Resolução da Assembleia da República n.º 31/2009
Aprova o Tratado entre a República Portuguesa e a República Popular da China sobre Extradição, assinado em Pequim em 31 de Janeiro de 2007
A Assembleia da República resolve, nos termos da alínea i) do artigo 161.º e do n.º 5 do artigo 166.º da Constituição, aprovar o Tratado entre a República Portuguesa e a República Popular da China sobre Extradição, assinado em Pequim em 31 de Janeiro de 2007, cujo texto, nas versões autenticadas nas línguas portuguesa, chinesa e inglesa, se publica em anexo.

TRATADO ENTRE A REPÚBLICA PORTUGUESA E A REPÚBLICA POPULAR DA CHINA SOBRE EXTRADIÇÃO
A República Portuguesa e a República Popular da China (doravante designadas «as Partes»), desejando promover a efectiva cooperação entre os dois países na supressão do crime, com base no respeito mútuo pela soberania e igualdade e benefício mútuo, resolveram concluir este Tratado e acordaram no seguinte:
Artigo 1.º
Obrigação de extradição
Cada Parte compromete-se, nos termos das disposições deste Tratado e a pedido da outra Parte, a extraditar reciprocamente pessoas encontradas no seu território e procuradas pela outra Parte para efeitos de condução de processos criminais ou execução de sentença decretada contra tal pessoa.
Artigo 2.º
Crimes que dão lugar a extradição
1 - A extradição será concedida unicamente quando o acto pelo qual a extradição é pedida constituir um crime ao abrigo do direito de ambas as Partes e preencher uma das seguintes condições:
a) Nos casos em que o pedido de extradição se destine à condução de um processo criminal, o crime seja punível ao abrigo do direito de ambas as Partes com pena de prisão superior a um ano; ou
b) Nos casos em que o pedido de extradição se destine à execução de uma sentença decretada, o período da pena ainda por cumprir pela pessoa reclamada seja de pelo menos seis meses no momento em que o pedido de extradição é apresentado.
2 - Ao determinar se um acto constitui um crime ao abrigo do direito de ambas as Partes nos termos do n.º 1 deste artigo, não relevará a questão de o direito de ambas as Partes enquadrar o acto dentro do mesmo tipo de crime ou utilizar a mesma terminologia para designar o crime.
3 - Se o pedido de extradição disser respeito a dois ou mais actos, cada um constituindo um crime ao abrigo do direito de ambas as Partes, e pelo menos um preencher as condições estabelecidas no n.º 1 deste artigo, a Parte requerida pode conceder a extradição relativamente a todos aqueles actos.
Artigo 3.º
Fundamentos imperativos de recusa
1 - A extradição será recusada se:
a) A Parte requerida considerar o crime pelo qual a extradição é pedida um crime político ou que a Parte requerida concedeu asilo à pessoa reclamada;
b) A Parte requerida tiver motivos relevantes para acreditar que o pedido de extradição foi feito com o fim de mover uma acção ou punir a pessoa reclamada em virtude da sua raça, sexo, religião, nacionalidade ou opinião política ou que a sua situação processual pode ser prejudicada por qualquer das referidas razões;
c) O crime pelo qual a extradição é pedida constituir unicamente um crime militar;
d) A pessoa reclamada for um nacional da Parte requerida no momento em que o pedido de extradição é recebido pela Parte requerida;
e) A pessoa reclamada estiver, ao abrigo do direito de qualquer das Partes, isenta de responsabilidade criminal em virtude de quaisquer razões, tais como prescrição ou perdão;
f) A Parte requerida já tiver emitido decisão válida ou tiver dado por concluído o processo criminal contra a pessoa reclamada relativamente ao crime pelo qual a extradição é pedida;
g) O pedido de extradição for apresentado pela Parte requerente na sequência de julgamento na ausência do arguido, salvo se a Parte requerente garantir que a pessoa reclamada tem o direito e a oportunidade de recorrer da condenação ou de requerer novo julgamento na sua presença depois de extraditado; ou
h) A execução do pedido colocasse em causa a soberania, a segurança, a ordem pública ou outros interesses públicos essenciais da Parte requerida ou se fosse contrária aos princípios fundamentais do seu direito interno.
