Decreto n.º 36/82

de 27 de Março

O Governo decreta, nos termos da alínea c) do artigo 200.º da Constituição, o seguinte:

Artigo único. É aprovado, para ratificação, o Acordo Cultural entre o Governo da República Portuguesa e o Governo da República da Zâmbia, assinado em Lusaka aos 2 de Dezembro de 1981, cujo texto em inglês vai anexo ao presente decreto assim como a correspondente tradução em português.

CULTURAL AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF PORTUGAL AND THE GOVERNMENT OF THE REPUBLIC OF ZAMBIA.

The Government of the Republic of Portugal and the Government of the Republic of Zambia (hereinafter referred to as the two Parties) desiring to strengthen the friendship between their two peoples and to promote the relations between the two countries in the fields of education, culture and science under the framework of mutual respect of the principles of national sovereignty and independence, of the equality of rights non-interference in internal matters, have decided to sign the present Agreement.

ARTICLE I

The two Parties shall encourage all the activities conducive to a better knowledge of their respective cultures and main fields of artistic, scientific and educacional activities.

ARTICLE II

The two Parties shall favour the development of their relations in the field of education by means of:

a) Promoting cooperation between their universities and other high educational institutions;

b) Reciprocal visits of teachers of all levels for study purposes and delivery of lectures;

c) Studying and promoting the languages of both countries.

ARTICLE III

The two Parties shall study the possibility of providing lecturerships and courses in Portuguese in educational and cultural institutions of Zambia.

ARTICLE IV

Each Party shall study the possibility of using the same academic and scientific titles, degrees and diplomas obtained from teaching institutions of either Party.

ARTICLE V

Each Party, within the limits of its internal legislation, shall act in a way to avoid incorrect references of the history of the other Party in text books used in its public educational institutions.

ARTICLE VI

The two Parties shall encourage the development of mutual relations in cultural, artistic and scientific fields and will, for this purpose:

a) Reciprocally grant all facilities for the exchange of books, publications, radio and television programmes and production of works of art;

b) Encourage the exchange of educational and scientific films of national productions;

c) Favour the organization of art exhibitions, concerts and musical auditions, drama performances and other artistic activities;

d) Facilitate the co-operation between specialised education institutions, cultural and scientific centres, art schools, museums, libraries and archives.

ARTICLE VII

For the safeguard of national patrimony of each country the two Parties shall prevent the exit or admission of works of art and documents of historic or patrimonial value.

ARTICLE VIII

The two Parties shall favour interchange in the fields of sport and physical education.

ARTICLE IX

Each Party shall study the possibility of granting scholarships annually to the nationals of the other Party which may enable them to study or have training in cultural centres and to attend specialised courses in higher educational or similar institutions.

ARTICLE X

For the purposes of implementing this Agreement, the two Parties shall set periodical educational, cultural and scientific programmes which will define the concrete activities to be carried out and the methods under which such programmes will be carried out.

ARTICLE XI

1 - To carry out the objectives under this Agreement, a joint committee shall be created with the task of presenting suggestions and recommendations and giving advice to the two Parties.

2 - The joint committee shall meet every three years alternately in Zambia and Portugal and the meetings shall be presided over by the host country.

3 - The joint committee may create sub-committees or working groups to produce specialized studies on the subjects concerning this Agreement to be submitted to the two Parties.

4 - The joint committee may also call experts to the meeting as counsellors.

ARTICLE XII

This Agreement shall come into force upon the date of exchange of the instruments of ratification between the two Parties.

ARTICLE XIII

The Agreement shall remain in force for a period of 5 years and may automatically be extendend for further periods of 2 years, unless terminated by either Party by giving 6 months notice in writing before the date of expiry.

Done at Lusaka on the 2nd day of December, 1981, in 2 originals in the English and Portuguese languages, both texts being equally authentic.

ACORDO CULTURAL ENTRE O GOVERNO DA REPÚBLICA PORTUGUESA E O GOVERNO DA REPÚBLICA DA ZÂMBIA

O Governo da República Portuguesa e o Governo da República da Zâmbia, a seguir designados como «Duas Partes», desejosos de fortalecer os laços de amizade entre os seus povos e de desenvolver as relações entre os 2 países nos domínios do ensino, da cultura e da ciência, com base no respeito recíproco dos princípios da soberania e da independência nacionais, da igualdade dos direitos e da não ingerência nos assuntos internos, decidiram firmar o presente Acordo:

ARTIGO I

As Duas Partes encorajarão todas as actividades susceptíveis de contribuir para o melhor conhecimento das respectivas culturas e principais domínios de actividade artística, científica e educativa.

