O Governo decreta, nos termos da alínea c) do artigo 200.º da Constituição, o seguinte:
Artigo único. É aprovado para adesão o Acordo Internacional para a Manutenção da Iluminação no Mar Vermelho, concluído em Londres em 20 de Fevereiro de 1962, cujos textos em inglês e a respectiva tradução para português vão anexos ao presente decreto.

International Agreement Regarding the Maintenance of Certain Lights in the Red Sea
The contracting Governments:
Considering that certain lights on the islands of Abu Ail and Jabal at Tair in the Red Sea were constructed at the expense of the Ottoman Government and subsequently maintained on the behalf and at the expense of the said Government; and
Considering that in the course of the 1914-1918 war the above-mentioned islands were occupied by the forces of His Britannic Majesty; and
Considering that by article 16 of the Treaty of Peace with Turkey signed at Lausanne on 24th July, 1923, Turkey renounced all her rights and titles over the above-mentioned islands, the future of these islands being a matter for settlement by the Parties concerned; and that no agreement on the subject of the future of the above-mentioned islands has been come to among the Parties concerned; and
Considering that in 1930 a Convention was signed on behalf of certain interested Governments, making provision for the maintenance of the lights on the above-mentioned islands; and that the Convention of 1930 did not come into force but the lights continued to be maintained by the Government of the United Kingdom with contributions towards the cost thereof from the Governments of Germany, Italy and the Netherlands; and
Considering that the outbreak of the 1939-1945 war put an end to the arrangement just recited and that the Government of the United Kingdom has maintained the two lights and since 1945 has received contributions towards the cost thereof from the Government of the Netherlands; and
Desiring to conclude an agreement which will provide for the maintenance of the lights on the islands of Abu Ail and Jabal at Tair in the interests of shipping and for the sharing of the cost of their maintenance in an equitable manner;
have agreed as follows:
ARTICLE 1
In the present Agreement:
i) The word «tonnage» means net tonnage as ascertained in accordance with the tonnage measurement rules of the Suez Canal Authority;
ii) The expression «vessels of» a Government means vessels registered in the metropolitan territory of that Government;
iii) The expression «contributing Government» means a contracting Government which for the financial year in question has not relieved itself of liability to contribute by giving notice in accordance with the provisons of article 5;
iv) The expression «financial year» means the twelve months ending 31st March; and
v) The expression «the lights» means the lights on the Islands of Abu Ali and Jabal at Tair.
ARTICLE 2
Subject to the provisions of article 6, the Government of the United Kingdom of Great Britain and Northern Ireland shall be the managing Government and as such shall continue to manage and maintain the lights. The Managing Government may appoint an agent to act on its behalf at a fee agreed between the Managing Government and such agent.
ARTICLE 3
1) The contributing Governments shall defray the expense of managing and maintaining the said lights by contributions based on the total tonnage of the vessels of each contributing Government as ascertained in accordance with paragraphs 5) and 6) of the present article.
2) The Managing Government shall forward to the other contracting Governments, as soon as possible after 31st March in each year, particulars of the expenditure which it has incurred in managing and maintaining the lights during the previous financial year, a statement of the contribution due from each contributing Government and an estimate of the next year's expenditure. Should this estimate exceed £ 30,000, the Managing Government, at the request of any contributing Government, shall call a meeting the contributing Governments to discuss the estimate.
3) Should it become desirable to expend on renewals, replacements, or repairs, other than normal maintenance, more than £ 5,000 in any one financial year, the Managing Government shall consult the other contributing Governments, by a meeting of contributing Governments should any one so request, or in writing if not so requested, before incurring such expenditure in excess of £ 5,000 except in case it is necessary to provide for any sudden emergency; in that event the contributing Governments shall he informed as soon as possible.
4) Each other contributing Government shall pay to the Managing Government the amount of its contribution as soon as practicable after the receipt from the Managing Government of the statement referred to in paragraph 2) of the present article and in any event within twelve months after the statement is received.