2 - Os crimes que não sejam considerados crimes políticos ao abrigo do direito interno da Parte requerida, ou ao abrigo de qualquer tratado, convenção ou acordo internacionais de que ambos os Estados sejam Partes, não serão tratados como crimes políticos.
Artigo 4.º
Fundamentos para recusa opcional
A extradição pode ser recusada se:
a) A Parte requerida tiver competência criminal para julgar o crime pelo qual a extradição é pedida ao abrigo do seu direito interno e estiver a conduzir ou a ponderar instaurar um processo contra a pessoa reclamada por aquele crime; ou
b) A extradição for incompatível com considerações humanitárias em virtude da idade, saúde ou outras condições da pessoa reclamada.
Artigo 5.º
Obrigação de instauração de processo criminal na Parte requerida
Se a extradição não for concedida nos termos da alínea d) do artigo 3.º deste Tratado, a Parte requerida, a pedido da Parte requerente, submeterá o caso à autoridade competente respectiva para efeitos de instauração de processo criminal de acordo com o seu direito interno. Para este efeito, a Parte requerente fornecerá à Parte requerida documentos e meios de prova relativos ao caso.
Artigo 6.º
Canais de comunicação
1 - Para efeitos deste Tratado, as Partes comunicarão entre si através das suas autoridades respectivamente designadas.
2 - As autoridades referidas no n.º 1 deste artigo serão a Procuradoria-Geral da República em representação da República Portuguesa e o Ministério dos Negócios Estrangeiros em representação da República Popular da China.
3 - Para efeitos de comunicação entre as autoridades referidas no n.º 1 deste artigo, poderá ser utilizada a língua inglesa.
Artigo 7.º
Pedido de extradição e documentos exigidos
1 - A Parte requerente apresentará um pedido oficial de extradição que incluirá:
a) O nome da autoridade requerente;
b) O nome, idade, sexo e, se conhecidos, a nacionalidade, categoria e número dos documentos de identificação, ocupação, características físicas, domicílio e residência da pessoa reclamada e outras informações que possam ajudar a identificar e procurar tal pessoa;
c) Factos relativos ao crime, incluindo o momento, local, actos e consequências do crime; e
d) Disposições legais relativas a criminalização, aplicação de pena, prescrição do prazo para instauração de acção ou para aplicação de pena e libertação antecipada se aplicável.
2 - Um pedido oficial de extradição apresentado pela Parte requerente será acompanhado de:
a) Uma cópia do mandado de captura ou outros documentos com o mesmo efeito quando a extradição for pedida para efeitos de condução de processo criminal; ou
b) Uma cópia da sentença executória e uma declaração sobre o período da pena que já tenha sido cumprido quando a extradição for pedida para efeitos de execução de sentenças;
c) Outras informações ou documentos fundamentando o pedido;
d) Se disponíveis, fotografias e impressões digitais da pessoa reclamada e outros documentos que possam ajudar a identificá-la.
3 - O pedido oficial de extradição e outros documentos relevantes apresentados pela Parte requerente nos termos dos n.os 1 e 2 deste artigo serão oficialmente assinados ou selados pela autoridade competente da Parte requerente e serão acompanhados de traduções na língua da Parte requerida.
Artigo 8.º
Informação adicional
Se a Parte requerida considerar que a informação fornecida para fundamentar um pedido de extradição não é suficiente, tal Parte pode pedir que lhe sejam devidamente fornecidas informações adicionais. Se a Parte requerente não apresentar informações adicionais, será tida como havendo renunciado voluntariamente ao pedido por si apresentado. Contudo, a Parte requerente não ficará impossibilitada de apresentar novo pedido de extradição pelo mesmo crime.
Artigo 9.º
Detenção provisória
1 - Em caso de urgência, uma Parte pode apresentar um pedido à outra Parte para a detenção provisória da pessoa reclamada antes de apresentar um pedido de extradição. Tal pedido pode ser apresentado por escrito através dos canais indicados no artigo 6.º deste Tratado, da Organização Internacional de Polícia Criminal (INTERPOL) ou de outros canais acordados por ambas as Partes.
