Decreto n.º 101/77

O Governo decreta, nos termos da alínea c) do artigo 200.º da Constituição, o seguinte:

Artigo único. É aprovado, para ratificação, o Protocolo à Convenção Internacional das Pescarias do Noroeste do Atlântico, celebrado em Washington em 8 de Abril de 1975, cujos textos em inglês e respectiva tradução para português vão anexos ao presente decreto-lei.

PROTOCOL TO THE INTERNATIONAL CONVENTION FOR THE NORTHWEST ATLANTIC FISHERIES

The Governments parties to the International Convention for the Northwest Atlantic Fisheries signed at Washington under date of February 8, 1949, which Convention, as amended, is hereinafter referred to as the Convention, agree as follows:

ARTICLE I

Paragraph 3 of article XI of the Convention is amended to read as follows:

3. The Commission shall calculate the payments due from each Contracting Government under the annual administrative budget according to the following formula:

a) 15% of the administrative budget shall be deducted and the amount divided equally among the Contracting Governments;

b) The remainder shall be divided into such number of equal shares as corresponds to the total number of Panel member-ships;

c) The payment due from any Contracting Government shall be its share of the 15% deduction plus the number of shares equal to the number of Panels in which trat Government participates.

ARTICLE II

1. This Protocol shall take effect for all Contracting Governments one hundred and twenty days following the date on the notification by the Government of the United States of America, the Depositary Government, of receipt of written notification of approval by three-fourths of all Contracting Government unless any other Contracting Government notifies the Depositary Government that it objects to the Protocol, within ninety days of the date on the notification by the Depositary Government of such receipt, in which case the Protocol shall not take effect for any Contracting Government.

2. Any Contracting Government which has objected to this Protocol may at any time withdraw that objection. If all objections are withdrawn, this Protocol shall take effect for all Contracting Governments one hundred and twenty days following the date on the notification by the Depositary Government of receipt of the last withdrawal.

3. Any Government becoming a party to the Convention after June 16, 1973, shall be deemed to have approved this Protocol.

ARTICLE III

1. The Depositary Government shall promptly notify all Contracting Governments of the receipt of notifications of approval of the present Protocol, the receipt of notifications of objection or withdrawal of objections, and the entry into force of this Protocol.

2. The original of this Protocol shall be deposited with the Depositary Government, which Government shall communicate certified copies thereof to all the Governments signatory or adhering to the Convention.

PROTOCOLO À CONVENÇÃO INTERNACIONAL DAS PESCARIAS NO NOROESTE DO ATLÂNTICO

Os Governos partes da Convenção Internacional das Pescarias no Noroeste do Atlântico, assinada em Washington a 8 de Fevereiro de 1949, a qual, com a presente emenda, é de ora avante referida como a Convenção, acordam no seguinte:

ARTIGO I

O parágrafo 3 do artigo XI da Convenção é alterado, passando a ter a seguinte redacção:

3. A Comissão calculará os pagamentos devidos por cada Governo Contratante na vigência do orçamento administrativo anual, de acordo com a seguinte fórmula:

a) 15% do orçamento administrativo será deduzido e a quantia dividida igualmente entre os Governos Contratantes;

b) O restante será dividido em tantas partes iguais quantas as correspondentes ao número total dos membros dos Painéis;

c) O pagamento devido por qualquer dos Governos Contratantes será a sua parte da dedução de 15% mais o número de partes iguais ao número de Painéis nos quais o Governo participa.

ARTIGO II

1. Este Protocolo entrará em vigor para todos os Governos Contratantes decorridos cento e vinte dias sobre a data de notificação pelo Governo dos Estados Unidos da América, na sua qualidade de Governo Depositário, da recepção da notificação escrita de aprovação de três quartos de todos os Governos Contratantes, a menos que outro Governo Contratante notifique o Governo Depositário de que se opõe ao Protocolo, dentro dos noventa dias subsequentes à data da notificação pelo Governo Depositário de tal recepção, o que, a verificar-se, determinará que o Protocolo não produzirá efeitos em relação a nenhum dos Governos Contratantes.

2. Qualquer Governo Contratante que se tiver oposto a este Protocolo pode a todo o tempo retirar essa objecção. Se todas as objecções forem retiradas, este Protocolo entrará em vigor para todos os Governos Contratantes passados cento e vinte dias sobre a data de notificação pelo Governo Depositário da recepção da última retirada de objecção.

3. Considerar-se-á que qualquer Governo que se torne parte da Convenção depois de 16 de Junho de 1973 aprova este Protocolo.

ARTIGO III

1. O Governo Depositário deverá notificar prontamente todos os Governos Contratantes da recepção de notificações de aprovação do presente Protocolo, da recepção de notificações de objecção ou retirada de objecção e da entrada em vigor deste Protocolo.

2. O original deste Protocolo será depositado junto do Governo Depositário, cujo Governo deverá enviar cópias certificadas a todos os Governos signatários ou aderentes à Convenção.
