Decreto n.º 37/81
de 18 de Março
O Governo decreta, nos termos da alínea c) do artigo 200.º da Constituição, o seguinte:
Artigo único. É aprovada, para ratificação, a Convenção sobre Segurança Social entre a República Portuguesa e o Reino da Noruega, assinada em Oslo em 5 de Junho de 1980, cujos textos em português e inglês vão anexos ao presente decreto.

CONVENÇÃO SOBRE SEGURANÇA SOCIAL ENTRE A REPÚBLICA DE PORTUGAL E O REINO DA NORUEGA
O Reino da Noruega e a República de Portugal, animados do desejo de regular as relações entre os dois Estados no respeitante à segurança social, acordaram em concluir a seguinte convenção:
PARTE I
Disposições gerais
ARTIGO 1.º
1 - A presente Convenção é aplicável ao Reino da Noruega e à República de Portugal. É também aplicável à plataforma continental norueguesa.
2 - Para efeitos da presente Convenção a menos que do contexto resulte entendimento diferente:
a) «Território» significa, relativamente à Noruega, o território do Reino da Noruega e, relativamente à República de Portugal, o seu território nacional;
b) «Legislação» significa as leis e regulamentos especificados no artigo 2.º;
c) «Autoridade competente» significa, relativamente à Noruega, o Ministério dos Assuntos Sociais e, no que respeita a prestações de desemprego, o Ministério do Trabalho do governo local e, relativamente a Portugal, o Ministério dos Assuntos Sociais;
d) «Instituição de seguro» significa o organismo competente ou a autoridade responsável pela aplicação da legislação especificada no artigo 2.º;
e) «Organismo de ligação» significa o organismo competente para ligação e informação entre as instituições de seguro das duas Partes Contratantes, com vista a simplificar a aplicação desta Convenção, bem como para informação das pessoas interessadas sobre os seus direitos e obrigações ao abrigo da Convenção;
f) «Períodos de seguro» significam os períodos de contribuição, de emprego, ou outros reconhecidos como períodos de seguro pela legislação ao abrigo da qual foram cumpridos, incluindo os anos em relação aos quais tenham sido creditados pontos de pensão sob o sistema de seguro nacional norueguês, para efeitos de pensão suplementar com base no emprego ou noutra actividade económica durante o ano em questão, ou em parte dele;
g) O termo «pensão» inclui qualquer aumento de pensão ou qualquer quantia adicional pagável com esta;
h) «Pessoa segurada» significa uma pessoa segurada de acordo com a legislação especificada no artigo 2.º;
i) Os termos «familiares» e «sobreviventes» significam qualquer pessoa definida ou reconhecida como tal pela legislação ao abrigo da qual as prestações são concedidas;
j) «Prestações suplementares» (supplementary benefits) significam, em relação à Noruega, o suplemento pago em relação ao cônjuge e filhos a cargo (supporter's supplement for spouse and children), a prestação de compensação (compensation benefit) e o suplemento especial (special supplement);
k) «Prestações por morte» significam prestações únicas concedidas por ocasião da morte para a cobertura dos encargos de funeral e de outras despesas.
3 - Outros termos e expressões usados na Convenção terão o significado que, respectivamente lhes é atribuído na legislação aplicável.
ARTIGO 2.º
1 - A presente Convenção aplicável:
A) Em relação à Noruega, à seguinte legislação:
a) À Lei de 17 de Junho de 1966, relativa ao seguro nacional;
b) À Lei de 19 de Junho de 1969, relativa aos suplementos especiais às prestações do seguro nacional;
c) À Lei de 19 de Dezembro de 1969, sobre o suplemento de compensação do seguro nacional;
d) À Lei de 24 de Outubro de 1946, relativa ao abono de família.
B) Em relação a Portugal, à legislação sobre:
a) O regime geral de previdência social e abono de família, relativo à doença, maternidade, invalidez, velhice, sobrevivência, abono de família e prestações complementares;
b) Os regimes especiais de previdência social e abono de família relativos aos ramos referidos na alínea a) deste parágrafo;
c) A pensão social;
d) Os acidentes de trabalho e doenças profissionais;
e) As prestações de desemprego.
2 - A Covenção é aplicável a todas as leis e regulamentos que codifiquem, alterem ou completem a legislação especificada no n.º 1 deste artigo.
3 - A presente Convenção é aplicável:
a) A todas as leis e regulamentos que instituam um novo ramo de segurança social, unicamente se as Partes Contratantes assim acordarem;
b) A todas as leis e regulamentos que alarguem os regimes de seguro já existentes a novas categorias as de pessoas, a não ser que a Parte Contratante interessada notifique a outra Parte, dentro do prazo de seis meses após a promulgação oficial dessa lei ou regulamento, de que se lhes não aplica a presente Convenção.
4 - As pessoas abrangidas pela Convenção não podem, ao obrigo desta, invocar quaisquer direitos relativamente a convenções sobre segurança social que as Partes Contratantes tenham celebrado ou venham a celebrar com terceiro Estado.
ARTIGO 3.º
1 - A presente Convenção é aplicável aos nacionais das Partes Contratantes, bem como aos seus familiares cujos direitos sejam atribuídos em função daqueles nacionais, salvo o disposto por forma diversa no n.º 1 do artigo 8.º
2 - A Convenção é também aplicável a refugiados e apátridas no sentido da Convenção de 28 de Julho de 1951 Relativa ao Estatuto dos Refugiados e do respectivo Protocolo de 31 de Janeiro de 1967, assim como da Convenção de 28 de Setembro de 1954 Relativa ao Estatuto dos Apátridas.
ARTIGO 4.º
Salvo disposição em contrário desta Convenção, as pessoas referidas no precedente artigo 3.º, quando estejam no território de uma Parte Contratante, ficam sujeitas às mesmas obrigações e têm direito a gozar das mesmas regalias nas mesmas condições que os nacionais dessa Parte Contratante na aplicação da legislação dessa mesma Parte Contratante.
ARTIGO 5.º
Salvo disposição em contrário desta Convenção, as pensões de velhice, as pensões de invalidez, as pensões de sobrevivência, as pensões relativas a acidentes de trabalho e doenças profissionais e as prestações por morte não podem ser reduzidas, modificadas, suspensas ou suprimidas pelo facto de o beneficiário residir no território da outra Parte Contratante.