2 - O pedido de detenção provisória conterá os elementos indicados no n.º 1 do artigo 7.º deste Tratado, uma declaração de existência de documentos indicados na alínea a) ou b) do n.º 2 daquele artigo e uma declaração de que um pedido oficial de extradição da pessoa reclamada será apresentado de seguida.
3 - A Parte requerida informará prontamente a Parte requerente do resultado da sua análise do pedido.
4 - Pôr-se-á fim à detenção provisória se, no prazo de 30 dias após a detenção da pessoa reclamada, a autoridade competente da Parte requerida não tiver recebido o pedido oficial de extradição. Mediante pedido devidamente apresentado pela Parte requerente, tal prazo poderá ser prorrogado por 15 dias.
5 - O fim da detenção provisória nos termos do n.º 4 deste artigo não prejudicará a extradição da pessoa reclamada se a Parte requerida tiver posteriormente recebido o pedido oficial de extradição.
Artigo 10.º
Decisão do pedido de extradição
1 - A Parte requerida tratará do pedido de extradição de acordo com os procedimentos estabelecidos no seu direito interno e informará prontamente a Parte requerente da sua decisão.
2 - Se a Parte requerida recusar integral ou parcialmente o pedido de extradição, as razões da recusa serão notificadas à Parte requerente.
Artigo 11.º
Entrega da pessoa a ser extraditada
1 - Se a extradição tiver sido concedida pela Parte requerida, as Partes acordarão relativamente ao tempo, lugar e outras questões relevantes respeitantes à execução da extradição.
2 - A Parte requerida informará a Parte requerente acerca do período de tempo em que a pessoa a ser extraditada tenha estado detida antes da entrega.
3 - Se a Parte requerente não tiver recebido a pessoa a ser extraditada no prazo de 15 dias após a data acordada para a execução da extradição, a Parte requerida libertará tal pessoa de imediato, podendo recusar novo pedido da Parte requerente para a extradição de tal pessoa pelo mesmo crime, excepto se outra coisa for estabelecida no n.º 4 deste artigo.
4 - Se uma Parte não entregar ou receber a pessoa a ser extraditada no prazo acordado por razões fora do seu controlo, a outra Parte será prontamente notificada. As Partes acordarão mais uma vez relativamente a questões relevantes para a execução da extradição, aplicando-se as disposições do n.º 3 deste artigo.
Artigo 12.º
Extradição adiada e extradição temporária
1 - Se estiver a correr processo judicial contra a pessoa reclamada ou se esta estiver a cumprir pena na Parte requerida por um crime que não aquele pelo qual a extradição é pedida, a Parte requerida pode, após ter decidido conceder a extradição, adiar a extradição até à conclusão do processo ou ao fim do cumprimento da pena. A Parte requerida informará a Parte requerente do adiamento.
2 - Se o adiamento da extradição puder prejudicar seriamente o andamento do processo criminal na Parte requerente, a Parte requerida pode, mediante pedido e na medida em que o processo criminal em curso não seja prejudicado, extraditar temporariamente a pessoa reclamada para a Parte requerente desde que a Parte requerente se comprometa a devolver a pessoa incondicional e imediatamente após a conclusão do processo em causa.
Artigo 13.º
Pedidos de extradição apresentados por vários Estados
Se forem apresentados pedidos de extradição relativos à mesma pessoa por dois ou mais Estados, incluindo a Parte requerente, a Parte requerida decidirá, nos termos do seu direito interno, se aceitará o pedido de qualquer dos Estados.
Artigo 14.º
Regra da especialidade
A pessoa extraditada nos termos deste Tratado não será sujeita a processo judicial ou a execução de pena na Parte requerente relativamente a um crime por si cometido antes da sua entrega que não por aquele pelo qual a extradição é concedida nem será reextraditada para um terceiro Estado, salvo se:
a) A Parte requerida tiver dado o seu prévio consentimento. Para efeitos de tal consentimento, a Parte requerida pode exigir a apresentação dos documentos e informações mencionados no artigo 7.º deste Tratado e uma declaração da pessoa extraditada relativamente ao crime em questão;
b) Tal pessoa não tiver abandonado a Parte requerente no prazo de 45 dias após estar livre para o fazer. Este prazo não incluirá, contudo, o tempo durante o qual a pessoa não abandonar a Parte requerente por razões alheias à sua vontade; ou
c) Tal pessoa tiver voluntariamente regressado à Parte requerente depois de a ter abandonado.
