportando a UNIDO as suas deslocações e um subsídio para as despesas diárias;

2.3 - Governo:

a) Pôr à disposição da implementação dos programas comuns os recursos e facilidades do Centro;

b) O Centro assegurará a cooperação de outras instituições portuguesas, tais como universidades, indústria e outros institutos de investigação, quando se torne necessário para a implementação de programas comuns; e

c) Considerar a expansão do programa, incluindo, em adição aos fundos multilaterais, alguns fundos bilaterais de países específicos.

3 - Será constituída uma Comissão Mista, formada por representantes da UNIDO e do Centro, que se reunirá uma vez por ano num local mutuamente acordado, de preferência em Viena ou em Lisboa, para acompanhamento do progresso dos programas acima referidos para o ano em curso. Durante a reunião trocar-se-ão informações e discutir-se-ão planos de trabalho para preparação do futuro planeamento de actividades.

4 - Esta Nota de Entendimento entrará em vigor na data em que a UNIDO for notificada por escrito pelo Governo de que as formalidades legais da República Portuguesa tenham sido cumpridas.

NOTE OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE PORTUGUESE REPUBLIC AND THE UNITED NATIONS INDUSTRIAL DEVELOPMENT ORGANIZATION ON THEIR COOPERATION FOR THE ESTABLISHMENT OF THE CENTER FOR PHARMACEUTICAL TECHNOLOGY, INFORMATION, TRAINING AND DEVELOPMENT (ITPT).

The United Nations Industrial Development Organization, hereinafter called «UNIDO», and the Government of the Portuguese Republic, hereinafter called «Government»:

Bearing in mind the objectives of UNIDO and the Memorandum of Understanding signed by them on 7 April 1988;

Recognizing the recommendations of the Second and Third Consultation Meetings on Pharmaceutical Industry held in Budapest from 21 to 25 November 1983 and in Madrid from 5 to 9 October 1987, respectively, and the Portuguese declaration then presented;

have agreed as follows:

1 - A National Centre for Research, Development, Training and Information on Pharmaceutical Industry, hereinafter called «Centre», shall be established by the Government in the National Laboratory for Industrial Engineering and Technology, hereinafter called «LNETI». The Centre will be established by using the existing facilities of LNETI at Queluz de Baixo, near Lisbon. New facilities should be located, whenever necessary, at Lumiar, on the new LNETI campus.

2 - UNIDO and the Government will establish biennial joint programmes, bearing in mind the development of the pharmaceutical industry in developing countries. The Parties' inputs will be as follows:

2.1 - UNIDO and the Government will:

a) Jointly initiate identification and promotion of activities with regard to the development of the Pharmaceutical Industry in the developing countries;

b) Discuss, in consultation with the interested developing countries, the setting up of national centres with a view to establishing a network of pharmaceutical research and development centres in said countries; and

c) Evaluate the progress of joint programmes, and ensure the proper identification, promotion and effective, efficient implementation of future programmes;

2.2 - UNIDO will:

a) Identify and forward as appropriate to the Centre requests received from developing countries for technical assistance on research and development, transfer of technology, training, quality control, assays, information and documentation;

b) Organize training programmes in Portugal with Portuguese experts and defray their expenses when they travel in connection with UNIDO projects to the developing countries, in line with the UNIDO rules and regulations;

c) Prepare biennial programmes for implementation by the Centre as required by developing countries in the pharmaceutical field, which will be considered during the meetings of the Joint Committee (ref. paragraph 3); and

d) Make use of the Portuguese experts at the Centre for the implementation of technical assistance projects. The experts will be used as consultants from the Centre, for whom UNIDO will provide their travel expenses plus a daily subsistence allowance;

2.3 - The Government will:

a) Make available resources and facilities of the Centre for implementation of joint programmes in the interest of said developing countries;

b) The Centre will secure the cooperation of other Portuguese institutions such as the universities, industry and other research institutes when required for the implementation of the joint programmes; and

c) Consider the expansion of the programme by including, in addition to multilateral funding, some bilateral funds for specific countries.

3 - Representatives of UNIDO and of the Centre forming a Joint Committee shall meet once a year at a mutually agreed place, preferably in Vienna or Lisbon, to review the progress of the programmes agreed upon for that current year. During the review, they will also exchange information regarding future planning and discuss workplans to this effect.

4 - This Note of Understanding shall enter into force on the date on which UNIDO is notified in writing by the Government that the constitutional formalities of the Portuguese Republic have been completed.