ARTIGO 6.º
As prestações mencionadas no artigo 5.º devidas por uma das Partes Contratantes serão pagas aos nacionais da outra Parte Contratante que residam num terceiro Estado nas mesmas condições e na mesma medida que aos nacionais da primeira Parte Contratante residentes nesse terceiro Estado.
PARTE II
Disposições relativas à legislação aplicável
ARTIGO 7.º
1 - Salvo o disposto em contrário nos artigos 8.º, 9.º e 10.º, pessoas abrangidas pela presente Convenção ficam sujeitas:
a) À legislação o norueguesa, se residirem ou estiverem ocupadas na Noruega;
b) À legislação portuguesa, se residirem ou estiverem ocupadas em Portugal.
ARTIGO 8.º
1 - Quando um trabalhador ocupado no território de uma Parte Contratante for destacado pela entidade patronal para o território da outra Parte Contratante a fim de exercer actividade por conta da mesma entidade patronal, a legislação da primeira Parte Contratante continuará a ser-lhe aplicada, como se nela estivesse ocupado, durante os primeiros doze meses da sua estada no território da outra Parte Contratante. No caso de essa actividade prosseguir para além de doze meses, a legislação da primeira Parte Contratante pode continuar a ser-lhe aplicada, desde que a autoridade competente da última Parte Contratante ou o organismo por ela designado dê o seu consentimento. É aplicável esta norma a todos os trabalhadores independentemente da sua nacionalidade. É igualmente aplicável ao cônjuge e descendentes que acompanhem o trabalhador para o território da outra Parte Contratante, a não ser que eles próprios sejam trabalhadores.
2 - Ao pessoal ambulante ocupado em empresas de transporte ferroviário ou rodoviário que exerça e sua actividade nos territórios de ambas as Partes Contratantes será aplicada a legislação da Parte Contratante em que a empresa tem a sede, salvo se residir no território da outra Parte Contratante.
3 - A uma pessoa que trabalhe como tripulante de uma aeronave pertencente a uma companhia que opere no território de qualquer das Partes Contratantes será aplicada a legislação da Parte Contratante onde a companhia tem a sede, a não ser que seja nacional da outra Parte Contratante e residente no território dessa Parte. A outras categorias de pessoal que estejam ao serviço da mesma companhia será aplicada a legislação da Parte Contratante onde a companhia tem a sede no caso de a pessoa em questão ser enviada ao território da outra Parte Contratante para aí exercer um trabalho temporário.
4 - As disposições dos artigos 13.º a 15.º serão, todavia, aplicadas às pessoas referidas nos n.os 1 a 3 deste artigo.
ARTIGO 9.º
1 - Quando uma pessoa trabalhar como tripulante de um navio que arvore a bandeira de uma das Partes Contratantes, ser-lhe-á aplicada a legislação dessa Parte, considerando-se preenchidas as condições relativas a residência desde que seja residente no território de qualquer das Partes Contratantes.
2 - A legislação norueguesa será aplicada relativamente às pessoas que estejam ocupadas em instalações de prospecção ou exploração de depósitos naturais na plataforma continental norueguesa. Igualmente será aplicável em relação às pessoas que estejam ocupadas em instalações norueguesas sobre plataformas continentais não norueguesas, desde que tal seja permitido nos termos de um acordo específico com o Estado costeiro interessado ou ao abrigo do direito internacional. Aplicar-se-á, contudo, o disposto no n.º 1 do artigo 8.º, se a tanto houver lugar.
ARTIGO 10.º
1 - A presente Convenção não será aplicável aos membros permanentes do serviço diplomático de qualquer das Partes Contratantes.
2 - Com ressalva do disposto no n.º 1 deste artigo, as pessoas empregadas em missões diplomáticas ou postos consulares como pessoal administrativo e técnico ou pessoal doméstico e outros membros do pessoal de serviço ficarão sujeitos à legislação do Estado acreditador.
3 - Contudo, as pessoas abrangidas pelo n.º 2 deste artigo que sejam nacionais da Parte Contratante representada pela missão ou posto consular interessados podem optar por ficar sujeitas à legislação dessa Parte; tal direito de opção apenas pode ser exercido uma vez. Será exercido dentro de um prazo de seis meses, a contar da data da entrada em vigor da presente Convenção ou da data do início do emprego do trabalhador. A opção terá efeitos a partir da data da entrada em vigor da Convenção, no que respeita a trabalhadores que já se encontravam ao serviço nessa data, e, nos outros casos, desde a data do início do emprego.
4 - A missão diplomática ou posto consular que, de acordo com os precedentes n.os 2 e 3, empregue pessoas que estejam seguradas ao abrigo da legislação do Estado acreditador observará as obrigações que as disposições de segurança social do Estado acreditador impõem às entidades patronais.
5 - As disposições deste artigo não serão aplicáveis aos membros honorários de um posto consular ou a pessoas empregadas ao serviço destes.
ARTIGO 11.º
As autoridades competentes podem acordar, a pedido conjunto da entidade patronal e do trabalhador ou a pedido de um trabalhador por conta própria, em isentar certas pessoas ou grupos de pessoas da aplicação das disposições dos artigos 7.º a 10.º Independentemente do pedido, as autoridades competentes podem acordar nesta isenção, depois de ouvidas as pessoas interessadas.
PARTE III
Disposições especiais
Doença, maternidade e parto
ARTIGO 12.º
Se uma pessoa tiver cumprido períodos de seguro ao abrigo da legislação de ambas as Partes Contratantes, tais períodos serão totalizados para a aquisição do direito a prestações, desde que se não sobreponham.
ARTIGO 13.º
1 - Uma pessoa que resida no território de uma das Partes Contratantes e que tenha direito a prestações médicas ao abrigo da legislação dessa Parte Contratante receberá prestações médicas durante uma estada temporária no território da outra Parte, se tiver necessidade imediata de tais prestações.
2 - Não se aplicará, porém, o disposto no número anterior aos casos em que a pessoa se desloque ao território da outra Parte com a intenção específica de obter prestações médicas.