Artigo 15.º
Entrega de bens
1 - Se a Parte requerente assim o pedir, a Parte requerida, na medida em que tal for permitido pelo seu direito interno, procederá à apreensão das receitas e dos instrumentos do crime e outros bens que possam servir como meio de prova encontrados no seu território, e entregará tais bens à Parte requerente quando a extradição for concedida.
2 - Quando a extradição for concedida, os bens mencionados no n.º 1 deste artigo podem, não obstante, ser entregues ainda que a extradição não possa ser levada a cabo em virtude da morte, desaparecimento ou fuga da pessoa reclamada.
3 - A Parte requerida pode, de modo a conduzir quaisquer outros processos criminais em curso, adiar a entrega dos bens acima referidos até à conclusão de tais processos ou entregar temporariamente tais bens sob condição de a Parte requerente se comprometer a devolvê-los.
4 - A entrega de tais bens não prejudicará qualquer direito legítimo da Parte requerida ou de qualquer terceiro sobre tais bens. Caso existam tais direitos, a Parte requerente, a pedido da Parte requerida, devolverá prontamente os bens entregues, sem custos para a Parte requerida, logo que possível após a conclusão do processo.
Artigo 16.º
Trânsito
1 - Quando uma Parte dever extraditar uma pessoa de um terceiro Estado através do território da outra Parte, pedirá o consentimento da outra Parte para tal trânsito. Um tal pedido não será exigido quando for utilizado o transporte aéreo e não estiver prevista qualquer aterragem no território da outra Parte.
2 - A Parte requerida pode, na medida em que tal não seja contrário ao seu direito interno, aceder ao pedido de trânsito apresentado pela Parte requerente.
Artigo 17.º
Notificação do resultado
A Parte requerente fornecerá prontamente à Parte requerida informações sobre o processo ou a execução de sentença contra a pessoa extraditada ou informações respeitantes à reextradição de tal pessoa para um terceiro Estado.
Artigo 18.º
Despesas
As despesas resultantes dos procedimentos para a extradição na Parte requerida serão suportadas por tal Parte. As despesas de transporte e as despesas de trânsito relacionadas com a entrega ou recepção da pessoa extraditada ou a entrega de bens serão suportadas pela Parte requerente.
Artigo 19.º
Relação com outros tratados
Este Tratado não afectará qualquer direito ou obrigação assumida pelas Partes ao abrigo de quaisquer outros tratados.
Artigo 20.º
Solução de controvérsias
Qualquer controvérsia emergente da interpretação ou aplicação deste Tratado será dirimida através de consultas por via diplomática.
Artigo 21.º
Entrada em vigor, revisão e denúncia
1 - Este Tratado entrará em vigor 30 dias após a data de recepção da última notificação por escrito e por via diplomática, comunicando o cumprimento das respectivas formalidades constitucionais e legais para a entrada em vigor do Tratado.
2 - Este Tratado pode ser revisto em qualquer momento por acordo escrito entre as Partes. As emendas entrarão em vigor nos termos do n.º 1 deste artigo.
3 - Qualquer das Partes pode denunciar este Tratado em qualquer momento mediante notificação por escrito dirigida à outra Parte por via diplomática. A denúncia produzirá efeitos no 180.º dia após a data da notificação.
4 - Este Tratado aplica-se a qualquer pedido apresentado depois da sua entrada em vigor, ainda que os crimes em questão tenham ocorrido antes da entrada em vigor deste Tratado.
Em fé do que os abaixo-assinados, devidamente autorizados para o efeito pelos seus respectivos Governos, assinaram este Tratado.
Feito em duplicado em Pequim em 31 de Janeiro de 2007, nas línguas portuguesa, chinesa e inglesa, sendo todos os textos igualmente autênticos. Em caso de divergência de interpretação, o texto em inglês prevalecerá.

