Decreto n.º 35/80
de 30 de Maio
O Governo decreta, nos termos da alínea c) do artigo 200.º da Constituição, o seguinte:
Artigo único. É aprovado o Acordo de Cooperação Cultural entre o Governo da República Portuguesa e o Governo da República da Índia, assinado em Lisboa a 7 de Abril de 1980, cujo texto em inglês vai anexo ao presente decreto, assim como a correspondente tradução em português.

Cultural Cooperation Agreement between the Government of the Portuguese Republic and the Government of the Republic of India.
The Government of the Portuguese Republic and the Government of the Republic of India (hereinafter referred to as the Contracting Parties):
Desirous of maintaining and promoting the cultural ties, which contribute to closeness between the two countries as well as to the cause of friendship between their peoples;
Recalling the provisions of article IV of the Treaty between Portugal and India, signed at New Delhi on 31st December 1974, by which the Contracting Parties agree to take steps to develop contacts in the cultural field and in particular in the promotion of the Portuguese language and culture and the preservation of historical and religious monuments in Goa, Daman, Diu, Dadra and Nagar Haveli;
have agreed as follows:
ARTICLE I
The Contracting Parties shall facilitate and encourage cooperation in the fields of art and culture, education, including academic activity in the field of science and technology, youth activities and public health, mass media of information and education, sports and games in order to contribute towards a better knowledge of their respective cultures and activities in these fields.
ARTICLE II
1) Each Contracting Party shall encourage and support, to the extent possible, the study of the history, culture and languages of the other Contracting Party.
2) Both the Contracting Parties agree to take steps to develop contacts in the cultural fields and in particular in the promotion of the Portuguese language and culture and the preservation of historical monuments, including those in religious use, in Goa and other places in India.
ARTICLE III
1) Each Contracting Party may establish in the territory of the other cultural institutes in accordance with its laws regulations and general policy in this regard, it being understood that prior clearance of the Government concerned would be obtained before any such institution is established.
2) The details regarding the establishment of such institutions shall be settled between the two countries by means of an additional Protocol to be negotiated after this Agreement enters into force.
ARTICLE IV
The Contracting Parties shall take appropriate steps for the preservation of historical records and historical monuments, including historical monuments in religious use, of common interest to them.
ARTICLE V
The Contracting Parties shall encourage and facilitate:
a) Reciprocal visits of professors and experts for delivering lectures, sudy tours and special courses;
b) Reciprocal visits of representatives of educational, literary, scientific, technical, artistic, sports and jornalists' associatons/organisations; and
c) Participation in congresses, conferences, symposia and seminars.
ARTICLE VI
The Contracting Parties shall encourage and facilitate:
a) Exchange of materials in the field of culture such as films, documentaries, radio and television programme recordings and recordings on discs and tapes as well as exchange of materials in the fields of science, education, sports; and
c) Translation and exchange of books, periodicals and other educational, scientific, technical, cultural and sports publications, and wherever possible, exchange of art specimens.
ARTICLE VII
Each Contracting Party shall endeavour to provide facilities and scholarschips to students and scientific personnel of the other country seeking to study in its institutions of higher education and research laboratories, as well as to follow practical trainig courses.
ARTICLE VIII
The Contracting Parties shall examine the diplomas, certificates, university degrees granted by the other Party with a view to arriving at their equivalence.
ARTICLE IX
Each Contracting Party shall endeavour to present different facets of the life and culture of the other Party through the media of radio, television and press. With this end in view, the two Parties shall exchange suitable materials and programmes.
ARTICLE X
The Contracting Parties shall facilitate and promote:
a) Exchange of artists, and dance and music ensembles;
b) Exchange of art and other exhibitions; and
c) Exchange of experts in the field of cinematography and participation in each other's International Film Festivals.
ARTICLE XI
The Contracting Parties shall encourage visits of sports teams between the two countries and shall facilitate, subject to the national laws and regulation in force, their stay and movements in their respective territories.
ARTICLE XII
The Contracting Parties shall promote, in the field of youth activities, exchange of documents and encourage cooperation between their youth movements and associations.
ARTICLE XIII
Each Contracting Party shall facilitate, in accordance whit its respective laws, the importation for non-commercial purposes and circulation of all material originating from the other party, that may be necessary for the fulfilment of the objectives of this Agreement.