ARTIGO II

As Duas Partes favorecerão o desenvolvimento das relações no domínio do ensino através:

a) Da promoção da cooperação entre as universidades e outros estabelecimentos de ensino superior;

b) De visitas recíprocas de professores de todos os graus de ensino, a fim de se documentarem e realizarem conferências;

c) Da divulgação e do estudo das línguas dos 2 países.

ARTIGO III

As Duas Partes comprometem-se a estudar a possibilidade de criação de leitorados e cursos de Português em instituições de ensino e de cultura na República da Zâmbia.

ARTIGO IV

Cada uma das Partes estudará a possibilidade de equivalência recíproca de títulos, graus e diplomas académicos ou científicos obtidos nos estabelecimentos de ensino da outra Parte.

ARTIGO V

Cada uma das Partes compromete-se, nos limites da sua legislação interna, a proceder de maneira que os textos utilizados nos seus estabelecimentos de ensino oficial não contenham inexactidões no que se refere à História da outra Parte.

ARTIGO VI

As Duas Partes encorajarão o desenvolvimentos das relações recíprocas nos domínios cultural, artístico e científico, comprometendo-se para isso a:

a) Conceder reciprocamente todas as possíveis facilidades para a troca de livros, publicações, programas de rádio e de televisão e produções de obras de arte;

b) Encorajar a troca de filmes científicos e educativos de produção nacional;

c) Favorecer a organização de exposições de arte, concertos e audições musicais, representações teatrais e outras manifestações artísticas;

d) Facilitar a cooperação entre as instituições de ensino especializadas, centros culturais e científicos, escolas de arte, museus, bibliotecas e arquivos.

ARTIGO VII

Para a salvaguarda do património nacional de cada país, as Duas Partes comprometem-se a impedir a saída e entrada de obras de arte ou de espécies documentais de valor histórico ou patrimonial.

ARTIGO VIII

As Duas Partes favorecerão o intercâmbio nos domínios dos desportos e da educação física.

ARTIGO IX

Cada uma das Partes estudará a possibilidade de conceder anualmente aos nacionais da outra Parte bolsas de estudo que lhes permitam realizar estudos ou estágios em centros culturais ou frequentar cursos de especialização em estabelecimentos de ensino superior ou equiparados.

ARTIGO X

Com o fim de aplicar as disposições do presente Acordo, as Duas Partes estabelecerão periodicamente programas de intercâmbio nos domínios do ensino, da cultura e da ciência, definindo as actividades concretas a realizar e o modo mais adequado à respectiva efectivação.

ARTIGO XI

1 - Para a consecução dos objectivos referidos no presente Acordo será constituída uma comissão mista que terá a seu cargo apresentar sugestões, recomendações e conselhos às Duas Partes.

2 - A comissão mista reunir-se-á de 3 em 3 anos e, alternadamente, em Portugal e na Zâmbia, cabendo a presidência das reuniões ao país em que as mesmas se realizarem;

3 - A comissão mista poderá criar subcomissões ou grupos de trabalho com o fim de realizarem estudos especializados sobre as matérias constantes deste Acordo, para posteriormente os submeterem às Duas Partes;

4 - A comissão mista poderá igualmente convocar peritos para as reuniões na qualidade de assessores.

ARTIGO XII

O presente Acordo entrará em vigor a partir da data da troca definitiva dos instrumentos de ratificação entre as Duas Partes.

ARTIGO XIII

O Acordo será válido pelo período de 5 anos, podendo ser renovado por períodos sucessivos de 2 anos e por recondução tácita, salvo se uma das Partes o denunciar, por escrito, pelo menos 6 meses antes da sua expiração.

Feito em Lusaca, aos 2 dias do mês de Dezembro de 1981, em 2 originais, em língua portuguesa e em língua inglesa, ambos os textos sendo igualmente autênticos.