3 - As prestações são concedidas pela instituição de seguro do lugar de residência temporária do beneficiário, nos termos da legislação da referida Parte, e a cargo da mesma instituição.
ARTIGO 14.º
Aos familiares de pessoas que residam no território de uma das Partes Contratantes e que estejam seguradas ao abrigo da legislação desta Parte, se residirem no território da outra Parte Contratante, são-lhes concedidas prestações médicas, nos termos da legislação aplicável, pela instituição de seguro do seu lugar de residência e a cargo dessa mesma instituição.
ARTIGO 15.º
1 - O titular de uma pensão ao abrigo da legislação de ambas as Partes Contratantes ou da legislação de uma delas tem direito a prestações médicas para si próprio e para os seus familiares, nos termos da legislação da Parte Contratante em cujo território reside.
2 - As prestações serão concedidas pela instituição de seguro do lugar de residência e a cargo desta instituição.
Velhice, invalidez e sobrevivência
Artigos 16.º a 22.º: aplicação da legislação norueguesa
ARTIGO 16.º
1 - Para efeitos de aquisição do direito a pensões de velhice, invalidez e sobrevivência, incluindo as prestações suplementares, ao abrigo da legislação norueguesa, os períodos de seguro portugueses serão totalizados com os períodos de seguro noruegueses, desde que o período norueguês não seja inferior a um ano e os períodos não se sobreponham.
2 - Para efeitos de aquisição do direito à pensão suplementar norueguesa, devem ter sido creditados pontos de pensão relativamente a um período não inferior a um ano.
ARTIGO 17.º
Quando houver direito a uma pensão de velhice, invalidez ou sobrevivência sem ser por aplicação do artigo 16.º, a instituição de seguro determina o montante da prestação que corresponde aos períodos de seguro cumpridos em conformidade com a legislação norueguesa.
ARTIGO 18.º
Quando uma pessoa preenche as condições exigidas pela legislação norueguesa para ter direito a uma pensão de velhice, invalidez ou sobrevivência apenas mediante a totalização prevista no artigo 16.º, a instituição de seguro calculará o montante da prestação a que o beneficiário tem direito exclusivamente com base nos períodos de seguro noruegueses.
ARTIGO 19.º
Os nacionais portugueses usufruem dos mesmos direitos que os nacionais noruegueses no que respeita à tomada em consideração como períodos de seguro de períodos anteriores à entrada em vigor da Lei do Seguro Nacional de 1967.
ARTIGO 20.º
No que diz respeito aos nacionais portugueses, a pensão suplementar será calculada em conformidade com as disposições referentes à sobrecompensação (over-compensation) relativamente às pessoas seguradas que não sejam nacionais noruegueses e refugiados estrangeiros.
ARTIGO 21.º
1 - Os nacionais portugueses, bem como os nacionais noruegueses, apenas têm direito ao suplemento de compensação (compensation supplement) enquanto residirem na Noruega.
2 - O suplemento de base (basic benefit) e o suplemento a grandes inválidos (attendance benefit) serão pagos aos nacionais portugueses residentes fora da Noruega nas mesmas condições em que são pagos aos nacionais noruegueses.
ARTIGO 22.º
O direito à pensão de sobrevivência não será afectado pelo facto de o sobrevivente residir em Portugal na ocasião do falecimento da pessoa segurada.
Artigos 23.º a 27.º: aplicação da legislação portuguesa
ARTIGO 23.º
Os períodos de seguro que tenham sido completados em conformidade com a legislação de ambas as Partes Contratantes serão totalizados, se necessário, para a aquisição do direito às prestações ao abrigo da legislação portuguesa, desde que não se sobreponham.
ARTIGO 24.º
Quando houver direito a uma pensão de velhice, invalidez ou sobrevivência sem ser por aplicação do artigo 23.º, a instituição competente portuguesa determina directa e exclusivamente, em conformidade com a sua própria legislação, o montante da prestação que corresponde aos períodos de seguro a tomar em conta nos termos da mesma legislação.
ARTIGO 25.º
Quando uma pessoa preencha as condições exigidas pela legislação portuguesa para ter direito a uma pensão de velhice, invalidez ou sobrevivência apenas mediante a totalização prevista no artigo 23.º, a instituição portuguesa competente calcula o montante da prestação a que o beneficiário tem direito exclusivamente com base nos períodos de seguro cumpridos nos termos da legislação portuguesa aplicável.
ARTIGO 26.º
Quando a soma das prestações concedidas pelas instituições competentes de ambas as Partes Contratantes for inferior ao montante mínimo estabelecido pela legislação portuguesa, a pessoa interessada que resida em Portugal tem direito a um complemento igual a essa diferença, que será suportado pela instituição competente portuguesa.
ARTIGO 27.º
O direito à pensão de sobrevivência não será afectado pelo facto de o sobrevivente residir na Noruega na ocasião do falecimento da pessoa segurada.
Abono de família
ARTIGO 28.º
Os nacionais de uma das Partes Contratantes que estejam ocupados ou residam no território da outra Parte Contratante têm direito ao abono de família em relação aos descendentes que residam no território da última Parte Contratante em conformidade com a legislação aplicável aos nacionais dessa Parte Contratante.
Prestações de desemprego
ARTIGO 29.º
Os nacionais de uma Parte Contratante que se encontrem ou residam no território da outra Parte Contratante têm direito a prestações de desemprego em conformidade com as normas aplicáveis aos nacionais da mesma Parte Contratante.
Prestações por morte
ARTIGO 30.º
1 - Os nacionais de uma Parte Contratante residentes no território da outra Parte Contratante terão direito a prestações por morte em conformidade com as normas aplicáveis aos nacionais da última Parte Contratante. Estas prestações serão concedidas mesmo que o falecimento da pessoa em causa ocorra no território de uma Parte Contratante que não seja o da residência.
2 - Quando houver direito a prestações por morte, ao abrigo da legislação de ambas as Partes Contratantes, em relação ao mesmo falecimento, quer por aplicação da presente Convenção quer por outro motivo:
a) A prestação deverá ser paga apenas ao abrigo da legislação da Parte em cujo território ocorrer o falecimento; ou
b) No caso de o falecimento ocorrer fora do território de qualquer das Partes, a prestação será paga apenas nos termos da legislação da Parte ao abrigo de cuja legislação a pessoa em causa estivesse segurada pela última vez antes do seu falecimento.
