Decreto n.º 39/77

O Governo decreta, nos termos da alínea c) do artigo 200.º da Constituição, o seguinte:
Artigo único. É aprovado o Acordo de Transporte Aéreo entre o Governo de Portugal e o Governo da República Popular da Bulgária, assinado em Lisboa em 22 de Outubro de 1975, cujos textos em inglês e respectiva tradução para português acompanham o presente decreto.

ACORDO DE TRANSPORTE AÉREO ENTRE O GOVERNO DE PORTUGAL E O GOVERNO DA REPÚBLICA POPULAR DA BULGÁRIA.
O Governo de Portugal e o Governo da República Popular da Bulgária, daqui em diante designados por «Partes Contratantes»,
Sendo partes da Convenção sobre Aviação Civil Internacional, aberta à assinatura em Chicago aos sete dias do mês de Dezembro de 1944,
Confirmando o seu desejo de promover o desenvolvimento da aviação civil internacional através da rigorosa observância dos regulamentos da referida Convenção,
Desejando concluir um Acordo, suplementar a essa Convenção, com o fim de estabelecer serviços aéreos regulares entre os seus respectivos territórios e pontos além,
Acordaram no seguinte:
ARTIGO 1
1. Para os efeitos do presente Acordo e seu Anexo:
a) O termo «a Convenção» significa a Convenção sobre Aviação Civil Internacional, aberta à assinatura em Chicago aos sete dias do mês de Dezembro de 1944, e inclui qualquer Anexo adoptado nos termos do artigo 90.º daquela Convenção e qualquer emenda aos Anexos ou à Convenção nos termos dos artigos 90.º e 94.º, na medida em que aqueles Anexos e emendas tenham entrado em vigor para ambas as Partes Contratantes;
b) O termo «autoridades aeronáuticas» significa:
Para Portugal - o Ministério dos Transportes e Comunicações e qualquer pessoa ou organismo autorizado a exercer qualquer função de responsabilidade do referido Ministério;
Para a República Popular da Bulgária - o Ministério dos Transportes e qualquer pessoa ou organismo autorizado a exercer qualquer função de responsabilidade do referido Ministério;
c) O termo «empresa designada» significa uma empresa de transporte aéreo que tenha sido designada e autorizada de harmonia com o artigo 3 do presente Acordo;
d) O termo «território» em relação a um Estado significa as regiões terrestres e as águas territoriais debaixo da soberania desse Estado;
e) Os termos «serviço aéreo», «serviço aéreo internacional», «empresa» e «escala para fins não comerciais» têm os significados que lhes são atribuídos no artigo 96.º da Convenção;
f) O termo «capacidade» em relação a uma aeronave significa a carga pagante dessa aeronave disponível em toda ou parte da rota;
g) O termo «capacidade» em relação a um de erminado serviço aéreo significa a capacidade da aeronave utilizada em tal serviço, multiplicada pela frequência dos voos realizados por essa aeronave durante um dado período numa rota ou em parte da mesma.
2. O Anexo a este Acordo é considerado como parte inseparável do mesmo.
ARTIGO 2
1. Cada Parte Contratante concede à outra Parte Contratante os direitos referidos no presente Acordo para o estabelecimento de serviços aéreos regulares internacionais nas rotas especificadas no Anexo a este Acordo. Os referidos serviços e rotas são designados, daqui em diante, por «serviços acordados» e «rotas especificadas», respectivamente.
2. A empresa designada por cada Parte Contratante gozará, na exploração de um serviço acordado numa rota especificada, dos seguintes direitos:
a) Sobrevoar, sem aterrar, o território da outra Parte Contratante;
b) Aterrar no referido território para fins não comerciais;
c) Embarcar e desembarcar tráfego internacional de passageiros, correio e carga nos pontos especificados nas rotas especificadas, sob reserva do disposto neste Acordo.
3. As disposições do parágrafo 2 deste artigo não deverão ser tomadas como conferindo à empresa de uma Parte Contratante o privilégio de embarcar no território da outra Parte Contratante passageiros, carga ou correio contra remuneração ou em regime de fretamento e destinados a outro ponto no território da outra Parte Contra ante.
ARTIGO 3
1. Cada Parte Contratante terá o direito de designar por escrito à outra Par e Contratante uma empresa para explorar os serviços acordados nas rotas especificadas. Cada Parte Contratante notificará por escrito a outra Parte Contra ante da substituição da empresa designada por outra.
2. Uma vez recebida tal notificação, cada Parte Contratante deverá, sob reserva das disposições dos parágrafos 3 e 4 des e artigo, conceder sem demora à empresa designada pela outra Parte Contratante a competente autorização de exploração.
3. As autoridades aeronáuticas de cada Parte Contratante poderão exigir que a empresa designada pela outra Parte Contratante lhes demonstre estar em condições de satisfazer as exigências prescritas nas leis e regulamentos que normal e razoavelmente são aplicados por tais autoridades à exploração de serviços aéreos internacionais em conformidade com as disposições da Convenção.