ARTICLE XIV
For the implementation of the objectives of the present Agreement, a joint Committee shall be established by the Contracting Parties as and when considered necessary consisting of an equal number of representatives of the two Governments, which shall meet as agreed upon between the Contracting Parties or at the request of either of them alternatively in Lisbon and New Delhi, at least once in two years.
The Joint Committee will be responsible for:
a) Reviewing periodically the implementation of the Agreement in the two countries;
b) Advising the Government concerned on the modalities of implementation;
c) Formulating cultural, scientific, technological and educational exchange programmes, and reviewing the same;
d) Recommending to the Party concerned any item of interest to either party in the fields within the scope of the Agreement; and
c) Generally advising the Government concerned as to the manner in which the provisions of this Agreement may be implemented effectively.
ARTICLE XV
The present Agreement shall come into force on the date of the exchange of the instruments of ratification. It shall remain in force for a period of five years and shall be renewed automatically thereafter for further periods of five years each time unless either Contracting Party gives to the other party a six months' prior written notice of ist intention to terminate it.
In witness whereof the undersigned representatives being duly authorised thereto by their Governments, have signed the present Agreement and have affixed their scals.
Done at Lisbon on this seventh day of April. One thousand, nine hundred and eighty (A.D), corresponding to the eighteenth day of Chaitra, one thousand, nine hundred and two (Saka), in six originals, two each in Portuguese, Hindi and English languages, all the texts being equally authentic except in case of doubt when the English text shall prevail.

Acordo de Cooperação Cultural entre o Governo da República Portuguesa e o Governo da República da Índia
O Governo da República Portuguesa e o Governo da República da Índia (a seguir designados como Partes Contratantes):
Desejosos de manter e ampliar os laços culturais capazes de contribuir para uma maior aproximação entre os dois países, bem como para a amizade entre os seus povos;
Tendo em conta o disposto no artigo IV do Tratado entre Portugal e a Índia, assinado em Nova Delhi em 31 de Dezembro de 1974, pelo qual as Partes Contratantes acordaram em tomar medidas para desenvolver contactos no campo cultural e, em particular, na promoção da língua e cultura portuguesas e na conservação de monumentos históricos e religiosos em Goa, Damão, Diu, Dadrá e Nagar-Aveli;
acordaram no seguinte:
ARTIGO 1.º
As Partes Contratantes deverão facilitar e encorajar a cooperação nos domínios da arte e da cultura, da educação, incluindo actividades académicas, no domínio da ciência e da tecnologia, da juventude e da saúde pública, da comunicação social, nos seus aspectos da informação e da educação, e dos desportos, por forma a contribuir para um melhor conhecimento das suas respectivas culturas e das actividades desenvolvidas nestes domínios.
ARTIGO 2.º
Cada Parte Contratante deverá encorajar e promover, na medida do possível, o estudo da história, cultura e línguas da outra Parte Contratante.
Ambas as Partes Contratantes acordaram em intensificar contactos no domínio da cultura e, nomeadamente, promover o estudo da língua e cultura portuguesas e preservar os monumentos históricos, incluindo os que ainda estejam abertos ao culto, existentes em Goa e em outros lugares da Índia.
ARTIGO 3.º
Cada Parte Contratante poderá estabelecer institutos culturais no território da outra Parte, de acordo com as suas leis, regulamentos e planos de acção neste domínio. Será, no entanto, necessária a obtenção de autorização do Governo da outra Parte antes do estabelecimento de qualquer instituição feita ao abrigo do presente artigo.
Os pormenores relativos ao estabelecimento de tais instituições serão definidos entre os dois países por um protocolo adicional a negociar após a entrada em vigor do presente Acordo.
ARTIGO 4.º
As Partes Contratantes deverão tomar medidas apropriadas à preservação dos arquivos e monumentos históricos, incluindo os monumentos históricos de natureza religiosa ainda em uso e que sejam de interesse comum.
ARTIGO 5.º
As Partes Contratantes deverão encorajar e facilitar:
a) Visitas mútuas de professores e peritos para levarem a cabo palestras, visitas de estudo e cursos especializados;
b) Visitas mútuas de representantes de associações ou organizações educacionais, literárias, científicas, técnicas, artísticas, desportivas e jornalísticas; e
c) Participação em congressos, conferências, simpósios e seminários.