Acidentes de trabalho e doenças profissionais
ARTIGO 31.º
1 - O direito a prestações derivado de um acidente de trabalho será determinado em conformidade com a legislação aplicável ao beneficiário por ocasião do acidente.
2 - A indemnização por um novo acidente de trabalho será estabelecida tendo em conta a redução da capacidade de trabalho e a perda de faculdades físicas e mentais provocadas pelo novo acidente e em conformidade com a legislação da Parte Contratante em cujo território ocorreu o novo acidente.
3 - Se uma doença profissional se manifestar depois de o segurado ter estado ocupado no território de ambas as Partes Contratantes em emprego sujeito ao risco da mesma doença, será responsável pelo pagamento das prestações o sistema de seguro da Parte Contratante em que essa ocupação foi exercida pela última vez.
4 - Se por essa doença profissional forem devidas prestações ao abrigo do regime de seguro de uma Parte Contratante, qualquer agravamento que ocorra no território da outra Parte será também coberto pelo sistema de seguro da primeira Parte Contratante, desde que o agravamento não possa ser atribuído ao emprego no território da última Parte Contratante em ocupação susceptível de provocar a mesma doença.
PARTE IV
Disposições diversas e finais
Disposições diversas
ARTIGO 32.º
As autoridades competentes de ambas as Parte Contratantes ou as autoridades por elas designadas concluirão um acordo relativo às disposições necessárias à aplicação da presente Convenção e designarão os organismos de ligação de cada Parte Contratante, a fim de facilitar a aplicação da Convenção. Comunicar-se-ão reciprocamente todas as alterações mais importantes das suas leis e regulamentos.
ARTIGO 33.º
1 - As autoridades e instituições competentes de ambas as Partes Contratantes auxiliar-se-ão mutuamente na aplicação da presente Convenção, tal como se se tratasse de aplicar a sua própria legislação. Este auxílio será prestado gratuitamente.
2 - As autoridades e instituições de ambas as Partes Contratantes podem corresponder-se directamente entre si e com as pessoas interessadas. Podem também, se necessário, dirigir-se às autoridades da outra Parte Contratante através das vias diplomáticas e consulares dessa Parte Contratante.
3 - As autoridades diplomáticas e consulares podem solicitar directamente das autoridades e instituições da outra Parte Contratante todas as informações necessárias para assegurar os interesses dos seus nacionais, a quem podem representar sem qualquer procuração especial.
4 - Os requerimentos apresentados à autoridade ou instituição competente de qualquer das Partes Contratantes relativos à aplicação da presente Convenção serão tidos em consideração mesmo quando redigidos na língua oficial da outra Parte Contratante.
5 - A correspondência entre autoridades e pessoas individuais será formulada em língua inglesa.
ARTIGO 34.º
As isenções de taxas e de outros impostos legais relativos a documentos e certificados que se destinem a ser apresentados às autoridades e instituições de qualquer das Partes Contratantes serão aplicáveis aos documentos e certificados que devam ser apresentados às autoridades ou instituições competentes da outra Parte Contratante para efeitos de aplicação da presente Convenção.
Os documentos e certificados que se destinam a ser apresentados para efeitos de aplicação da presente Convenção serão isentos de legalização ou autenticação pelas autoridades diplomáticas e consulares.
ARTIGO 35.º
Os requerimentos, informações ou recursos que, de acordo com a legislação de uma Parte Contratante, devam ser apresentados a uma autoridade dessa Parte Contratante dentro de um prazo estabelecido e que tenham sido apresentados à correspondente autoridade da outra Parte Contratante dentro do mesmo prazo serão considerados como tendo sido apresentados em devido tempo à autoridade da primeira Parte Contratante. As autoridades interessadas da outra Parte Contratante transmitirão sem demora o requerimento, informação ou recurso às autoridades competentes da primeira Parte Contratante.
ARTIGO 36.º
1 - Os pagamentos a efectuar em conformidade com a presente Convenção podem ser feitos validamente na moeda da Parte Contratante que efectua o pagamento.
2 - No caso de serem adoptadas limitações cambiais em qualquer dos Estados, ambas as Partes Contratantes acordarão de imediato as medidas necessárias para assegurar a transferência entre as Partes Contratantes das importâncias a pagar em cumprimento da presente Convenção.
3 - O modo de pagamento de pensões devidas a pessoas que se encontrem no território da outra Parte Contratante será estabelecido por acordo, como se prevê no artigo 32.º
ARTIGO 37.º
1 - As autoridades competentes de qualquer das Partes Contratantes diligenciarão resolver através de negociação quaisquer conflitos relativos à interpretação e aplicação da presente Convenção.
2 - No caso de não se haver chegado a acordo por via de negociações dentro do prazo de três meses, o conflito será submetido à arbitragem de um tribunal, cuja composição e normas de procedimento serão fixadas por acordo entre as Partes Contratantes.
ARTIGO 38.º
1 - Quando uma instituição de seguro no território de uma das Partes Contratantes tiver efectuado um pagamento adiantado, poderá ser retida uma quantia devida, nos termos da legislação da outra Parte Contratante, relativamente ao mesmo período a que se reporta o pagamento adiantado.
Quando uma instituição de seguro de uma das Partes Contratantes tiver efectuado um pagamento em excesso de uma prestação referente a um período em relação ao qual uma instituição de seguro da outra Parte Contratante deve pagar uma soma de montante correspondente, pode igualmente ser retida uma importância equivalente ao pagamento em excesso.
2 - Os pagamentos adiantados ou em excesso serão deduzidos das prestações referentes ao mesmo período e pagas posteriormente. Se não houver pagamento posterior ou o mesmo não for suficiente para a compensação pretendida, a compensação total ou a dedução relativa à quantia restante pode ser efectuada nos pagamentos de prestações correntes, em conformidade, porém, com as modalidades e dentro dos limites estabelecidos pela legislação da Parte Contratante que procede à compensação.