4. Cada Parte Contratante terá o direito de recusar a autorização de exploração referida no parágrafo 2 deste artigo, ou de impor as condições que julgar necessárias ao exercício dos direitos especificados neste Acordo, sempre que não se der por demonstrado, de harmonia com o parágrafo 3 deste artigo, que a propriedade substancial e o contrôle efectivo da empresa pertencem à Parte Contratante que a designou ou aos seus nacionais.
5. Após a recepção da autorização de exploração referida no parágrafo 2 deste artigo, a empresa designada poderá, em qualquer altura, iniciar a exploração de qualquer dos serviços acordados, desde que a tarifa e o horário estabelecidos de harmonia com as disposições dos artigos 10 e 11 do presente Acordo estejam em vigor relativamente àquele serviço.
6. Numa base de reciprocidade, não serão necessários vistos para a entrada, estada e saída da tripulação da aeronave explorada pelas empresas designadas pelas Partes Contratantes, desde que partam no voo em que chegaram. Isto aplicar-se-á também aos membros das tripulações da empresa designada de uma Parte Contratante que permaneçam no território da outra Parte Contratante por razões de ordem técnica ou de saúde, desde que partam no voo seguinte da mesma empresa, a não ser que as competentes autoridades concordem em prolongar a duração da estada.
ARTIGO 4
1. As leis e regulamentos de cada Parte Contratante relativos à entrada, permanência e saída do seu território de aeronaves utilizadas em serviços aéreos internacionais e à operação e navegação de aeronaves dentro dos limites do seu território serão também aplicados às aeronaves da empresa designada da outra Parte Contratante.
2. As leis e regulamentos de cada Parte Contratante relativos à entrada, permanência e saída do seu território de passageiros, tripulantes, correio e carga transportados em aeronaves e em especial os relativos a passaportes, alfândega e contrôle sanitário serão aplicados aos passageiros, tripulantes, correio e carga transportados pelas aeronaves da empresa designada da outra Parte Contratante.
ARTIGO 5
1. Cada Parte Contratante terá o direito de revogar uma autorização de exploração ou de suspender o exercício dos direitos especificados no artigo 2 do presente Acordo pela empresa designada pela outra Parte Contratante, ou ainda de sujeitar às condições que julgar necessárias o exercício daqueles direitos:
a) No caso de não dar por demonstrado que a propriedade substancial e o contrôle efectivo dessa empresa pertencem à Parte Contratante que a designou ou aos nacionais da dita Parte Contratante; ou
b) No caso de a empresa deixar de cumprir as leis ou regulamentos da Parte Contratante que concede os direitos; ou
c) No caso de a empresa deixar, por outro modo, de operar de harmonia com as condições prescritas no presente Acordo.
2. Salvo se a revogação imediata, suspensão ou imposição das condições mencionadas no parágrafo 1 deste artigo for essencial para evitar ulteriores infracções de leis ou regulamentos, tal direito apenas será exercido após consulta com a outra Parte Contratante. Neste caso, a consulta terá início no prazo de trinta dias a contar da data do pedido de consulta.
ARTIGO 6
1. As empresas designadas das duas Partes Contratantes terão justa e igual oportunidade de exploração dos serviços acordados nas rotas especificadas entre os seus respectivos territórios. A empresa de cada Parte Contratante deverá ter em consideração, na operação dos serviços acordados, os interesses da empresa da outra Parte Contratante, de modo a não afectar indevidamente os serviços que esta última oferece, no todo ou em parte, da mesma rota.
2. A capacidade total a oferecer será mantida em equilíbrio com as necessidades do tráfego entre os territórios das Partes Contratantes e será dividida em partes tanto quanto possível iguais entre as empresas designadas.
3. As empresas designadas entender-se-ão sobre a frequência e capacidade dos serviços a oferecer nas rotas que ligam os territórios das duas Partes Contratantes. A referida capacidade será ajustada, de tempos a tempos, às necessidades do tráfego e submetida à aprovação das autoridades aeronáuticas de ambas as Partes Contratantes.
4. A fim de satisfazer exigências de tráfego imprevistas de carácter temporário, as empresas designadas poderão, não obstante as disposições deste artigo, decidir entre elas os aumentos temporários de capacidade que forem necessários para satisfazer a procura do tráfego. Cada um destes aumentos de capacidade deverá ser notificado sem demora às autoridades aeronáuticas das Partes Contratantes.
5. Sempre que a empresa designada de uma Parte Contratante goze, numa rota especificada, de direitos de tráfego entre o território da outra Parte Contratante e pontos intermédios e/ou pontos além do último território, as empresas designadas acordarão entre si na capacidade a oferecer em complemento da capacidade estabelecida de harmonia com o parágrafo 3 e sem prejuízo das disposições dos parágrafos 1 e 2 deste artigo. O referido acordo será submetido à aprovação das autoridades aeronáuticas das Partes Contratantes.