TREATY BETWEEN THE PORTUGUESE REPUBLIC AND THE PEOPLE'S REPUBLIC OF CHINA ON EXTRADITION
The Portuguese Republic and the People's Republic of China (hereinafter referred to as «the Parties»), desirous to promote the effective cooperation between the two countries in the suppression of crime on the basis of mutual respect for sovereignty and equality and mutual benefit, have resolved to conclude this Treaty and agreed as follows:
Article 1
Obligation to extradition
Each Party undertakes, in accordance with the provisions of this Treaty and at the request of the other Party, to extradite to each other persons found in its territory and wanted by the other Party for the purpose of conducting criminal proceedings against or executing sentence imposed on that person.
Article 2
Extraditable offences
1 - Extradition shall be granted only when the act for which the extradition is requested constitutes an offence under the laws of both Parties and meets one of the following conditions:
a) Where the request for extradition is aimed at conducting a criminal proceeding, the offence is punishable under the laws of both Parties by the penalty of imprisonment for a period of more than one year; or
b) Where the request for extradition is aimed at executing a sentence imposed, a period of sentence that remains to be served by the person sought is at least six months at the time when the request for extradition is made.
2 - In determining whether an act constitutes an offence under the laws of both Parties in accordance with paragraph 1 of this article, it shall not matter whether the laws of both Parties place the act within the same category of offence or denominate the offence by the same terminology.
3 - If the request for extradition concerns two or more acts each of which constitutes offence under the laws of both Parties and at least one of which fulfils the conditions provided for in paragraph 1 of this article, the Requested Party may grant extradition for all of those acts.
Article 3
Mandatory grounds for refusal
1 - Extradition shall be refused if:
a) The Requested Party considers that the offence for which the extradition is requested is a political offence, or that the Requested Party has granted asylum to the person sought;
b) The Requested Party has substantial grounds for believing that the request for extradition has been made for the purpose of prosecuting or punishing the person sought on account of that person's race, sex, religion, nationality or political opinion, or that that person's position in judicial proceedings may be prejudiced for any of those reasons;
c) The offence for which the extradition is requested only constitutes a military offence;
d) The person sought is a national of the Requested Party at the time the request for extradition is received by the Requested Party;
e) The person sought is, under the laws of either Party, exempted from criminal responsibility for any reasons such as lapse of time or pardon;
f) The Requested Party has already rendered an effective judgment or terminated the criminal proceeding against the person sought in respect of the offence for which the extradition is requested;
g) The request for extradition is made by the Requesting Party pursuant to a judgment rendered in absentia, unless the Requesting Party undertakes that the person sought has the right and opportunity to appeal against the conviction or to seek re-trial at his presence after being extradited; or
h) The execution of the request would impair sovereignty, security, public order or other essential public interests of the Requested Party, or would be contrary to the fundamental principles of its internal law.
2 - Offences that are not regarded as political offences under the internal law of the Requested Party, or under any international treaty, convention or agreement to which both States are Parties shall not be treated as political offences.
Article 4
Grounds for optional refusal
Extradition may be refused if:
a) The Requested Party has criminal jurisdiction over the offence for which the extradition is requested in accordance with its internal law, and is conducting or contemplates to institute a proceeding against the person sought for that offence; or
b) Extradition is incompatible with humanitarian considerations in view of that person's age, health or other conditions of the person sought.
Article 5
Obligation to institute criminal proceedings in the Requested Party
If extradition is not granted pursuant to subparagraph d) of article 3 of this Treaty, the Requested Party shall, at the request of the Requesting Party, submit the case to its competent authority for the purpose of institution of a criminal proceeding in accordance with its internal law. For this purpose, the Requesting Party shall provide the Requested Party with documents and evidence relating to the case.
Article 6
Channels of communication
1 - For the purpose of this Treaty, the Parties shall communicate with each other through their respectively designated authorities.
2 - The authorities referred to in paragraph 1 of this article shall be the Procuradoria-Geral da República for the Portuguese Republic and the Ministry of Foreign Affairs for the People's Republic of China.