Disposições transitórias e finais
ARTIGO 39.º
1 - A presente Convenção aplicar-se-á também a eventos ocorridos antes da sua entrada em vigor. Contudo, não podem ser pagas prestações ao abrigo da Convenção relativamente a quaisquer períodos anteriores à sua entrada em vigor, embora os períodos de seguro ou de residência cumpridos antes daquela entrada em vigor devam ser tidos em conta para a determinação das prestações.
2 - As prestações que não tenham sido concedidas em virtude da nacionalidade do interessado ou que tenham sido suspensas por motivo da sua residência no território da outra Parte Contratante serão concedidas ou retomadas com efeitos a partir da data da entrada em vigor desta Convenção.
3 - As prestações concedidas antes da entrada em vigor da presente Convenção serão, a requerimento do interessado, calculadas de novo, em conformidade com o disposto neste diploma. Tais prestações podem também ser novamente calculadas, independentemente de qualquer requerimento. Deste novo cálculo não pode resultar diminuição da prestação paga.
4 - As normas das legislações das Partes Contratantes relativas à prescrição e extinção do direito às prestações não se aplicarão a direitos atribuídos em função do disposto nos n.os 1 a 3 deste artigo, desde que o beneficiário apresente o requerimento da prestação dentro do prazo de dois anos após a data da entrada em vigor desta Convenção.
ARTIGO 40.º
1 - A presente Convenção manter-se-á em vigor por um período de doze meses, a partir da data da sua entrada em vigor. Posteriormente, continuará em vigor por sucessivos períodos de um ano, salvo se for denunciada, por escrito, pelo Governo de qualquer das Partes Contratantes, o que será feito pelo menos três meses antes do termo de cada período de um ano. No caso de a Convenção ser denunciada, a sua vigência cessará no fim do período de um ano, a contar da apresentação da denúncia.
2 - No caso de denúncia, as disposições da presente Convenção continuarão a aplicar-se a direitos adquiridos sem se considerarem as disposições estabelecidas pela legislação nacional de qualquer dos países sobre restrições ao direito a prestações por motivo da nacionalidade ou da residência noutro país.
3 - No que se refere aos direitos adquiridos com base num período de seguro e num período de residência que tenham sido cumpridos antes do termo de vigência da presente Convenção, continuarão a ser aplicáveis as suas disposições, em conformidade com as normas a estabelecer por um acordo especial.
ARTIGO 41.º
A presente Convenção será ratificada e os instrumentos de ratificação serão trocados, logo que possível, em Oslo.
A Convenção entrará em vigor no primeiro dia do segundo mês subsequente ao da troca dos instrumentos de ratificação.

PROTOCOLO
Os signatários da Convenção sobre Segurança Social, concluída nesta data, entre a República de Portugal e o Reino da Noruega acordaram em que o presente Protocolo constituía parte integrante da Convenção.
1 - No que se refere à Noruega, as disposições do artigo 13.º não serão aplicadas a nacionais portugueses ou noruegueses residentes em Portugal durante uma estada temporária em Svalbard, Jan Mayen ou nas dependências norueguesas.
2 - No que se refere à Noruega, acordou-se em que os nacionais portugueses que prestam serviço a bordo de navios noruegueses em comércio externo ficam sujeitos à legislação norueguesa, relativamente a prestações de desemprego, apenas quando residam permanentemente na Noruega, Dinamarca, Finlândia, Islândia e Suécia. Em tal caso, a pessoa interessada tem direito a essas prestações, mesmo que se encontre fora da Noruega, em conformidade com as mesmas normas que são aplicáveis aos nacionais desse país.
3 - As Partes Contratantes acordaram em que o disposto no artigo 12.º não se aplicará aos benefícios concedidos nos termos do capítulo 12.º da lei norueguesa relativa ao seguro nacional.

CONVENTION ON SOCIAL SECURITY BETWEEN THE REPUBLIC OF PORTUGAL AND THE KINGDOM OF NORWAY
The Republic of Portugal and the Kingdom of Norway, desirous to regulate the relations between the two States in the field of social security, have agreed to conclude the following convention:
PART I
General provisions
ARTICLE 1
1 - This Convention shall apply to the Republic of Portugal and the Kingdom of Norway. It shall also apply to the Norwegian continental shelf.
2 - For the purpose of the present Convention, unless the context otherwise requires:
a) «Territory» means in relation to Norway the territory of the Kingdom of Norway, and in relation to the Republic of Portugal its national territory;
b) «Legislation» means the laws and regulations as specified in article 2;
c) «Competent authority» means in relation to Norway: the Ministry of Social Affairs and, as regards unemployment benefits, the Ministry of Local Government and Labour, and in relation to Portugal: the Ministry of Social Affairs;
d) «Insurance institution» means the competent body or authority responsible for the implementation of the legislation specified in article 2;
e) «Liaison body» means an institution for liaison and information between the insurance institutions of the two Contracting Parties with a view to simplifying the implementation of this Convention and for the information of the persons affected concerning their rights and obligations under the Convention;
f) «Periods of insurance» means contribution periods, periods of employment or other periods recognized as periods of insurance by the legislation under which they were completed, including years for which pension points have been credited under the Norwegian national insurance scheme for purposes of supplementary pension on the basis of employment or other economic activity during the year in question or a portion thereof;
g) The term «pension» includes any increase of or any additional amount payable with a pension;
h) «Insured person» means a person insured in accordance with the legislations specified in article 2;
i) The terms «family members» and «survivors» mean any person defined or recognized as such by the legislation under which the benefits are granted;
j) «Supplementary benefits» means in relation to Norway, supporter's supplement for spouse and children, compensation benefit and special supllement;
k) «Death grant» means lump sum benefits granted in connection with death for covering funeral and other expenses.
3 - Other words and expressions which are used in this Convention shall have the meaning respectively assigned to them in the legislation concerned.
ARTICLE 2
1 - This Convention shall apply:
A) In relation to Norway, to the followying legislation:
a) The Act of 17 June 1966 concerning national insurance;
b) The Act of 19 June 1969 concerning special supplements to benefits under the national insurance;
c) The Act of 19 December 1969 on compensation supplement under the national insurance;
d) The Act of 24 October 1946 concerning family allowance;
B) In relation to Portugal, to the legislation concerning:
a) The social welfare and family allowance general scheme in reference to sickness, maternity, disablement, old age, survivors, family allowance and complementary benefits;
b) The social welfare and family allowance special schemes, concerning the branches referred to in the letter a) of this paragraph;
c) Social pension;
d) Work injury and professional diseases;
e) Unemployment benefits.