ARTIGO 7
1. As aeronaves das empresas designadas de uma Parte Contratante utilizadas na exploração de serviços aéreos internacionais serão isentas de direitos aduaneiros ou impostos semelhantes à chegada ou à partida do território da outra Parte Contratante. Aplicar-se-á este mesmo princípio ao equipamento normal das aeronaves, combustíveis e lubrificantes e provisões de bordo, incluindo alimentos, bebidas e tabaco, e pequenas quantidades de artigos destinados a venda aos passageiros durante o voo, desde que tal equipamento, provisões e artigos permaneçam a bordo até à altura de serem reexportados.
2. Serão igualmente isentos dos mesmos direitos e impostos, com excepção dos encargos correspondentes a serviços prestados:
a) As provisões de bordo embarcadas no território de qualquer das Partes Contratantes, dentro dos limites fixados pelas autoridades da dita Parte Contratante e para utilização a bordo das aeronaves que saiam e estejam afectas a serviços internacionais da empresa designada da outra Parte Contratante;
b) As peças sobresselentes e o equipamento normal de bordo importados no território de qualquer das Partes Contratantes para a manutenção ou reparação das aeronaves utilizadas em serviços internacionais pela empresa designada da outra Parte Contratante. Tais peças e equipamento deverão ser utilizados dentro dos limites da área do aeroporto em questão destinada à manutenção da aeronave e da carga e ao serviço a passageiros e, no caso de aterragem forçada ou aterragem num aeroporto alternante, poderão ser transferidos para o local em que se encontre a aeronave;
c) Os combustíveis e lubrificantes destinados ao abastecimento à partida das aeronaves utilizadas num serviço internacional pela empresa designada da outra Parte Contratante, mesmo quando aqueles fornecimentos se destinem a ser utilizados na parte da viagem sobre o território da Parte Contratante em que são metidos a bordo.
3. Pode ser exigido que os materiais referidos nos subparágrafos a), b) e c) acima sejam colocados sob vigilância ou contrôle das autoridades aduaneiras enquanto permanecerem no território da outra Parte Contratante.
ARTIGO 8
O equipamento normal de bordo, bem como os materiais e provisões mantidos a bordo da aeronave de cada Parte Contratante, somente poderão ser desembarcados no território da outra Parte Contratante com a autorização das autoridades alfandegárias da última Parte Contratante. Em tal caso, poderão ser colocados sob vigilância das ditas autoridades até ao momento de serem reexportados ou de lhes ser dado outro destino de harmonia com os regulamentos aduaneiros.
ARTIGO 9
Os passageiros em trânsito directo pelo território de qualquer das Partes Contratantes que não abandonem a área do aeroporto que lhes é destinada serão sujeitos a um contrôle simplificado. A bagagem e as mercadorias em trânsito directo serão isentas de direitos alfandegários e outros impostos semelhantes.
ARTIGO 10
1. Nos parágrafos seguintes, o termo «tarifa» significa os preços do transporte de passageiros, bagagem e mercadorias e as condições em que se aplicam, assim como os preços e condições referentes aos serviços de agência e outros serviços auxiliares, com exclusão, todavia, das remunerações e condições relativas ao transporte do correio.
2. As tarifas a aplicar a qualquer serviço acordado deverão ser estabelecidas a níveis razoáveis, tendo em devida conta todos os factores relevantes, incluindo custo de exploração, lucro razoável e as tarifas de outras empresas.
3. As tarifas a que se refere o parágrafo 2 deste artigo serão acordadas entre as empresas designadas de ambas as Partes Contratantes, após consulta, quando necessário, a outras empresas que operem em toda ou em parte da mesma rota. Esse acordo deverá, sempre que possível, ser estabelecido em conformidade com o procedimento da IATA.
4. As tarifas assim acordadas entre as empresas designadas serão submetidas à aprovação das autoridades aeronáuticas, pelo menos noventa dias antes da data prevista para a sua entrada em vigor. Em casos especiais, este prazo poderá ser reduzido mediante acordo das referidas autoridades.
5. As autoridades aeronáuticas de cada Parte Contratante notificarão directamente as autoridades aeronáuticas da outra Parte Contratante do seu acordo ou eventual desacordo relativamente às tarifas propostas, dentro do mais curto prazo possível. No caso de nenhuma das autoridades aeronáuticas ter manifestado o seu desacordo no prazo de trinta dias a contar da data de apresentação das tarifas, de harmonia com o parágrafo anterior deste artigo, estas serão consideradas aprovadas.
6. Se as tarifas não puderem ser acordadas de harmonia com o parágrafo 3 deste artigo ou no caso de não serem aprovadas pelas autoridades aeronáuticas, as autoridades aeronáuticas das duas Partes Contratantes deverão esforçar-se por determinar as tarifas de mútuo acordo.
7. No caso de não se chegar a acordo, o diferendo será solucionado em conformidade com as disposições do artigo 15 do presente Acordo.
8. As tarifas estabelecidas de harmonia com o disposto neste artigo continuarão em vigor até ao estabelecimento de novas tarifas. A validade de uma tarifa não poderá, todavia, ser prorrogada em virtude deste parágrafo por período superior a doze meses a contar da data em que deveria ter expirado.