5) The Managing Government shall assess the contributions on the total tonnage of the vessels of each contributing Government passing through the Suez Canal as compared with the total tonnage of all vessels of all the contributing Governments passing through the Suez Canal: the tonnage in each case being the tonnage (as ascertained from publications issued by the Suez Canal Authority) passing through the Suez Canal during the calendar year ending 31st December immediately preceding the said 31st March.
6) Where however a contributing Government has made representations before 31st March in any year to the Managing Government that the total tonnage of its vessels passing through the Suez Canal in the previous calendar year was substantially greater than the tonnage benefiting from the lights, and produces figures to that effect, the Managing Government shall assess the contribution of that Government in respect of that calendar year on the total tonnage of its vessels benefiting from the lights (this total tonnage to be determined by agreement between the Managing Government and the contributing Government concerned) as compared with the total tonnage of all vessels of all the contributing Governments passing through the Canal, and shall re-assess the contributions of all the other contributing Governments in respect of that calendar year proportionately.
7) Subject to any declaration made under article 9, 4), each contributing Government shall pay its first contribution under the present Agreement in respect of the expenditure incurred in whichever of the following financial years is the later:
a) The financial year in which the present Agreement comes into force in accordance with the provisions of article 11; or
b) The financial year in which it becomes a party to the present Agreement in accordance with the provisions of article 9.
ARTICLE 4
1) If for any reason the contribution of a contributing Government in respect of any financial year has not been paid within the twelve months time limit referred to in article 3, 4), the defaulting Government remains responsible for the contribution outstanding and the Managing Government shall use every endeavour to obtain the monies due.
2) If such efforts prove abortive after a lapse of 2 years the other contributing Governments shall defray the amounts in default in the proportions laid down in article 3, 1), and the rights under article 3, 2) and 3), and under article 7 shall be suspended with respect to the defaulting Government until outstanding payments are made and payment of contributions resumed.
ARTICLE 5
1) Each contracting Government has the right to discontinue its contribution for any financial year upon giving written notice to the Managing Government before 1st October in the previous financial year; it shall continue to be responsible for its current contribution up to the 31st March following the date of giving such notice. Any Government giving such notice shall state the reasons therefor, and for the financial year in respect of which its contribution is thus discontinued the rights of that Government under article 3, 2) and 3), and article 7 of the present Agreement shall be suspended. It shall, however, remain a party to the present Agreement.
2) The Managing Government shall inform all contracting Governments of any notice received in accordance with the provisions of the present article.
ARTICLE 6
1) The Government of the United Kingdom has the right to discontinue its obligation to be Managing Government by giving to the other contracting Governments written notice to this effect. Its obligation shall cease at the end of the financial year following the financial year in which notice was given.
2) In such event, the contracting Governments shall consult among themselves with a view to appointing another Government as Managing Government or making other arrangements for the management of the lights. If no such arrangements are made before the obligation of the Government of the United Kingdom ceases in accordance with paragraph 1) of the present article, the present Agreement shall cease to be in force.
ARTICLE 7
If any contracting Government desires that any amendment should be made in the provisions of the present Agreement, it shall communicate its proposals, together with the reasons therefor, to the Managing Government. The Managing Government shall inform all the other contracting Governments of any proposal for amendment received by it with a request that they shall, as soon as possible, inform it whether they accept the proposal. A contracting Government shall be deemed to have accepted a proposal for amendment only after a notification of acceptance has been filed with the Managing Government. If a proposal for amendment is accepted by all the contributing Governments, the Managing Government shall draw up a certificate of the amendment which has been so agreed and communicate it to all the other contracting Governments, and the amendment shall be deemed to have come into force on the date of the certificate unless a different effective date has been provided in the accepted proposal.
ARTICLE 8
Nothing in the present Agreement shall be regarded as constituting a settlement of the future of the Islands or territories referred to in article 16 of the Treaty of Lausanne or as prejudicing the conclusion of any such settlement in future.
