Resolução da Assembleia da República n.º 30/2009

Aprova o Protocolo Relativo a Uma Emenda à Convenção sobre Aviação Civil Internacional, adoptado em Montreal em 1 de Outubro de 1998

A Assembleia da República resolve, nos termos da alínea i) do artigo 161.º e do n.º 5 do artigo 166.º da Constituição, aprovar o Protocolo Relativo a Uma Emenda à Convenção sobre Aviação Civil Internacional, adoptado em Montreal em 1 de Outubro de 1998, cujo texto, nas versões autenticadas nas línguas inglesa e chinesa, assim como a respectiva tradução para língua portuguesa, se publica em anexo.

PROTOCOL RELATING TO AN AMENDMENT TO THE CONVENTION ON INTERNATIONAL CIVIL AVIATION, SIGNED AT MONTREAL ON 1 OCTOBER 1998

The Assembly of the International Civil Aviation Organization:

Having met in its Thirty-second Session at Montreal on 22 September 1998;

Having noted that it is the general desire of Contracting States to take action to ensure that the Convention on International Civil Aviation, done at Chicago on 7 December 1944, is available as the authentic Chinese text;

Having considered it necessary to amend the said Convention, for the purpose aforesaid:

1) Approves, in accordance with the provisions of article 94, a), of the Convention aforesaid, the following proposed amendment which is to replace the present text of the final paragraph of the said Convention:

«Done at Chicago the seventh day of December 1944 in the English language. The texts of this Convention drawn up in the English, Arabic, Chinese, French, Russian and Spanish languages are of equal authenticity. These texts shall be deposited in the archives of the Government of the United States of America, and certified copies shall be transmitted by that Government to the Governments of all the States which may sign or adhere to this Convention. This Convention shall be open for signature at Washington, D. C.»

2) Specifies, pursuant to the provisions of the said article 94, a), of the said Convention, one hundred and twenty-four as the number of Contracting States upon whose ratification the proposed amendment aforesaid shall come into force; and

3) Resolves that the Secretary General of the International Civil Aviation Organization draw up a Protocol in the English, Arabic, Chinese, French, Russian and Spanish languages each of which shall be of equal authenticity embodying the proposed amendment above mentioned and the matter hereinafter appearing.

Consequently, pursuant to the aforesaid action of the Assembly:

This Protocol has been drawn up by the Secretary General of the Organization;

The Protocol shall be open to ratification by any State which has ratified or adhered to the said Convention on International Civil Aviation;

The instruments of ratification shall be deposited with the International Civil Aviation Organization;

The Protocol shall come into force in respect of the States which have ratified it on the date on which the one hundred and twenty-fourth instrument of ratification is so deposited;

The Secretary General shall immediately notify all Contracting States of the date of deposit of each ratification of the Protocol;

The Secretary General shall immediately notify all States parties to the said Convention of the date on which the Protocol comes into force;

With respect to any Contracting State ratifying the Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratification with the International Civil Aviation Organization.

In witness whereof the President of the aforesaid Thirty-second Session of the Assembly and the Secretary General of the Organization, being authorized thereto by the Assembly, sign this Protocol.

Done at Montreal on the first day of October of the year one thousand nine hundred and ninety-eight, in a single document in the English, Arabic, Chinese, French, Russian and Spanish languages, each of which shall be of equal authenticity. This Protocol shall remain deposited in the archives of the International Civil Aviation Organization, and certified copies thereof shall be transmitted by the Secretary General of the Organization to all States parties to the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944.

PROTOCOLO RELATIVO A UMA EMENDA À CONVENÇÃO SOBRE AVIAÇÃO CIVIL INTERNACIONAL, ASSINADA EM MONTREAL EM 1 DE OUTUBRO DE 1998

A Assembleia da Organização da Aviação Civil Internacional:

Tendo reunido na sua 32.ª sessão em Montreal no dia 22 de Setembro de 1998;

Tendo tomado nota que os Estados Contratantes manifestaram o desejo geral que fossem tomadas as medidas necessárias para garantir a disponibilidade de um texto autêntico em língua chinesa da Convenção sobre Aviação Civil Internacional, feita em Chicago em 7 de Dezembro de 1944;

Tendo considerado que é necessário emendar a referida Convenção com os objectivos acima mencionados:

1) Aprova, de acordo com as disposições do artigo 94.º, alínea a), da referida Convenção, a seguinte proposta de emenda que visa substituir o actual texto do parágrafo final da referida Convenção:

«Feita em Chicago em 7 de Dezembro de 1944 em língua inglesa. Os textos da presente Convenção nas línguas árabe, chinesa, espanhola, francesa, inglesa e russa fazem igualmente fé. Estes textos serão depositados nos arquivos do Governo dos Estados Unidos da América, o qual transmitirá cópias autenticadas aos governos de todos os Estados que assinem ou que adiram à presente Convenção. A presente Convenção será aberta para assinatura em Washington (D. C.)»

2) Fixa, de acordo com as disposições do artigo 94.º, alínea a), da referida Convenção, em 124 o número de Estados Contratantes necessários para que a referida emenda entre em vigor; e

3) Decidiu que o Secretário-Geral da Organização da Aviação Civil Internacional redija um protocolo nas línguas árabe, chinesa, espanhola, francesa, inglesa e russa, cada um dos quais fazendo igualmente fé, incorporando a proposta de emenda acima mencionada, bem como os elementos a seguir indicados.

Consequentemente, de acordo com a referida decisão da Assembleia:

O presente Protocolo foi redigido pelo Secretário-Geral da Organização;

O Protocolo será aberto para ratificação por parte de qualquer Estado que tenha ratificado ou aderido à referida Convenção sobre Aviação Civil Internacional;

Os instrumentos de ratificação serão depositados junto da Organização da Aviação Civil Internacional;

O Protocolo entrará em vigor em relação aos Estados que a tenham ratificado na data em que o 124.º instrumento de ratificação seja depositado;

O Secretário-Geral deverá notificar imediatamente todos os Estados Contratantes sobre a data do depósito de cada ratificação do Protocolo;

O Secretário-Geral deverá notificar imediatamente todos os Estados Partes da referida Convenção sobre a data em que o Protocolo entra em vigor;

No que se refere à ratificação do Protocolo por qualquer outro Estado Contratante depois da data acima mencionada, o Protocolo entrará em vigor após depósito do seu instrumento de ratificação junto da Organização da Aviação Civil Internacional.

Em fé do que o Presidente da referida 32.ª Sessão da Assembleia e o Secretário-Geral da Organização, devidamente autorizados pela Assembleia, assinaram o presente Protocolo.

Feito em Montreal em 1 de Outubro de 1998, num único documento nas línguas árabe, chinesa, espanhola, francesa, inglesa e russa, cada um dos textos fazendo igualmente fé. O presente Protocolo ficará depositado nos arquivos da Organização da Aviação Civil Internacional e as cópias devidamente certificadas serão transmitidas pelo Secretário-Geral da Organização a todos os Estados Partes da Convenção sobre Aviação Civil Internacional, feita em Chicago em 7 de Dezembro de 1944.