ARTIGO 11
1. As autoridades aeronáuticas de uma Parte Contratante fornecerão às autoridades aeronáuticas da outra Parte Contratante, a seu pedido, as estatísticas razoavelmente necessárias à revisão da capacidade oferecida nos serviços acordados pela empresa designada da primeira Parte Contratante.
2. A empresa designada de uma Parte Contratante submeterá à aprovação das autoridades aeronáuticas da outra Parte Contratante, com um mês de antecedência, o horário dos serviços, especificando a frequência e o tipo de aeronave a ser utilizado, bem como qualquer outra informação relativa à exploração dos serviços acordados.
ARTIGO 12
1. Cada Parte Contratante concede à empresa designada da outra Parte Contratante o direito de transferir livremente, à taxa de câmbio oficial, os excedentes das receitas sobre as despesas que essa empresa realize no seu território e que se relacionem com o transporte de passageiros, correio e carga.
2. No caso de existir um acordo especial que regule os pagamentos a efectuar entre as duas Partes Contratantes, aplicar-se-ão as disposições desse acordo.
3. As receitas e lucros da empresa designada de uma Parte Contratante provenientes do transporte de passageiros, carga e correio no território da outra Parte Contratante serão isentos de todos os direitos e taxas.
ARTIGO 13
1. A empresa designada de uma Parte Contratante terá o direito de manter no território da outra Parte Contratante a sua própria representação técnica e comercial, constituída por nacionais de qualquer das Partes Contratantes, em número razoavelmente necessário, para a exploração dos serviços aéreos. As Partes Contratantes deverão dar aos representantes da empresa a liberdade de acção necessária para desempenhar as suas funções, numa base de reciprocidade e em conformidade com os respectivos regulamentos nacionais.
2. As autoridades aeronáuticas de ambas as Partes Contratantes deverão ajudar os representantes das empresas designadas no desempenho das suas funções.
ARTIGO 14
1. Num espírito de estreita cooperação, as autoridades aeronáuticas das Partes Contratantes consultar-se-ão de tempos a tempos com vista a assegurar a observância do presente Acordo.
2. Cada Parte Contratante poderá, em qualquer altura, solicitar consultas à outra Parte Contratante para efeitos de interpretação, aplicação ou modificação deste Acordo. As referidas consultas terão início dentro de sessenta dias a contar da data do envio do pedido, salvo no caso de ambas as Partes Contratantes acordarem numa dilação ou redução deste período.
ARTIGO 15
Os diferendos entre as Partes Contratantes relativos à interpretação ou aplicação do presente Acordo serão solucionados por negociações directas entre as autoridades aeronáuticas das duas Partes Contratantes. Se as ditas autoridades não chegarem a acordo, o diferendo será solucionado por via diplomática.
ARTIGO 16
1. As emendas ao presente Acordo resultantes de consultas entre as Partes Contratantes de harmonia com o artigo 14 deste Acordo entrarão em vigor depois de mutuamente notificadas através de notas diplomáticas.
2. As emendas ao Anexo a este Acordo poderão ser efectuadas por acordo directo entre as autoridades aeronáuticas das Partes Contratantes. As emendas acordadas entrarão em vigor em data a determinar mutuamente pelas autoridades aeronáuticas e deverão ser confirmadas por troca de notas.
3. O presente Acordo e seu Anexo serão considerados emendados de modo a ficarem conformes com qualquer Convenção ou acordo multilateral que venha a obrigar ambas as Partes Contratantes.
ARTIGO 17
Cada Parte Contratante poderá, em qualquer altura, notificar a outra Parte Contratante da sua decisão de fazer cessar o Acordo. A referida notificação será comunicada simultaneamente à Organização da Aviação Civil Internacional. Nesse caso, o Acordo cessará doze meses após a data de recepção da notificação pela outra Parte Contratante, salvo se essa notificação vier a ser anulada de comum acordo antes de expirado aquele prazo. No caso de a outra Parte Contratante não acusar a recepção da notificação, esta será considerada como tendo sido recebida catorze dias após a recepção da notificação pela Organização da Aviação Civil Internacional.
ARTIGO 18
O presente Acordo será registado na Organização da Aviação Civil Internacional.
ARTIGO 19
1. O presente Acordo aplicar-se-á provisoriamente a partir da data da sua assinatura. A aplicação provisória não deverá durar mais de seis meses, salvo acordo em contrário entre as duas Partes Contratantes.
2. O Acordo entrará em vigor na data em que as Partes Contratantes tiverem notificado uma à outra que deram cumprimento às formalidades constitucionais relativas à conclusão e entrada em vigor de acordos internacionais.
Em fé do que os signatários, devidamente autorizados pelos respectivos Governos, assinaram o presente Acordo.

ANEXO AO ACORDO DE TRANSPORTE AÉREO ENTRE O GOVERNO DE PORTUGAL E O GOVERNO DA REPÚBLICA POPULAR DA BULGÁRIA.
SECÇÃO I
«Empresas designadas», em relação a este Acordo, são:
Para Portugal:
Transportes Aéreos Portugueses - TAP, com sede em Lisboa, Portugal.