ARTICLE 9
1) Subject to the provisions of paragraph 2) of the present article, the Government of any State invited to attend the Diplomatic Conference regarding the maintenance of certain lights in the Red Sea held in London from 11th to 13th October, 1961, namely Denmark, Federal Republic of Germany, Finland, France, Greece, Italy, Liberia, Netherlands, Norway, Pakistan, Panama, Sweden, Union of Soviet Socialist Republics, United Arab Republic, United Kingdom of Great Britain and Northern Ireland and the United States of America, may become a party to the present Agreement by:
i) Signature without reservation as to acceptance; or
ii) Signature subject to acceptance, followed by acceptance; or
iii) Acceptance.
2) The present Agreement shall be open for signature from the 20th of February to the 19th of August, 1962, and thereafter it shall remain open for acceptance.
3) Acceptance shall be effected by the deposit of an instrument of acceptance with the Government of the United Kingdom.
4) Any Government which deposits its instrument of acceptance after the present Agreement has come into force may declare that its acceptance shall not take effect until 1st April following the date of its signature or acceptance.
5) The Government of the United Kingdom shall inform all signatory Governments and all Governments that have accepted the present Agreement of each signature or acceptance received and the date of its receipt and of any declaration made in accordance with paragraph 4) of the present article.
ARTICLE 10
If in any calendar year the total tonnage of the vessels of any Government other than a contracting Government passing through the Suez Canal exceeds 1 per cent of the total tonnage of all vessels passing through the Suez Canal, the Managing Government, after obtaining the assent of all contracting Governments, shall invite that Government to become a party to the present Agreement.
ARTICLE 11
The Government of the United Kingdom shall notify all signatory Governments and all Governments which have accepted the present Agreement when the total tonnage of the vessels passing through the Suez Canal of those Governments which have taken the action required by article 9 to become parties to the Agreement has, in the preceding calendar year, exceeded 50 per cent of the total tonnage of all vessels which have passed through the Suez Canal in that year, and the Agreement shall enter into force on the date of such notification.
ARTICLE 12
1) Any contracting Government may denounce the present Agreement by giving written notice to the Managing Government. A notice of intention to discontinue contributing for an indefinite period shall be deemed to be a notice of denunciation. Denunciation shall take effect at the end of the financial year following that in which notice is given and a contributing Government shall remain liable for a contribution incurred before its denunciation takes effect.
2) The Managing Government shall inform all contracting Governments of any such notice received by it.
In witness whereof the undersigned, duly authorised thereto by their respective Governments, have signed the present Agreement.
Done in London the 20th day of February, 1962, in the English and French languages of which the English text shall be authoritative, in a single copy which shall be deposited in the archives of the Government of the United Kingdom which shall transmit certified copies thereof to each Government which has signed or accepted the present Agreement.

Acordo Internacional Relativo à Manutenção da Iluminação no Mar Vermelho, 1962
Os Governos contratantes:
Considerando que a iluminação nas ilhas de Abu Ail e Jabal at Tair, no mar Vermelho, foi posta e custeada pelo Governo Turco e subsequentemente mantida em nome e a expensas do dito Governo;
Considerando que durante a guerra de 1914-1918 as ilhas acima mencionadas foram ocupadas pelas forças de sua Majestade Britânica;
Considerando que, pelo artigo 16 do Tratado de Paz assinado com a Turquia, em Lausana, a 24 de Julho de 1923, este país renunciou a todos os seus direitos e títulos nas ilhas acima mencionadas, e o futuro destas se tornou um assunto a resolver pelas Partes interessadas; e que acerca deste assunto não foi efectuado nenhum acordo entre as Partes interessadas; sobre o futuro das ilhas acima mencionadas;
Considerando que foi assinada uma Convenção, em 1930, em nome de certos Governos interessados, contendo disposições para a manutenção da iluminação nas ilhas acima mencionadas; e que a Convenção de 1930 não entrou em vigor, mas a iluminação continuou a ser mantida pelo Governo do Reino Unido com o auxílio dos Governos da Alemanha, da Itália e da Holanda;
Considerando que a eclosão da guerra de 1939-1945 pôs fim a esta disposição, apenas enunciada, e que o Governo do Reino Unido tem mantido a iluminação, só tendo recebido, desde 1945, o auxílio do Governo da Holanda;
Desejando concluir um acordo que providencie a manutenção da iluminação nas Ilhas de Abu Ail e Jabal at Tair, no interesse do tráfego marítimo internacional, assim como a participação no custo da sua manutenção de forma equitativa;
acordaram nas seguintes disposições:
ARTIGO 1
No presente Acordo:
i) A palavra «tonelagem» significa tonelagem líquida, aferida de acordo com o previsto nas regras de medição de tonelagem das autoridades do canal de Suez;
ii) A expressão «navios de» um Governo significa navios registados no território metropolitano desse Governo;
iii) A expressão «Governo contribuinte» significa um Governo contratante que, no ano financeiro em questão, se não tenha libertado da responsabilidade de contribuição, de acordo com as disposições do artigo 5;
iv) A expressão «ano financeiro» significa doze meses acabando em 31 de Março;
v) A expressão «a iluminação» significa a iluminação nas ilhas de Abu Ail e Jabal at Tair.
