Decreto n.º 427/76

Usando da faculdade conferida pelo artigo 3.º, n.º 1, alínea 3), da Lei Constitucional n.º 6/75, de 26 de Março, o Governo decreta o seguinte:
Artigo único. É aprovado o Acordo de Cooperação Económica, Industrial, Científica e Tecnológica a Longo Prazo entre a República Portuguesa e a República Popular da Bulgária, assinado em Lisboa em 23 de Outubro de 1975, cujo texto em inglês e respectiva tradução para português vão juntos ao presente decreto.

Long-Term Agreement on Economic, Industrial, Scientific and Technological Co-operation between the Republic of Portugal and the People's Republic of Bulgaria.
The Government of the Republic of Portugal and the Government of the People's Republic of Bulgaria, designated henceforward as Contracting Parties,
Led by the desire to contribute to the development and diversification of their mutual relations in the field of economic, industrial, scientific and technological co-operation on a lasting basis and in a spirit of equality and mutual advantage, respect for mutual sovereignity and non-interference in internal affairs,
Aiming at the utilization of the possibilities created by economic potentials and the technical progress of the two countries,
Taking into account the Long-Term Trade Agreement signed by the two countries, on February 11th, 1975,
Have agreed on the following:
ARTICLE 1
The Contracting Parties will take measures designated to facilitate, to expand and to diversify the economic, industrial, scientific and technological co-operation between the two countries.
ARTICLE 2
The Contracting Parties will stimulate and facilitate the conclusion of long-term contracts of economic, industrial, scientific and technological co-operation, in order to allow the trade resulting of these contracts to benefit, as widely as possible, from the advantages foreseen in the legislations of the two countries, particularly those referring to perfectioning traffic, dutyfree temporary imports, utilization of free-ports and free-zones and simplification of customs and administrative formalities.
ARTICLE 3
The Contracting Parties shall identify the fields in which the long-term expansion of the economic, industrial, scientific and technological co-operation appears to be useful and mutually advantageous.
Among others, co-operation of mutual interest could be established in the following fields: ship-building and ship-repair, machinebuilding, electronic and electrotechnical industry, agriculture, particularly tobacco and sunflower production, food-processing and tobacco industry, light industry and in particular textiles, timber processing industry, transport and tourism.
ARTICLE 4
The economic, industrial, scientific and technological co-operation could be carried out, among others in the following forms:
Joint production and marketing of commodities;
Mutual supply of raw-materials;
Investigation, designing and execution of joint projects, including the modernization of existing capacities;
Exchange of patents, licences and know-how and elaboration and utilization of improved or new technologies;
Joint research work and exchange of the results of scientific researches and of other kinds of documentation and technical information;
Exchange of specialists and promotion of their adequate formation;
Organization and participation in specialized exhibitions, symposia, etc.
ARTICLE 5
The co-operation foreseen shall be carried out through contracts and arrangements between the competent authorities, economic organizations, research institutes and enterprises of the two countries, in accordance with the laws and regulations effective in either country.
The Contracting Parties shall assist and create all possible facilities for the realization of such contracts and arrangements.
ARTICLE 6
The Contracting Parties shall give assistance in the co-operation between enterprises and organizations of the two countries on third markets.
ARTICLE 7
Payments between the Republic of Portugal and the People's Republic of Bulgaria shall be effected in freely convertible currency in accordance with the foreign exchange regulations in force in the two countries.
ARTICLE 8
The Contracting Parties shall make efforts to grant financing and credit facilities as favourable as possible for the operations resulting from the co-operation described in this context, within the framework of the laws and regulations existing in the two countries.
ARTICLE 9
For the purpose of realizing the objectives of this Agreement, a General Portuguese-Bulgarian Commission for Economic, Industrial, Scientific and Technological Co-operation is Set up. The Commission will have the following tasks:
To supervise, assist and facilitate the practical implementation and development of the co-operation foreseen in this Agreement;
To prepare long-term programmes on development of the economic, industrial, scientific and technological co-operation between the two countries;
To facilitate and assist the development of trade relations between the two countries and make recommendations aimed at the expansion of mutual trade;
To make recommendations to the two Governments in order that measures will be adopted aiming at the expansion of the economic, industrial, scientific and technological co-operation;
To consider other questions resulting from the implementation of this Agreement.
Whenever necessary the General Commission could establish working groups for the analysis and discussion of specific problems of co-operation.
ARTICLE 10
The provisions of this Agreement shall also apply to current contracts which are not executed as to the date of expiry of the validity of the Agreement.
ARTICLE 11
This Agreement shall come into force as from the date of receiving the second of notes, by which the Contracting Parties inform each other about its approval in accordance with the constitutional procedures of both countries.
The Agreement shall be valid for a period of 5 years and shall be automatically prolonged each subsequent year unless either Party gives, through a diplomatic channel, a written notice to the other, three months before the expiry of the one year period, about its desire to terminate the Agreement.
The Agreement could be altered or supplemented only in a written form upon agreement between the two Contracting Parties.