Para a República Popular da Bulgária:
Darjavno Stopansko Obedinenie Balgarska Grajdanska Aviacia - Balkan, com sede em Sófia, Bulgária.
SECÇÃO II
1. A empresa designada pelo Governo de Portugal poderá explorar serviços aéreos regulares na seguinte rota, em ambos os sentidos:
Pontos em Portugal - pontos intermédios - Sófia - pontos além.
2. A empresa designada pelo Governo da República Popular da Bulgária poderá explorar serviços aéreos regulares na seguinte rota, em ambos os sentidos:
Pontos na Bulgária - Madrid e/ou outros pontos intermédios - Lisboa - pontos além.
3. Na exploração da rota especificada no parágrafo 1 acima, a empresa portuguesa designada terá o direito de:
a) Desembarcar no território da República Popular da Bulgária passageiros, carga e correio embarcados no território de Portugal;
b) Embarcar no território da República Popular da Bulgária passageiros, carga e correio destinados ao território de Portugal;
c) Omitir um ou mais pontos intermédios, desde que os serviços com origem no território português e as omissões sejam previamente anunciados nos horários.
4. Na exploração da rota especificada no parágrafo 2 acima, a empresa búlgara designada terá o direito de:
a) Desembarcar no território de Portugal passageiros, carga e correio embarcados no território da República Popular da Búlgara;
b) Embarcar no território de Portugal passageiros, carga e correio destinados ao território da República Popular da Bulgária;
c) Omitir um ou mais pontos intermédios, desde que os serviços com origem no território búlgaro e as omissões sejam previamente anunciados nos horários.
SECÇÃO III
A empresa designada de uma Parte Contratante poderá ter o direito de embarcar ou desembarcar no território da outra Parte Contratante tráfego internacional de passageiros, carga e correio destinados ou com origem em pontos intermédios nas rotas especificadas na secção II.
O exercício de tal direito ficará sujeito a um acordo entre as empresas designadas, que será submetido à aprovação das autoridades aeronáuticas das duas Partes Contratantes.
SECÇÃO IV
A empresa designada de uma Parte Contratante poderá ter o direito de embarcar ou desembarcar no território da outra Parte Contratante tráfego internacional de passageiros, carga e correio destinados ou com origem em pontos além do referido território.
O exercício de tal direito ficará sujeito a um acordo entre as empresas designadas, que será submetido à aprovação das autoridades aeronáuticas das duas Partes Contratantes.
AIR TRANSPORT AGREEMENT BETWEEN THE GOVERNMENT OF PORTUGAL AND THE GOVERNMENT OF THE PEOPLE'S REPUBLIC Of BULGARIA.
The Government of Portugal and the Government of the People's Republic of Bulgaria, hereinafter called the Contracting Par ies,
Being parties to the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December 1944,
Confirming their wish to promote the development of international civil aviation through strict observance of the regulations of the said Convention,
Desiring to conclude an Agreement, supplementary to that Convention, for the purpose of establishing scheduled air services between and beyond their respective territories,
Have agreed as follows:
ARTICLE 1
1. For the purposes of this Agreement and its Annex:
a) The term «the Convention» means the Convention on International Civil Aviation, opened for signature at Chicago on the seven h day of December 1944, and includes any Annex adopted under article 90 of that Convention and any amendment of the Annexes or Convention under articles 90 and 94 thereof so far as those Annexes and amendments have become effective for both Contracting Parties;
b) The term «aeronautical authorities» means:
For Portugal - the Ministry of Transport and Communications and any person or body authorized to perform any functions being the responsibility of the said Ministry;
For the People's Republic of Bulgaria - the Ministry of Transport and any person or body authorized to perform any functions being the responsibility of the said, Ministry;
c) The term «designated airline» means an airline which has been designated and authorized in accordance with article 3 of the present Agreement;
d) The term «territory» in relation to a State means the land areas and the territorial waters under the sovereignty of that State;
e) The terms «air service», «international air service», «airline» and «stop for non-traffic purposes» have the meanings respectively assigned to them in article 96 of the Convention;
f) The term «capacity» in relation to an aircraft means the payload of that aircraft available on a route or sec ion of a route;
g) The term «capacity» in relation to a specified air service means the capacity of the aircraft used on such service multiplied by the frequency of the flights operated by such an aircraft over a given period and route or section of a route.
2. The Annex to this Agreement is considered an unseparable part thereof.
ARTICLE 2
1. Each Contracting Party grants to the other Contracting Party the rights specified in the present Agreement for the purpose of establishing scheduled in ernational air services on the routes specified in the Annex to this Agreement. Such services and routes are hereafter called «the agreed services» and «the specified routes», respectively.
2. The airline designated by each Contracting Party shall enjoy, while operating an agreed service on a specified route, the following rigths:
a) To fly without landing across the territory of the other Contracting Party;
b) To make stops in the said territory for non-traffic purposes;
c) To take on and to put down in international traffic passengers, mail and cargo at the specified points on the specified routes, subject to the provisions of this Agreement.