ARTIGO 2
De acordo com as disposições do artigo 6, o Governo do Reino Unido da Grã-Bretanha e Irlanda do Norte deverá ser o Governo dirigente e, como tal, deverá continuar a orientar e manter a iluminação. O Governo Dirigente pode designar um representante para actuar em seu nome, e os honorários serão combinados entre o Governo Dirigente e tal representante.
ARTIGO 3
1) Os Governos contribuintes deverão liquidar as despesas de administração e manutenção da dita iluminação através de contribuições baseadas na tonelagem total de navios de cada Governo contribuinte, de acordo com o previsto nos parágrafos 5) e 6) do presente artigo.
2) O Governo Dirigente deverá enviar aos outros Governos contratantes, o mais cedo possível e depois de 31 de Março de cada ano, informações pormenorizadas dos gastos em que incorreu com a administração e manutenção da iluminação durante o ano financeiro anterior e uma declaração com as contribuições devidas por cada Governo contribuinte, além de uma estimativa das despesas para o ano seguinte. Se essa estimativa exceder 30000 libras, o Governo Dirigente, a pedido de qualquer Governo contribuinte, deverá convocar uma reunião dos Governos contribuintes para discutir essa estimativa.
3) Se for necessário gastar mais que 5000 libras em renovações, substituições ou reparações que não façam parte da manutenção normal, o Governo Dirigente deverá consultar os outros Governos contribuintes numa reunião de Governos contribuintes, quer esta seja solicitada por qualquer deles quer por escrito se não for solicitada, antes de incorrer em tal despesa excedendo as 5000 libras, excepto se for necessário providenciar a qualquer emergência imprevista; nesse caso os Governos contribuintes deverão ser informados o mais cedo possível.
4) Cada Governo contribuinte deverá pagar ao Governo Dirigente o total da sua contribuição, logo que lhe seja viável, depois da recepção da declaração referida no parágrafo 2) do presente artigo (enviada pelo Governo Dirigente) e em qualquer circunstância dentro do prazo de doze meses após a recepção da declaração.
5) O Governo Dirigente deverá estabelecer as contribuições de acordo com a tonelagem total dos navios de cada Governo contribuinte que atravessarem o canal de Suez em comparação com a tonelagem total de todos os navios de todos os Governos contribuintes que atravessarem o canal de Suez: a tonelagem será em cada caso a tonelagem (como se verifica nas publicações emitidas pelas autoridades do canal de Suez) que atravessar o canal de Suez durante o ano que acaba a 31 de Dezembro, imediatamente anterior ao dito 31 de Março.
6) No entanto, se um Governo contribuinte tiver declarado ao Governo Dirigente, antes de 31 de Março de cada ano, que a tonelagem total dos seus navios que atravessaram o canal de Suez no ano anterior foi substancialmente mais elevada que a tonelagem que beneficia de iluminação, e apresente dados sobre o assunto, o Governo Dirigente deverá estabelecer, em relação a esse ano, a contribuição desse Governo sobre a tonelagem total dos seus navios que beneficiam de iluminação (esta tonelagem total será estabelecida por acordo entre o Governo Dirigente e o Governo contribuinte interessado) em comparação com a tonelagem total de todos os navios de todos os Governos contribuintes que atravessaram o canal, e deverá reestabelecer as contribuições de todos os outros Governos contribuintes proporcionalmente e em relação a esse ano.
