Resolução da Assembleia da República n.º 27/2009

Aprova o Protocolo Relativo a Uma Emenda ao Artigo 50.º, Alínea a), da Convenção sobre Aviação Civil Internacional, adoptado em Montreal em 16 de Outubro de 1974

A Assembleia da República resolve, nos termos da alínea i) do artigo 161.º e do n.º 5 do artigo 166.º da Constituição, aprovar o Protocolo Relativo a Uma Emenda ao Artigo 50.º, Alínea a), da Convenção sobre Aviação Civil Internacional, adoptado em Montreal em 16 de Outubro de 1974, cujo texto, na versão autenticada na língua inglesa, assim como a respectiva tradução para língua portuguesa, se publica em anexo.

PROTOCOL RELATING TO AN AMENDMENT TO ARTICLE 50, A), OF THE CONVENTION ON INTERNATIONAL CIVIL AVIATION, SIGNED AT MONTREAL ON 16 OCTOBER 1974

The Assembly of the International Civil Aviation Organization:

Having met in its twenty-first session, at Montreal on 14 October 1974;

Having noted that it is the general desire of contracting States to enlarge the membership of the Council;

Having considered it proper to provide for three additional seats in the Council, and accordingly to increase the membership from thirty to thirty-three, in order to permit an increase in the representation of States elected in the second, and particularly the third, part of the election; and

Having considered it necessary to amend, for the purpose aforesaid, the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944:

1) Approved, in accordance with the provisions of article 94, a), of the Convention aforesaid, the following proposed amendment to the said Convention:

In article 50, a), of the Convention the second sentence shall be amended by replacing «thirty» by «thirty-three»;

2) Specified, pursuant to the provisions of the said article 94, a), of the said Convention, eighty-six as the number of contracting States upon whose ratification the proposed amendment aforesaid shall come into force; and

3) Resolved that the Secretary General of the International Civil Aviation Organization draw up a Protocol, in the English, French and Spanish languages, each of which shall be of equal authenticity, embodying the proposed amendment above-mentioned and the matter hereinafter appearing:

a) The Protocol shall be signed by the President of the Assembly and its Secretary General;

b) The Protocol shall be open to ratification by any State which has ratified or adhered to the said Convention on International Civil Aviation;

c) The instruments of ratification shall be deposited with the International Civil Aviation Organization;

d) The Protocol shall come into force in respect of the States which have ratified it on the date on which the eighty-sixth instrument of ratification is so deposited;

e) The Secretary General shall immediately notify all contracting States of the date of deposit of each ratification of the Protocol;

f) The Secretary General shall immediately notify all States parties to the said Convention of the date on which the Protocol comes into force;

g) With respect to any contracting State ratifying the Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratification with the International Civil Aviation Organization.

Consequently, pursuant to the aforesaid action of the Assembly, this Protocol has been drawn up by the Secretary General of the Organization.

In witness whereof the President and the Secretary General of the Twenty-first Session of the Assembly of the International Civil Aviation Organization, being authorized thereto by the Assembly, sign this Protocol.

Done at Montreal on the sixteenth day of October of the year one thousand nine hundred and seventy-four, in a single document in the English, French and Spanish languages, each of which shall be of equal authenticity. This Protocol shall remain deposited in the archives of the International Civil Aviation Organization, and certified copies thereof shall be transmitted by the Secretary General of the Organization to all States parties to the Convention on International Civil Aviation, done at Chicago on the seventh day of December 1944.

PROTOCOLO RELATIVO A UMA EMENDA AO ARTIGO 50.º, ALÍNEA A), DA CONVENÇÃO SOBRE AVIAÇÃO CIVIL INTERNACIONAL, ASSINADO EM MONTREAL EM 16 DE OUTUBRO DE 1974.

A Assembleia da Organização da Aviação Civil Internacional:

Reunida na sua 21.ª Sessão, em Montreal, no dia 14 de Outubro de 1974;

Tendo em conta o desejo geral dos Estados Contratantes de aumentar o número de membros do Conselho, de forma a assegurar um maior equilíbrio, pelo aumento da representação de Estados Contratantes;

Considerando conveniente elevar de 30 para 33 o número de membros deste órgão;

Considerando que, para o efeito, é necessário modificar a Convenção sobre Aviação Civil Internacional, assinada em Chicago em 7 de Dezembro de 1944:

1) Aprova, em conformidade com o disposto na alínea a) do artigo 94.º da referida Convenção, o seguinte projecto de emenda àquela Convenção:

Modificar a segunda frase da alínea a) do artigo 50.º da Convenção, substituindo «30» por «33»;

2) Fixa em 86 o número de Estados Contratantes cuja ratificação é necessária para a entrada em vigor da referida emenda, de acordo com o disposto na alínea a) do artigo 94.º daquela Convenção; e

3) Decide que o Secretário-Geral da Organização da Aviação Civil Internacional redija em inglês, francês e espanhol, fazendo cada um dos idiomas igual fé, um protocolo relativo à emenda acima mencionada e compreendendo as seguintes disposições:

a) O Protocolo será assinado pelo Presidente e pelo Secretário-Geral da Assembleia;

b) O Protocolo ficará aberto para ratificação de qualquer Estado que tenha ratificado a referida Convenção sobre Aviação Civil Internacional ou a ela tenha aderido;

c) Os instrumentos de ratificação serão depositados junto da Organização da Aviação Civil Internacional;

d) O Protocolo entrará em vigor, em relação aos Estados que o tiverem ratificado, no dia do depósito do 86.º instrumento de ratificação;

e) O Secretário-Geral notificará imediatamente todos os Estados Contratantes da data do depósito de cada instrumento de ratificação do Protocolo;

f) O Secretário-Geral notificará imediatamente todos os Estados Partes da referida Convenção da data de entrada em vigor do Protocolo;

g) O Protocolo entrará em vigor, em relação a qualquer Estado Contratante que o tiver ratificado após aquela data, a partir do momento em que tal Estado depositar o respectivo instrumento de ratificação junto da Organização da Aviação Civil Internacional.

Em consequência, de acordo com a referida decisão da Assembleia, o presente Protocolo foi redigido pelo Secretário-Geral da Organização.

Em fé do que o Presidente e o Secretário-Geral da 21.ª Sessão da Assembleia da Organização da Aviação Civil Internacional, para o efeito autorizados pela Assembleia, assinam o presente Protocolo.

Feito em Montreal em 16 de Outubro de 1974, num só exemplar redigido em inglês, francês e espanhol, fazendo cada idioma igualmente fé. O presente Protocolo ficará depositado nos arquivos da Organização da Aviação Civil Internacional e o Secretário-Geral da Organização enviará cópias autenticadas a todos os Estados Partes da Convenção sobre Aviação Civil Internacional, assinada em Chicago em 7 de Dezembro de 1944.