2 - This Convention shall apply to all laws and regulations codifying, emending or supplementing the legislation specified in paragraph 1 of this article.
3 - The present Convention shall apply to:
a) All laws and regulations instituting a new branch of social security, only if the Contracting Parties so agree;
b) All laws and regulations extending the existing insurance schemes to new categories of persons, unless the Contracting Party concerned gives notice to the other Party within six months after the official promulgation of such law or regulation, to the effect that the present Convention shall not apply to such law or regulation.
4 - The persons covered by this Convention cannot under this Convention invoke any rights with regard to social security conventions which the Contracting Parties have concluded or may conclude with any third State.
ARTICLE 3
1 - This Convention shall apply to nationals of the Contracting Parties as well as to their family members deriving their rights from nationals, save as otherwise provided in article 8, paragraph 1.
2 - It shall also apply to refugees and stateless persons as referred to in the Convention of 28 July 1951 Relating to the Status of Refugees and the Protocol of 31 January 1967 to the said Convention, as well as the Convention of 28 September 1954 Relating to the Status of Stateless Persons.
ARTICLE 4
Save as otherwise provided in this Convention persons mentioned in article 3 above shall, when they are in the territory of a Contracting Party, be subject to the same obligations and entitled to enjoy the same advantages under the same conditions as nationals of that Contracting Party in the implementation of the legislation of the Contracting Party.
ARTICLE 5
Save as otherwise provided in this Convention, old age pensions, disability pensions, survivors pensions, pensions in respect of occupational injuries and diseases and death grants may not be reduced, modified, suspended or withdrawn on account of the recipient residing in the territory of the other Contracting Party.
ARTICLE 6
Benefits as mentioned in article 5 payable by one of the Contracting Parties shall be paid to nationals of the other Contracting Party, who are resident in a third State, on the same terms and to the same extent as to nationals of the first Contracting Party resident in this third State.
PART II
Provisions concerning applicable legislation
ARTICLE 7
1 - Save as otherwise provided in articles 8, 9 and 10, the persons covered by this Convention shall be subject to:
a) Norwegian legislation if they are resident or occupied in Norway;
b) Portuguese legislation if they are resident or occupied in Portugal.
ARTICLE 8
1 - Where an employee who is employed in the territory of a Contracting Party is posted by his employer to the territory of the other Contracting Party to perform work on behalf of the same employer, the legislation of the former Contracting Party shall continue to apply to him as if he were employed there during the first twelve months of his stay in the territory of the other Contracting Party. If such employment continues beyond the period of twelve months, the legislation of the former Contracting Party may continue to apply to him, provided that the competent authority in the latter Contracting Party, or the body designated by it, gives its consent. This shall apply to all employees irrespective of nationality. It shall equally apply to spouses and children accompanying the employee to the territory of the other Contracting Party, unless they are themselves employed.
2 - Where travelling personnel in undertakings of railway or road transport work in the territories of both Contracting Parties, the legislation of the Contracting Party in which the undertaking has its principal place of business shall apply, unless he is resident in the territory of the other Contracting Party.
3 - Where a person is employed as crew-member of aircraft belonging to a company operating in the territory of either Contracting Party, the legislation of the Contracting Party in which the company has its principal place of business shall apply to him unless he is a national of and resident in the territory of the other Contracting Party. Where other categories of personnel are employed by such company the legislation of the Contracting Party in which the company has its principal place of business shall apply in cases where the person concerned has been sent to the territory of the other Contracting Party for temporary employment there.
4 - The provisions in articles 13-15 shall, however, apply to the persons mentioned under paragraphs 1-3 in this article.
ARTICLE 9
1 - Where a person is employed as member of the crew of a vessel flying the flag of one of the Contracting Parties, the legislation of that Party shall apply to him as if any conditions relating to residence were satisfied in his case, provided that he is resident in the territory of either Contracting Party.
2 - For persons who are occupied on installations for exploitation of and exploration for natural deposits on the Norwegian continental shelf, norwegian legislation shall apply. The same shall apply for persons who are occupied on Norwegian installations on non-Norwegian continental shelves provided this is permissible in pursuance of a specific agreement with the coastal State concerned or by virtue of international law otherwise. Article 8, paragraph 1, shall, however, be applied correspondingly.
ARTICLE 10
1 - This Convention shall not apply to established members of the diplomatic service of either Contracting Party.
2 - Subject to the provision of paragraph 1 of this article, persons employed in diplomatic missions or consular posts as administrative and technical staff, private servants and other members of the service staff shall be subject to the legislation of the receiving State.
3 - However, persons covered by paragraph 2 of this article who are nationals of the Contracting Party represented by the mission or consular post concerned may opt to be subject to the legislation of that Party; such right of option may be exercised once only. It shall be exercised within a period of six months from the date of entry into force of this Convention or from date of entry of the worker into employment. The option shall take effect from the date of entry into force of this Convention in respect of workers who have entered into employment at the said date and, in other cases, from the date of entry into employment.
4 - A diplomatic mission or consular post who employ persons who according to paragraphs 2 and 3 above are insured under the legislation of the receiving State shall observe the obligation which the social security provisions of the receiving State impose upon employers.
5 - The provisions of this article shall not apply to honorary members of a consular post or to persons employed in their service.
ARTICLE 11
At mutual request of employer and employee or at the request of a self-employed person, the competent authorities may agree on the exemption of certain persons or groups of persons from the provisions of articles 7-10. Even without such request, the competent authorities may agree on such exemption after consulting the persons concerned.
PART III
Special provisions
Sickness, maternity and childbirth
ARTICLE 12
If any person has completed periods of insurance according to the legislation of both Contracting Parties, these periods shall be added together for the acquisition of rights to a benefit, insofar as they do not coincide.
ARTICLE 13
1 - A person who is resident in the territory of one Contracting Party and entitled under the legislation of that Contracting Party to medical benefits shall during a temporary stay in the territory of the other Party receive medical benefits if he is in immediate need of such benefits.