O Governo da República Portuguesa e o Governo da República Popular da Bulgária, a seguir designados por Partes Contratantes,
Animados do desejo de contribuir para o desenvolvimento e diversificação das suas relações no campo da cooperação económica, industrial, científica e tecnológica numa base duradoura e num espírito de igualdade e vantagem recíprocas, respeito pela soberania mútua e não interferência nos assuntos internos,
Visando a utilização das possibilidades criadas pelos potenciais económicos e o progresso técnico dos dois países,
Tendo presente o Acordo de comércio a longo prazo assinado pelos dois países em 11 de Fevereiro de 1975,
Acordaram no seguinte:
ARTIGO 1
As Partes Contratantes adoptarão medidas destinadas a facilitar, expandir e diversificar a cooperação económica, industrial, científica e tecnológica entre os pois países.
ARTIGO 2
As Partes Contratantes estimularão e facilitarão a conclusão de contratos de cooperação económica, industrial, científica e tecnológica a longo prazo, no sentido de permitir que as trocas resultantes destes contratos beneficiem, na maior medida, das vantagens previstas nas legislações dos dois países, particularmente das que se referem ao tráfico de aperfeiçoamento, à importação temporária com isenção de direitos, à utilização de portos e zonas francas e simplificação de formalidades alfandegárias e administrativas.
ARTIGO 3
As Partes Contratantes indicarão os campos nos quais a expansão a longo prazo da cooperação económica, industrial, científica e tecnológica se afigura ser útil e mutuamente vantajosa.
Entre outros, a cooperação de interesse recíproco poderá ser estabelecida nos seguintes sectores: construção e reparação naval, construção de máquinas, indústria electrónica e electrotécnica, agricultura, particularmente produção de tabaco e girassol, indústrias alimentar e do tabaco, indústria ligeira e especialmente de têxteis, indústria de trabalho da madeira, transportes e turismo.
ARTIGO 4
A cooperação económica, industrial, científica e tecnológica poderá ser realizada, entre outras, das seguintes formas:
Produção e venda conjunta de artigos;
Fornecimento mútuo de matérias-primas;
Investigação, desenho e execução de projectos conjuntos, incluindo a modernização das capacidades existentes;
Troca de patentes, licenças e know-how e elaboração e utilização de tecnologias novas ou aperfeiçoadas;
Trabalho conjunto de pesquisa e troca de resultados de investigações científicas e de outro tipo de documentação ou informação técnica;
Troca de especialistas e promoção da sua adequada formação;
Organização e participação em exposições especializadas, simpósios, etc.
ARTIGO 5
A cooperação prevista realizar-se-á através de contratos e acordos entre autoridades competentes, organizações económicas, institutos de pesquisa e empresas dos dois países, em conformidade com as leis e regulamentos em vigor em qualquer dos dois países.
As Partes Contratantes concederão e criarão todas as facilidades possíveis para a realização de tais contratos e acordos.
ARTIGO 6
As Partes Contratantes apoiarão a cooperação entre empresas e organizações dos dois países em terceiros mercados.
ARTIGO 7
Os pagamentos entre a República Portuguesa e a República Popular da Bulgária serão efectuados em moeda livremente convertível, de acordo com os regulamentos cambiais em vigor nos dois países.
ARTIGO 8
As Partes Contratantes farão esforços por conceder facilidades de financiamento e crédito tão favoráveis quanto possível para as operações resultantes da cooperação descrita neste contexto, dentro da estrutura das leis e regulamentos existentes nos dois países.
ARTIGO 9
Com o propósito de realizar os objectivos deste Acordo, é criada uma Comissão Geral Luso-Búlgara para a Cooperação Económica, Industrial, Científica e Tecnológica. A Comissão terá as seguintes funções:
Supervisionar, assistir e facilitar a implementação prática e desenvolvimento da cooperação prevista no presente Acordo;
Preparar programas a longo prazo de desenvolvimento da cooperação económica, industrial, científica e tecnológica entre os dois países;
Facilitar e auxiliar o desenvolvimento das relações comerciais entre os dois países e fazer recomendações destinadas à expansão do comércio mútuo;
Fazer recomendações aos dois Governos no sentido de serem adoptadas medidas que visem a expansão da cooperação económica, industrial, científica e tecnológica;
Considerar outras questões resultantes da implementação do presente Acordo.
Quando necessário, a Comissão Geral poderá estabelecer grupos de trabalho para análise e discussão de problemas específicos de cooperação.
ARTIGO 10
As cláusulas deste Acordo aplicar-se-ão também aos contratos em curso que não tenham sido cumpridos à data do termo da validade do Acordo.
ARTIGO 11
O presente Acordo entrará em vigor na data de recepção da segunda das notas pelas quais as Partes Contratantes se informam reciprocamente quanto à sua aprovação, em concordância com as formalidades constitucionais de ambos os países.
O Acordo será válido por um período de cinco anos e será automaticamente prorrogado cada ano subsequente, a não ser que qualquer Parte anuncie, por escrito, à outra Parte, através da via diplomática, três meses antes do termo do período de um ano, acerca do seu desejo de denunciar o Acordo.
O Acordo poderá ser alterado ou suplementado, somente por escrito, segundo desejo das duas Partes Contratantes.