3. The provisions in paragraph 2 of this article shall not be deemed to confer on the airline of one Contracting Party the privilege of taking up in the territory of the other Contracting Party passengers, cargo or mail carried for remuneration or hire and destined for another point in the territory of the other Contracting Party.
ARTICLE 3
1. Each Contracting Party shall have the right to designate in writing to the other Contracting Party one airline for the purpose of operating the agreed services on the specified routes. Each Contracting Party shall notify in writing to the other Contracting Party the substitution of he designated airline for another one.
2. On receipt of such designation each Contracting Part shall, subject to the provisions of paragraphs 3 and 4 of this article, without delay grant to the airline designated by the other Contracting Party the appropriate operating authorization.
3. The aeronautical authorities of each Contracting Party may require the airline designated by the other Contracting Party to satisfy them that it is qualified to fulfil the conditions prescribed under the laws and regulations normally and reasonably applied to the operation of international air services by such authorities in conformity with the provisions of the Convention.
4. Each Contracting Party shall have the right to refuse to grant the operating authorization referred to in paragraph 2 of this article, or to impose such conditions as it may deem necessary on the exercise of the rigths specified in this Agreement, in any case where it does not obtain the required evidence prescribed under paragraph 3 of this article or is not satisfied that substantial ownership and effective control of the airline are ves ed in the Contracting Party designating it or in its nationals.
5. On receipt of the operating authorization referred to in paragraph 2 of this article, the designated airline may begin at any time to operate any agreed service, provided that the tariff and time-table established in accordance with the provisions of articles 10 and 11 of the present Agreement are in force in respect of that service.
6. On a basis of reciprocity, visas will not be required for the entry, stay and exit of the crew of the aircraft operated by the designated airlines of the Contracting Parties, provided that they leave on the same flight on which the they arrived. This shall also apply to crew members of the designated airline of one Contracting Party who remain in the territory of the other Contracting Party for technical or medical reasons, provided that they leave on the next flight of the same airline, unless the competent authorities agree to extend the duration of stay.
ARTICLE 4
1. The laws and regulations of each Contracting Party governing the admission to, remaining in and departure from its territory of aircrafts engaged in international air services and the operation and navigation of aircrafts while within the limits of its territory shall also be applied to the aircraft of the designated airline of the other Contracting Party.
2. The laws and regulations of each Contracting Party governing the admission to, remaining in and departure from its territory of passengers, crews, mail and cargo carried on board aircraft and in particular those regarding passports, customs and sanitary control shall be applied to passengers, crews, mail and cargo taken on board the aircraft of the designated airline of the other Contracting Party.
ARTICLE 5
1. Each Contracting Party shall have the right to revoke an operating authorization or to suspend the exercise of the rigths specified in article 2 of the present Agreement by the airline designated by the other Contracting Party, or to impose such conditions as it may deem necessary on the exercise of these rights:
a) In any case where it is not satisfied that substantial ownership and effective control of that airline are vested in the Contracting Party designating the airline or in nationals of such Contracting Party; or
b) In the case of failure by that airline to comply with the laws and regulations in force in the territory of the Contracting Party granting these rights; or
c) In case the airline otherwise fails to operate in accordance with the conditions prescribed under the present Agreement.
2. Unless immediate revocation, suspension or imposition of the conditions mentioned in paragraph 1 of this article is essential to prevent further infringements of laws or regulations, such right shall be exercised only af er consultation with the other Contracting Party. In such a case the consultation shall begin within a period of thirty days of the date of the request for the consultation.
ARTICLE 6
1. There shall be fair and equal opportunity for the airlines of both Contracting Parties to operate the agreed services on the specified routes between their respective territories. In operating the agreed services, the airline of each Contracting Party shall take in o account the interests of the airline of the other Contracting Party, so as not to affect unduly the services which the latter provides on the whole or part of the same route.
2. The total capacity to be provided shall be maintained in equilibrium with the traffic requeriments between the territories of the Contracting Parties and shall as far as possible be equally divided between the designated airlines.
3. The designated airlines shall agree on the frequency and capacity of the services to be offered on the routes connecting the territories of both Contracting Parties. Such capacity shall be adjusted from time to time to traffic requeriments and submitted to the approval of the aeronautical authorities of both Contracting Parties.
4. In order to meet unexpected traffic demands of a temporary character, the designated airlines may, notwithstanding the provisions of this article, agree between them to such temporary increases as are necessary to meet the traffic demand. Every such increase of capacity shall be notified without delay to the aeronautical authorities of the Contrac ing Parties.
5. In the case where the designated airline of one Contracting Party enjoys traffic rights between the territory of the other Contracting Party and intermediate points and/or points beyond the latter territory on a specified route, the designated airlines shall agree between themselves on the capacity to be offered in addition to the capacity established in accordance with paragraph 3 and without prejudice to the provisions of paragraphs 1 and 2 of this article. Such agreement shall be submitted to the approval of the aeronautical authorities of the Contracting Parties.