2 - However, this shall not apply in cases where a person goes to the territory of the other Party for the specific purpose of obtaining medical benefits.
3 - Benefits are provided by the insurance institution in the beneficiary's place of temporary residence according to the legislation of that Party, and at the expense of that institution.
ARTICLE 14
Members of the families of persons resident in the territory of a Contracting Party and insured under its legislation shall, if resident in the territory of the other Contracting Party, receive medical benefits in accordance with the legislation applicable by the insurance institution in their place of residence and at the expense of that institution.
ARTICLE 15
1 - A person receiving a pension under the legislation of both Contracting Parties or under the legislation of one of them is entitled to medical benefits for himself and for members of his family in accordance with the legislation of the Contracting Party in whose territory they are resident.
2 - The benefits shall be provided by the insurance institution of the place of residence and at the expense of that institution.
Old age, disability and survivors
Articles 16-22: application of Norwegian legislation
ARTICLE 16
1 - In order to become entitled to old age, disability and survivors' pensions, including supplementary benefits, under the Norwegian legislation, Portuguese periods of insurance shall be added together with Norwegian insurance periods, provided that the Norwegian period is at least one year, and the periods do not coincide.
2 - To become entitled to Norwegian supplementary pension, pension points for at least one year must have been awarded.
ARTICLE 17
If entitlement to old age, disability or survivors' pension exists without applying article 16, the insurance institution determines the amount of the benefit which corresponds to the insurance periods fulfilled in accordance with Norwegian legislation.
ARTICLE 18
When a person satisfies the conditions required by the Norwegian legislation to be entitled to old age, disability or survivors' pensions only by means of the totalisation foreseen in article 16, the insurance institution computes the amount of the benefit to which the beneficiary is entitled exclusively on the basis of Norwegian insurance periods.
ARTICLE 19
Portuguese nationals shall enjoy the same rights as Norwegian nationals as regards taking into consideration as insurance periods any period preceding the entry into force of the National Insurance Act in 1967.
ARTICLE 20
Supplementary pension shall in respect of Portuguese nationals be computed in accordance with the provisions concerning over-compensation for insured persons other than Norwegian nationals and foreign refugees.
ARTICLE 21
1 - Portuguese nationals as well as Norwegian nationals are only entitled to compensation supplement as long as they are resident in Norway.
2 - Basic benefit and attendance benefit shall be paid to Portuguese nationals resident outside Norway on the same conditions as to Norwegian nationals.
ARTICLE 22
The entitlement to survivors' pension shall not be affected by the survivor being resident in Portugal at the time of the death of the insured person.
Articles 23-27: application of Portuguese legislation
ARTICLE 23
Where periods of insurance have been completed in accordance with the legislation of both the Contracting Parties, the periods shall be added together if necessary for the acquisition of the right to benefits under Portuguese legislation, insofar as they do not coincide.
ARTICLE 24
If entitlement to old age, disability or survivors' pension exist without applying article 23, the competent Portuguese institution determines directly and exclusively, in accordance with its own legislation, the amount of the benefit which corresponds to the insurance periods to be considered in accordance with the same legislation.
ARTICLE 25
When a person satisfies the conditions required by the Portuguese legislation to be entitled to old age, disability or survivors' pension only by means of the totalisation foreseen in article 23, the competent Portuguese institution computes the amount of the benefit to which the beneficiary is entitled exclusively on the basis of insurance periods completed in accordance with the applicable Portuguese legislation.
ARTICLE 26
If the total of the benefit granted by the competent institutions of both Contracting Parties is less than the minimum amount fixed by the Portuguese legislation, the person concerned who has his residence in Portugal is entitled to a complement equal to that difference, at the cost of the competent Portuguese institution.
ARTICLE 27
The entitlement to survivors' pension shall not be affected by the survivor being resident in Norway at the time of death of the insured person.
Family allowance
ARTICLE 28
Nationals of one Contracting Party who are working or residing in the territory of the other Contracting Party are entitled to family allowance in respect of children resident in the territory of the latter Contracting Party in accordance with the same rules as for nationals of that Contracting Party.
Unemployment benefit
ARTICLE 29
Nationals of one Contracting Party who are stay-grants shall be provided even if the person contracting Party are entitled to unemployment benefit in accordance with the same rules as for nationals of that Contracting Party.
Death grant
ARTICLE 30
1 - Nationals of one Contracting Party residing in the territory of the other Contracting Party shall be entitled to death grant according to the same rules as for nationals of the latter Contracting Party. These grants shall be provided even if the person concerned dies in the territory of a Contracting Party other where he was resident.
2 - Where there could be entitlement to death grant under the legislation of both Contracting Parties in respect of the same death whether by virtue of this Convention or otherwise:
a) The grant shall be payable only under the legislation of the Party in whose territory the death occurs; or
b) If the death does not occur in the territory of either Party, a grant shall be paid only under the legislation of the Party under whose legislation the person concerned was last insured before his death.
Occupational injury and disease
ARTICLE 31
1 - The right to benefits in connection with an accident at work shall be determined according to the legislation applying to the beneficiary at the time of the accident.
2 - Compensation for a new accident at work shall be established according to the reduction of work capacity and loss of physical and mental faculty which has been caused by the new accident and in accordance with the legislation of the Contracting Party in whose territory the new accident occurs.
3 - If an occupational disease becomes apparent after the insured person having been employed in the territories of both Contracting Parties in employment entailing risks of the same disease, the insurance scheme of the Contracting Party in which such work has been latest performed shall be liable to pay benefit.
4 - If such occupational disease entitles to benefit from the insurance scheme of one Contracting Party, the insurance scheme of this Contracting Party shall also cover any aggravation which takes place in the territory of the other Contracting Party, provided that the aggravation cannot be referred to employment in the territory of the latter Contracting Party in an occupation entailing risks of such disease.
PART IV
Miscellaneous provisions and final provisions
Miscellaneous provisions
ARTICLE 32
The competent authorities of both Contracting Parties or authorities designated by such competent authority shall conclude an agreement concerning the necessary provisions for the implementation of the present Convention, and appoint liaison bodies in each Contracting Party in order to facilitate the application of the present Convention. They shall communicate with each other concerning all major amendments of their laws and regulations.