3 - For the purpose of communication between the authorities referred to in paragraph 1 of this article, the english language may be used.
Article 7
Request for extradition and required documents
1 - The Requesting Party shall present an official request for extradition which shall include:
a) The name of the requesting authority;
b) The name, age, sex, and whenever available, nationality, category and number of identification documents, occupation, characteristics of appearance, domicile and residence of the person sought and other information that may help to identify and search for the person;
c) Facts of the offence, including the time, place, conduct and consequences of the offence; and
d) Legal provisions on criminalization, imposition of penalty, prescription for prosecution or penalty and early release if pertained.
2 - An official request for extradition submitted by the Requesting Party shall be accompanied by:
a) A copy of the warrant of arrest or other documents with the same effect when extradition is requested for the purpose of conducting criminal proceedings; or
b) A copy of the effective judgment and a statement of the period of sentence which has already been served when extradition is requested for the purpose of executing sentences;
c) Other information or material in support of the request;
d) If available, photographs and fingerprints of the person sought and other material which may help to identify that person.
3 - The official request for extradition and other relevant documents submitted by the Requesting Party in accordance with paragraphs 1 and 2 of this article shall be officially signed or sealed by the competent authority of the Requesting Party and be accompanied by translations in the language of the Requested Party.
Article 8
Additional Information
If the Requested Party considers that the information furnished in support of a request for extradition is not sufficient, that Party may request that additional information be duly furnished. If the Requesting Party fails to submit additional information, it shall be considered as having renounced its request voluntarily. However, the Requesting Party shall not be precluded from making a fresh request for extradition for the same offence.
Article 9
Provisional arrest
1 - In case of urgency, one Party may make a request to the other Party for the provisional arrest of the person sought before making a request for extradition. Such request may be submitted in writing through the channels provided for in article 6 of this Treaty, the International Criminal Police Organization (INTERPOL) or other channels agreed to by both Parties.
2 - The request for provisional arrest shall contain the contents indicated in paragraph 1 of article 7 of this Treaty, a statement of the existence of documents indicated in subparagraph a) or b) of paragraph 2 of that article and a statement that an official request for extradition of the person sought will follow.
3 - The Requested Party shall promptly inform the Requesting Party of the result of its handling of the request.
4 - Provisional arrest shall be terminated if, within a period of thirty days after the arrest of the person sought, the competent authority of the Requested Party has not received the official request for extradition. At a duly request by the Requesting Party, such time limit may be extended for fifteen days.
5 - The termination of provisional arrest pursuant to paragraph 4 of this article shall not prejudice the extradition of the person sought if the Requested Party has subsequently received the official request for extradition.
Article 10
Decision on the request for extradition
1 - The Requested Party shall deal with the request for extradition in accordance with the procedures provided for by its internal law, and shall promptly inform the Requesting Party of its decision.
2 - If the Requested Party refuses the whole or any part of the request for extradition, the reasons for refusal shall be notified to the Requesting Party.
Article 11
Surrender of the person to be extradited
1 - If the extradition has been granted by the Requested Party, the Parties shall agree on time, place and other relevant matters relating to the execution of the extradition.
2 - The Requested Party shall inform the Requesting Party of the period of time for which the person to be extradited has been detained prior to the surrender.
3 - If the Requesting Party has not taken over the person to be extradited within fifteen days after the date agreed for the execution of the extradition, the Requested Party shall release that person immediately and may refuse a fresh request by the Requesting Party for extradition of that person for the same offence, unless otherwise provided for in paragraph 4 of this article.
4 - If one Party fails to surrender or take over the person to be extradited within the agreed period for reasons beyond its control, the other Party shall be notified promptly. The Parties shall once again agree on the relevant matters for the execution of the extradition, and the provisions of paragraph 3 of this article shall apply.
Article 12
Postponed extradition and temporary extradition
1 - If the person sought is being proceeded against or is serving a sentence in the Requested Party for an offence other than that for which the extradition is requested, the Requested Party may, after having made a decision to grant extradition, postpone the extradition until the conclusion of the proceeding or the completion of the sentence. The Requested Party shall inform the Requesting Party of the postponement.