ARTIGO 6.º
As Partes Contratantes deverão encorajar e facilitar:
a) O intercâmbio de material no domínio da cultura, como filmes, documentários, gravações de programas de rádio e de televisão e gravações em discos e fitas magnéticas, bem como o intercâmbio de material nos domínios da ciência, educação, desporto; e
b) A tradução e troca de livros, jornais e demais publicações educacionais, científicas, técnicas, culturais e desportivas e, sempre que possível, o intercâmbio de objectos de arte.
ARTIGO 7.º
Cada Parte Contratante fará o possível por conceder facilidades e bolsas de estudo aos estudantes e pessoal científico da outra Parte que pretendam estudar nas suas instituições de ensino superior e nos seus laboratórios de pesquisa, bem como seguir cursos de aperfeiçoamento.
ARTIGO 8.º
As Partes Contratantes examinarão os diplomas, certificados e graus académicos concedidos pela outra Parte com vista ao reconhecimento da sua equivalência.
ARTIGO 9.º
Cada Parte Contratante fará o possível por dar a conhecer os diferentes aspectos da vida e cultura da outra Parte através da rádio, televisão e imprensa.
As duas Partes deverão trocar, para o efeito, materiais e programas apropriados.
ARTIGO 10.º
As Partes Contratantes deverão facilitar e promover:
a) O intercâmbio de artistas e grupos musicais e de dança;
b) O intercâmbio de exposições de arte e outras; e
c) O intercâmbio de peritos no campo da cinematografia e a participação nos seus respectivos festivais internacionais do filme.
ARTIGO 11.º
As Partes Contratantes deverão encorajar visitas de grupos desportivos entre ambos os países e facilitar, nos termos das leis nacionais e regulamentos em vigor, a sua estada e deslocação nos seus respectivos territórios.
ARTIGO 12.º
As Partes Contratantes promoverão, no sector da juventude, trocas de documentação e encorajarão o intercâmbio entre movimentos e associações juvenis.
ARTIGO 13.º
Cada Parte Contratante deverá facilitar, de acordo com a sua legislação adequada, a importação para fins não comerciais e a livre circulação de todo o material originário da outra Parte necessária ao cumprimento dos objectivos do presente Acordo.
ARTIGO 14.º
Para o cumprimento dos objectivos do presente Acordo, será criada pelas Partes Contratantes uma Comissão Mista, constituída, sempre que possível, por igual número de representantes dos dois Governos, que se reunirá por acordo das Partes Contratantes, a pedido de uma delas, em Lisboa e Nova Delhi alternadamente, no mínimo de dois em dois anos.
Compete à Comissão Mista:
a) Examinar regularmente a aplicação do Acordo em ambos os países;
b) Aconselhar o respectivo Governo sobre as modalidades de execução do Acordo;
c) Elaborar programas de intercâmbio cultural, científico, tecnológico e educacional e efectuar uma revisão periódica dos mesmos;
d) Recomendar às Partes temas de interesse para qualquer delas no âmbito do Acordo; e
e) Aconselhar, de um modo geral, a cada um dos Governos as acções a adoptar com vista a uma melhor aplicação do Acordo.
ARTIGO 15.º
O presente Acordo entrará em vigor à data da troca dos instrumentos de ratificação. Permanecerá em vigor por um período de cinco anos e será automaticamente renovado no fim desse período por novos períodos de cinco anos, excepto se uma das Partes Contratantes, mediante aviso prévio de seis meses, comunicar à outra Parte a sua intenção de pôr termo ao presente Acordo.
Em fé do que, os representantes das Partes Contratantes, devidamente autorizados para o efeito, assinaram o presente Acordo e nele apuseram os seus selos.
Feito em Lisboa aos 7 dias do mês de Abril de 1980, correspondente ao dia 18 de Chaitra de 1902, em seis originais, sendo dois em língua portuguesa, dois em língua inglesa e dois em língua hindi, fazendo os seis textos igualmente fé, prevalecendo, no entanto, o texto em inglês, em caso de dúvida.