ARTICLE 7
1. No customs duties or similar charges shall be imposed on the aircraft of the designated airline of one Contracting Party operating international air services, when flying into or departing from the territory of the other Contracting Party. The same shall apply to their regular equipment, supplies of fuel and lubricants, and aircraft stores including food, beverages and tobacco, and articles destined for sale in restricted quantities to the passengers during the flight, provided such equipment, supplies and stores remain on board up to such time as they are reexported.
2. There shall also be exempt from the same duties, fees and charges, with the exception of those corresponding to the service performed:
a) Aircraft stores taken on board in the territory of one Contracting Party, within the limits fixed by the authorities of the said Contracting Party, and for use on board outbound aircraft operated on an international service by the designated airline of the other Contracting Party;
b) Spare parts and regular airborne equipment, introduced into the territory of either Contracting Party and destined for the maintenance or repair of aircrafts used on an international service by the designated airline of the other Contracting Party. The same shall be used within the limited area of the airport concerned for handling of the aircraft, passengers and cargo, and in case of forced landing or landing at an alternate aerodrome they may be transferred to the point where the aircraft is located;
c) Fuel and lubricants destined to supply outbound aircraft operated on an international service by the designated airline of the other Contracting Party, even when these supplies are to be used on the part of the journey performed over the territory of the Contracting Party in which they are taken on board.
3. Materials referred to in sub-paragraphs a), b) and c) above while in the territory of the other Contracting Party may be required to be kept under customs supervision or control.
ARTICLE 8
Regular airborne equipment, as well as materials and supplies retained on board the aircraft of each Contracting Party may be unloaded in the territory of the other Contracting Party only with the approval of the customs authorities of the latter Contracting Party. In such case, they may be placed under the supervision of the said authorities up to such time as they are reexported or otherwise disposed of in accordance with customs regulations.
ARTICLE 9
Passengers in direct transit across the territory of either Contracting Party who do not leave the airport area destined for them shall undergo only a very simplified control. Luggage and goods in direct transit shall be exempt from customs duties and other similar charges.
ARTICLE 10
1. For the purpose of the following paragraphs, the term «tariff» means the prices to be paid for the carriage of passengers, baggage and freight and the conditions under which those prices apply, including prices and conditions for agency and other auxiliary services, but excluding remuneration and conditions for the carriage of mail.
2. The tariffs to be charged for any agreed service shall be established at reasonable levels, due regard being paid to all relevant factors, including cost of operation, reasonable profit and the tariffs of other airlines.
3. The tariffs referred to in paragraph 2 of this article shall be agreed by the designated airlines of both Contracting Parties, after consultation with the other airlines operating over the whole or part of the same route, if such consultation is deemed necessary. Such agreement shall, wherever possible, be reached by the use of the procedures of the International Air Transport Association.
4. The tariffs so agreed between the designated airlines shall be submitted to the aeronautical authorities for approval at least ninety days before the proposed date of their introduction. In special cases, this period may be reduced, subject to the mutual agreement of the said authorities.
5. The aeronautical authorities of each Contracting Party shall give a direct notice to the aeronautical authorities of the other Contracting Party of their approval or eventual disapproval of the proposed tariffs in the shortest possible delay. In case neither aeronautical authority has expressed its disapproval within thirty days from the date of submission in accordance with the preceding paragraph of this article, these tariffs shall be considered as approved.
6. If the tariffs cannot be agreed in accordance with paragraph 3 of this article or in case they are not approved by the aeronautical authorities, the aeronautical authorities of the two Contracting Parties shall endeavour to determine the tariffs by mutual agreement.
7. In the absence of agreement, the dispute shall be settled in accordance with the provisions of article 15 of the present Agreement.
8. Any tariff established in accordance with the provisions of this article shall remain in force until a new tariff has been established. Nevertheless, no tariff shall be prolonged by virtue of this paragraph for more than twelve months after the date on which it otherwise would have expired.
ARTICLE 11
1. The aeronautical authorities of one Contracting Party shall supply the aeronautical authorities of the other Contracting Party at their request with such statistics as may be reasonably required for the purpose of reviewing the capacity provided on the agreed services by the designated airline of the former Contracting Party.
2. The airline designated by one Contracting Party shall submit to the aeronautical authorities of the other Contracting Party for approval, one month in advance, the time-table of the services specifying the frequencies and the type of aircraft to be used, as well as any other information concerning the operation of the agreed services.
ARTICLE 12
1. Each Contracting Party shall grant the designated airline of the other Contracting Party the right of free transfer, at the official rate of exchange, of the excess of receipts over expenditure earned by that airline in its territory in connection with the carriage of passengers, mail and cargo.
2. In case there exists a special agreement for settling the payments between the two Contracting Parties, the provisions of that agreement shall be applied.
3. Receipts and profits earned by the airline of one Contracting Party in the territory of the other Contracting Party in connection with the carriage of passengers, cargo and mail shall be exempt from all duties and charges.
ARTICLE 13
1. The designated airline of one Contracting Party shall be entitled to maintain in the territory of the other Contracting Party its own representation with such technical and commercial staff consisting of nationals of any of the two Contracting Parties as are reasonably required for the operation of the air services. The Contracting Parties shall give the airline representatives freedom of action to enable them to carry out their duties on a basis of reciprocity and in accordance with their legislation.