7) De acordo com qualquer declaração feita ao abrigo do artigo 9, 4), cada Governo contribuinte deverá pagar a sua primeira contribuição, ao abrigo do presente Acordo, respeitante às despesas incorridas num dos últimos anos financeiros seguintes:
a) Ano financeiro em que o presente Acordo entra em vigor, de acordo com as disposições do artigo 11; ou
b) Ano financeiro em que assina o presente Acordo, de acordo com as disposições do artigo 9.
ARTIGO 4
1) Se por qualquer motivo a contribuição de um Governo contribuinte respeitante a algum ano financeiro não tiver sido paga dentro do tempo limite de doze meses referido no artigo 3, 4), o Governo em falta ficará responsável pela contribuição em dívida e o Governo Dirigente deverá fazer todas as diligências para obter os dinheiros em dívida.
2) Se tais esforços falharem depois de um espaço de tempo de dois anos, os outros Governos contribuintes deverão liquidar as importâncias em falta nas proporções estabelecidas no artigo 3, 1), e os direitos ao abrigo do artigo 3, 2) e 3), e ao abrigo do artigo 7 deverão ser suspensos em relação ao Governo em falta, até que os pagamentos em dívida sejam efectuados e reassumido o pagamento das contribuições.
ARTIGO 5
1) Cada Governo contratante tem o direito de interromper a sua contribuição em qualquer ano financeiro, a seguir a ter comunicado por escrito ao Governo Dirigente antes de 1 de Outubro do ano financeiro anterior; deverá continuar a ser responsável pela sua contribuição corrente até 31 de Março a seguir à data de tal comunicação.
Qualquer Governo que fizer tal comunicação deverá referir as razões para esse fim, e para o ano financeiro em relação ao qual a sua contribuição é interrompida os direitos desse Governo ao abrigo do artigo 3, 2) e 3), e do artigo 7 do presente Acordo deverão ser suspensos. Deverá, contudo, continuar a fazer parte do presente Acordo.
2) O Governo Dirigente deverá informar todos os Governos contratantes de qualquer comunicação recebida, de acordo com as disposições do presente artigo.
ARTIGO 6
1) O Governo do Reino Unido tem o direito de interromper a sua obrigação de ser o Governo Dirigente a notificar por escrito, e para tal efeito, os outros Governos contratantes. A sua obrigação deverá cessar no fim do ano financeiro a seguir ao ano financeiro em que for feita a comunicação.
2) Nestas circunstâncias, os Governos contratantes deverão consultar-se entre eles com vista a nomear outro Governo como Governo Dirigente ou a adoptar outras disposições para a administração da iluminação. Se não forem adoptadas outras disposições antes que a obrigação do Governo do Reino Unido cesse de acordo com o parágrafo 1) do presente artigo, o presente Acordo deverá deixar de estar em vigor.
ARTIGO 7
Se qualquer Governo contratante desejar que qualquer emenda deva ser feita às disposições do presente Acordo, deverá comunicar as suas propostas, juntamente com as razões justificativas, ao Governo Dirigente. O Governo Dirigente deverá informar todos os outros Governos contratantes de qualquer proposta de emenda por ele recebida, com a solicitação de que eles deverão, o mais cedo possível, informá-lo se aceitam a proposta. Só se deverá considerar que um Governo contratante aceitou a proposta de emenda após a notificação de aceitação ter sido registada pelo Governo Dirigente.
Se uma proposta de emenda for aceite por todos os Governos contratantes, o Governo Dirigente deverá redigir um certificado da emenda que tenha sido acordada e comunicá-lo a todos os outros Governos contratantes, e a emenda deverá ser considerada como entrando em vigor na data do certificado, a não ser que uma data efectiva diferente tenha sido estipulada na proposta aceite.
ARTIGO 8
Nada no presente Acordo deverá ser considerado como uma decisão para o futuro das Ilhas ou territórios indicados no artigo 16 do Tratado de Lausana ou que prejudique a conclusão de qualquer decisão no futuro.