ARTICLE 33
1 - In the application of the present Convention the competent authorities and institutions of the Contracting Parties shall assist each other to the same extent as when applying their own legislation. Such assistance shall be free of charge.
2 - The authorities and institutions of both Contracting Parties may correspond directly with each other and with the persons concerned. They may also if need arises address themselves to the authorities of the other Contracting Party through the diplomatic and consular channels of that Contracting Party.
3 - Diplomatic and consular authorities may address themselves directly to authorities and institutions of the other Contracting Party in order to collect all information necessary for maintaining the interests of their nationals, whom they may represent without any special power of attorney.
4 - Applications submitted to the competent authority or institution of either Contracting Party in connection with the application of the present Convention shall be dealt with even if worded in the official language of the other Contracting Party.
5 - Correspondence between authorities and individual persons shall be conducted in English.
ARTICLE 34
Any exemption from taxes and other legal dues on documents and certificates which are to be submitted to the authorities and institutions of either Contracting Party shall apply to documents and certificates to be submitted to the competent authorities or institutions of the other Contracting Party in connection with the application of the present Convention. Documents and certificates which are to be submitted in connection with the application of the present Convention shall be exempt from legalisation or authentication by diplomatic or consular authorities.
ARTICLE 35
Any claims, notices or appeals which according to the legislation of one Contracting Party shall be submitted to an authority of that Contracting Party within a prescribed period and which has been submitted to the corresponding authority of the other Contracting Party within the same period shall be considered as having been submitted in due time to the authority of the former Contracting Party. The authorities concerned of the other Contracting Party shall without delay transmit the claim, notice or appeal to the competent authorities of the former Contracting Party.
ARTICLE 36
1 - Payments payable pursuant to the present Convention may validly be made in the currency of the Contracting Party effecting the payment.
2 - In the event restrictions on currency being enforced in either State, both Contracting Parties shall immediately agree upon necessary measures for ensuring the transfer between the Contracting Parties of any sum payable pursuant to the present Convention.
3 - The manner of payment in respect of pensions payable to persons in the territory of the other Contracting Party shall be fixed by agreement as specified in article 32.
ARTICLE 37
1 - The competent authorities of either Contracting Party shall endeavour to resolve through negotiations any disputes arising in conection with the interpretation and application of the present Convention.
2 - In the event of no agreement being reached within three months through negotiations, the dispute shall be submitted to arbitration by a tribunal whose composition and rules of procedure shall be fixed by agreement between the Contracting Parties.
ARTICLE 38
1 - If an insurance institution in the territory of one of the Contracting Parties has made an advance payment, an amount accruing for the same period as the advance payment according to the legislation of the other Contracting Party may be withheld.
If an insurance institution of one of the Contracting Parties has paid an excessive rate of benefit for a period for which an insurance institution of the other Contracting Party is to pay a corresponding amount of compensation, the excess payment may similarly be withheld.
2 - The advance payment or the excess amount shall be deducted from compensation referring to the same period and paid subsequently. If there is no such subsequent payment, or if the payment is not sufficient for the clearance required, full clearance or deduction for the remaining amount can be made from current benefit payments, though in the manner and subject to the restrictions laid down by the legislation of the Contracting Party which is to perform the clearence.
Transitional and final provisions
ARTICLE 39
1 - This Convention shall also apply to contingencies arising prior to its entry into force. However, no benefits shall be payable under this Convention with respect to any period prior to its entry into force, though periods of insurance or residence completed before the said entry into force shall be taken into account in the determination of benefits.
2 - Any benefit which has not been awarded on account of the nationality of the person concerned or which has been withdrawn on account of his residence in the territory of the other Contracting Party shall be awarded or resumed with effect from the date of entry into force of this Convention.
3 - Upon application being received, a benefit granted prior to the entry into force of this Convention shall be recalculated in compliance with the provisions of the same. Such benefits may also be recalculated without any application being made. This recalculation may not result in any reduction of the benefit paid.
4 - Provisions in the laws of the Contracting Parties concerning prescription and the termination of the right to benefit shall not apply to rights arising out of the provisions of paragraphs 1-3 of this article, always provided that the beneficiary submits his application for benefit within two years after the date of entry into force of this Convention.
ARTICLE 40
1 - This Convention shall remain in force for a period of twelve months as from the date of its entry into force. Thereafter it shall continue to be in force from year to year unless it is denounced in writing by the Government of any of the Contracting Parties, which shall be done at least three months before the expiry of any one-year period. In the case of such denounciation, the Convention shall cease to be in force at the expiry of the one-year period in which it is denounced.
2 - In the event of denounciation, the provisions of the present Convention shall continue to apply to acquired rights without regard to the provisions concerning restrictions laid down in the national legislation of either country in respect of entitlement to benefits on account of nationality or residence in another country.
3 - For rights which have been acquired on the basis of an insurance period and period of residence having been completed before the expiration of the validity of the present Convention, the provisions thereto shall continue to be applicable pursuant to the reguations to be fixed by a special agreement.
ARTICLE 41
The present Convention shall be ratified and the instruments of ratification shall be exchanged as soon as possible in Oslo. The Convention shall come into force on the first day of the second month following the month in which the instruments of ratification have been exchanged.

PROTOCOL
The signatories of the Convention on Social Security which has been concluded today between the Republic of Portugal and the Kingdom of Norway have agreed that this Protocol shall constitute an integral part of the Convention.
1 - In relation to Norway, the provisions of article 13 shall not apply to Portuguese or Norwegian nationals resident in Portugal during a temporary stay in Svalbard, Jan Mayen or the Norwegian dependencies.
2 - In relation to Norway, it is agreed that any Portuguese nationals who are in service on board Norwegian vessels in foreign trade are subject to Norwegian legislation concerning benefit during unemployment only if they are permanent residents in Norway, Denmark, Finland, Iceland and Sweden. In such case the person concerned is entitled to benefit even when outside Norway according to the same rules as are applicable for nationals of that country.
3 - The Contracting Parties have agreed that the provision of article 12 shall not apply to benefits provided according to chapter 12 of the Norwegian National Insurance Act.