2. The aeronautical authorities of both Contracting Parties shall assist the representatives in carrying out their duties.
ARTICLE 14
1. In a spirit of close co-operation, the aeronautical authorities of the Contracting Parties shall consult each other from time to time with a view to ensuring the proper implementation of the present Agreement.
2. Either Contracting Party may at any time request consultation with the other Contracting Party in connection with the interpretation, application or modification of this Agreement. Such consultation shall begin within a delay of sixty days of the date of sending of the request, unless both Contracting Parties agree to an extension of shortening of this period.
ARTICLE 15
Disputes between the Contracting Parties relating to the interpretation or application of the present Agreement shall be settled by direct negotiations between the aeronautical authorities of the two Contracting Parties. If the said authorities fail to reach agreement, the dispute shall be settled through diplomatic channels.
ARTICLE 16
1. Any modification to this Agreement resulting from consultation between the Contracting Parties in accordance with article 14 of this Agreement shall come into effect after mutual notification through diplomatic notes.
2. Any modification of the Annex to the Agreement may be effected by direct agreement between the aeronautical authorities of both Contracting Parties. The agreed modifications shall come into effect on a date mutually determined by the aeronautical authorities and shall be confirmed by an exchange of notes.
3. The present Agreement and its Annex shall be deemed amended so as to conform with any multilateral Convention or Agreement which may become binding on both Contracting Parties.
ARTICLE 17
Either Contracting Party may at any time give notice to the other Contracting Party of its decision to terminate the Agreement. Such notice shall be simultaneously communicated to the International Civil Aviation Organization. In such case the Agreement shall terminate twelve months after the date of receipt of the notice by the other Contracting Party, unless the notice to terminate is withdrawn by mutual agreement before the expiry of this period. In the absence of acknowledgement of receipt by the other Contracting Party, notice shall be deemed to have been received fourteen days after the receipt of the notice by the International Civil Aviation Organization.
ARTICLE 18
The present Agreement shall be registered with the International Civil Aviation Organization.
ARTICLE 19
1. The present Agreement shall be applied provisionally from the date of its signature. Such a provisional application shall not last more than six months, unless otherwise agreed by the two Contracting Parties.
2. The present Agreement shall come into force when the Contracting Parties notify each other of the completion of their constitutional formalities concerning the conclusion and entry into force of international agreements.
In witness whereof the undersigned, being duly authorized thereto by their respective Governments, have signed the present Agreement.

ANNEX TO THE AIR TRANSPORT AGREEMENT BETWEEN THE GOVERNMENT OF PORTUGAL AND THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF BULGARIA.
SECTION I
«Designated airlines» with regard to this Agreement are:
For Portugal:
Transportes Aéreos Portugueses - TAP, with its head office in Lisbon, Portugal.
For the People's Republic of Bulgaria:
Darjavno Stopansko Obedinenie Balgarska Grajdanska Aviacia - Balkan, with its head office in Sofia, Bulgaria.
SECTION II
1. The airline designated by the Government of Portugal may operate scheduled air services on the following route in both directions:
Points in Portugal - intermediate points - Sofia - points beyond.
2. The airline designated by the Government of the People's Republic of Bulgaria may operate scheduled air services on the following route in both directions:
Points in Bulgaria - Madrid and/or other intermediate points - Lisbon - points beyond.
3. While operating the route specified in paragraph 1 above, the Portuguese designated airline shall have the right:
a) To put down in the territory of the People's Republic of Bulgaria passengers, cargo and mail taken on in the territory of Portugal;
b) To take on in the territory of the People's Republic of Bulgaria passengers, cargo and mail destined for the territory of Portugal;
c) To omit one or more intermediate points, provided that the services originate in the Portuguese territory and that the omissions are previously published in the time-tables.
4. While operating the route specified in paragraph 2 above, the Bulgarian designated airline shall have the right:
a) To put down in the territory of Portugal passengers, cargo and mail taken on in the territory of the People's Republic of Bulgaria;
b) To take on in the territory of Portugal passengers, cargo and mail destined for the territory of the People's Republic of Bulgaria;
c) To omit one or more intermediate points, provided that the services originate in the Bulgarian territory and that the omissions are previously published in the time-tables.
SECTION III
The designated airline of one Contracting Party may have the right to take on or put down in the territory of the other Contracting Party international traffic in passengers, cargo and mail destined for or originating at intermediate points on the routes specified in Section II.
The exercise of such right shall be subject to an agreement between the designated airlines to be submitted to the approval of the aeronautical authorities of the two Contracting Parties.
SECTION IV
The designated airline of one Contracting Party may have the right to take on or put down in the territory of the other Contracting Party international traffic in passengers, cargo and mail destined for or originating at points beyond the said territory.
The exercise of such right shall be subject to an agreement between the designated airlines to be submitted to the approval of the aeronautical authorities of the two Contracting Parties.