ARTIGO 9
1) De acordo com as disposições do parágrafo 2) do presente artigo, o Governo de qualquer Estado convidado a assistir à Conferência Diplomática respeitante à manutenção de iluminação no mar Vermelho, que teve lugar em Londres de 11 a 13 de Outubro de 1961, nomeadamente a Dinamarca, a República Federal da Alemanha, a Finlândia, a França, a Grécia, a Itália, a Libéria, a Holanda, a Noruega, o Paquistão, o Panamá, a Suécia, as Repúblicas Socialistas da União Soviética, as Repúblicas Árabes Unidas, o Reino Unido da Grã-Bretanha e Irlanda do Norte e os Estados Unidos da América, poderá tornar-se parte do presente Acordo através de:
i) Assinatura sem reservas quanto a aceitação; ou
ii) Assinatura sujeita a aceitação, seguida de aceitação; ou
iii) Aceitação.
2) O presente Acordo ficará aberto para assinatura desde 20 de Fevereiro até 19 de Agosto de 1962 e a seguir continuará aberto para aceitação.
3) A aceitação deverá ser efectuada pelo depósito de um instrumento de aceitação no Governo do Reino Unido.
4) Qualquer Governo que deposite o seu instrumento de aceitação após o presente Acordo ter entrado em vigor poderá declarar que a sua aceitação não deverá ter efeito senão a partir de 1 de Abril seguinte à data da sua assinatura de aceitação.
5) O Governo do Reino Unido deverá informar todos os Governos signatários e todos os Governos que tenham aceite o presente Acordo de cada assinatura ou aceitação recebida da data da sua recepção e de qualquer declaração feita de acordo com o parágrafo 4) do presente artigo.
ARTIGO 10
Se em qualquer ano cronológico a tonelagem total dos navios de qualquer Governo que não seja um Governo contratante que atravessa o canal de Suez atingir mais de 1% da tonelagem total de todos os navios que atravessam o canal de Suez, o Governo Dirigente, depois de obtida a concordância de todos os Governos contratantes, deverá convidar esse Governo a assinar o presente Acordo.
ARTIGO 11
O Governo do Reino Unido notificará todos os Governos signatários e todos os Governos que aceitaram o presente Acordo sempre que a tonelagem total dos navios pertencentes aos Governos que tomaram as providências requeridas pelo artigo 9 para se tornarem partes do Acordo e que atravessam o canal de Suez tenha excedido, no ano anterior, 50% da tonelagem total de todos os navios que tenham atravessado o canal de Suez nesse ano, e o Acordo entrará em vigor na data da mesma notificação.
ARTIGO 12
1) Qualquer Governo contratante pode denunciar o presente Acordo por notificação ao Governo Dirigente. A notificação de intenção de interromper a contribuição por um período indefinido deverá ser considerada como sendo uma notificação de denúncia.
A denúncia deverá entrar em vigor no fim do ano financeiro seguinte àquele em que a notificação for dada e um Governo contribuinte ficará responsável pela contribuição ocorrida antes da denúncia entrar em vigor.
2) O Governo Dirigente deverá informar todos os Governos contratantes de qualquer comunicação por ele recebida.
Em testemunho, os abaixo assinados, devidamente autorizados a isso pelos seus Governos respectivos, assinaram o presente Acordo.
Feito em Londres, a 20 de Fevereiro de 1962, em inglês e francês, sendo o texto em inglês o que faz fé, numa só cópia que será depositada nos arquivos do Governo do Reino Unido, o qual deverá enviar cópias certificadas a cada Governo que assinou ou aceitou o presente Acordo.
Assinaturas: a Dinamarca, a República Federal da Alemanha, a Grécia, a Itália, a Libéria, a Holanda, a Noruega, o Paquistão, o Panamá, a Suécia, as Repúblicas Socialistas da União Soviética, as Repúblicas Árabes Unidas, o Reino Unido da Grã-Bretanha e Irlanda do Norte, os Estados Unidos da América.