2 - If the postponement of the extradition may seriously impede the criminal proceedings in the Requesting Party, the Requested Party may, upon request and to the extent that its ongoing criminal proceedings are not hindered, temporarily extradite the person sought to the Requesting Party provided that the Requesting Party undertakes to return that person unconditionally and immediately upon conclusion of relevant proceedings.
Article 13
Requests for extradition made by Several States
If requests for extradition of the same person are made by two or more States, including the Requesting Party, the Requested Party shall, according to its internal law, decide whether to accept the request of any one State.
Article 14
Rule of speciality
The person extradited in accordance with this Treaty shall not be proceeded against or subject to the execution of sentence in the Requesting Party for an offence committed by that person before his surrender other than that for which the extradition is granted, nor shall that person be re-extradited to a third State, unless
a) The Requested Party has consented in advance. For the purpose of such consent, the Requested Party may require the submission of the documents and information mentioned in article 7 of this Treaty, and a statement by the extradited person with respect to the offence concerned;
b) That person has not left the Requesting Party within forty-five days after having been free to do so. However, this period of time shall not include the time during which that person fails to leave the Requesting Party for reasons beyond his control; or
c) That person has voluntarily returned to the Requesting Party after leaving it.
Article 15
Surrender of property
1 - If the Requesting Party so requests, the Requested Party shall, to the extent permitted by its internal law, seize the proceeds and instrumentality of the offence and other property which may serve as evidence found in its territory, and when extradition is granted shall surrender these property to the Requesting Party.
2 - When the extradition is granted, the property mentioned in paragraph 1 of this article may nevertheless be surrendered even if the extradition can not be carried out owing to the death, disappearance or escape of the person sought.
3 - The Requested Party may, for conducting any other pending criminal proceedings, postpone the surrender of above-mentioned property until the conclusion of such proceedings, or temporarily surrender that property on condition that the Requesting Party undertakes to return it.
4 - The surrender of such property shall not prejudice any legitimate right of the Requested Party or any third party to that property. Where these rights exist, the Requesting Party shall, at the request of the Requested Party, promptly return the surrendered property without charge to the Requested Party as soon as possible after the conclusion of the proceedings.
Article 16
Transit
1 - When one Party is to extradite a person from a third State through the territory of the other Party, it shall request the other Party for the permission of such transit. No such request is required where air transportation is used and no landing in the territory of the other Party is scheduled.
2 - The Requested Party may, insofar as not contrary to its internal law, grant the request for transit made by the Requesting Party.
Article 17
Notification of result
The Requesting Party shall provide the Requested Party promptly with the information on the proceedings or the execution of sentence against the extradited person or information concerning the re-extradition of that person to a third State.
Article 18
Expenses
Expenses arising from the procedures for extradition in the Requested Party shall be borne by that Party. Expenses of transportation and the transit expenses in connection with the surrender or taking over of the extradited person or surrender of property shall be borne by the Requesting Party.
Article 19
Relationship with other treaties
This Treaty shall not affect any right enjoyed and any obligation undertaken by the Parties under any other treaties.
Article 20
Settlement of disputes
Any dispute arising from the interpretation or application of this Treaty shall be settled by consultation through diplomatic channels.
Article 21
Entry into force, revision and termination
1 - This Treaty shall enter into force thirty days after the date of receipt of the later notification in writing and through the diplomatic channel, conveying the fulfillment of their respective constitutional or legal formalities for the entry into force of the Treaty.
2 - This Treaty may be revised at any time by written agreement between the Parties. The amendments shall enter into force under the terms of paragraph 1 of this article.
3 - Either Party may terminate this Treaty at any time by notice in writing to the other Party through diplomatic channels. The termination shall take effect on the one hundred and eightieth day after the date on which the notice is given.
4 - This Treaty applies to any request presented after its entry into force even if the relevant offences occurred before the entry into force of this Treaty.
In witness whereof the undersigned, being duly authorized thereto by their respective Governments, have signed this Treaty.
Done in duplicate at Beijing on this 31st day of January of 2007, in the portuguese, chinese and english languages, all texts being equally authentic. In case of divergence of interpretation, the english text shall prevail.
