Usando da faculdade conferida pelo artigo 3.º, n.º 1, alínea 3), da Lei Constitucional n.º 6/75, de 26 de Março, o Governo decreta o seguinte:
Artigo único. É aprovado o Acordo de Comércio a Longo Prazo entre a República Portuguesa e a República Popular da Bulgária, assinado em 11 de Fevereiro de 1975, cujo texto em inglês e a respectiva tradução para português vão anexos ao presente decreto.

LONG TERM TRADE AGREEMENT BETWEEN THE REPUBLIC OF PORTUGAL AND THE PEOPLE'S REPUBLIC OF BULGARIA.
The Government of the Republic of Portugal and the Government of the People's Republic of Bulgaria, led by the desire to encourage and facilitate the development of trade and of economic, industrial and technological cooperation between the two countries on the basis of equality and mutual benefit, have agreed as follows:
ARTICLE 1
The Contracting Parties shall contribute within the framework of the existing laws and regulations in the two countries for the harmonious and substancial increase of the volume of trade and for the expansion of the economic, industrial and technological cooperation, in order to obtain the maximum use of the possibilities resulting from their economic development.
ARTICLE 2
In order to ensure the conditions of mutual benefit needed for the expansion of trade between the two countries, each of the Contracting Parties grants the most-favoured-nation treatment to the goods originated and imported from the territory of the other Contracting Party, as well as to the goods originated in its own territory and exported to the territory of the other Contracting Party, with respect to everything which concerns custom duties, taxes and any other fiscal charges, including internal taxes and charges, as well as procedures and formalities connected to customs-clearance and import and export licensing.
The goods originated in the territory of one of the Contracting Parties shall not be subject, whenever imported into the territory of the other Party, to the payment of custom duties, taxes and other fiscal charges of any type, including internal taxes and charges, higher than those charged to similar goods imported from any other country.
Any advantage granted by one of the Contracting Parties to the goods originated in any third country shall be extended immediately and unconditionally to similar goods originated in the territory of the other Party.
ARTICLE 3
No prohibitions or restrictions shall be established or maintained by one of the Contracting Parties as regards the importation or exportation of any goods originated in the territory of the other Contracting Party or destinated to it, as well as their circulation, transportation and distribution in the respective territories, unless such measures shall also apply to similar goods originated in or destinated to any other country.
The same treatment shall apply to payments and transfers, resulting from trade between the two countries.
ARTICLE 4
The provisions of articles 2 and 3 shall not apply to:
a) Advantages which are or may be accorded by either Contracting Party to adjacent countries in order to facilitate frontier trade;
b) Advantages which are or may be granted by either Contracting Party to other countries under agreements on a customs union or a free-trade area.
ARTICLE 5
The Contracting Parties shall take the appropriate measures, within the limits of their legislation, to facilitate the rail, road, water and air transport between both countries.
The conditions for the settlement of the questions in the field of transport shall be subject to direct negotiations between the Portuguese and Bulgarian authorities duly authorized to engage in such activities.
ARTICLE 6
The Contracting Parties, in accordance with the objectives and requirements of their economic development, shall encourage and facilitate the conclusion and implementation of contracts and programs for a long term trade, industrial and technological cooperation between concerned enterprises and firms of both countries and shall provide all possible facilities in the realisation of projects of mutual interest.
ARTICLE 7
The Contracting Parties shall:
Facilitate visits of groups and delegations for trade purposes and in connection with the establishment of industrial and technological cooperation between enterprises and firms of the two countries;
Encourage and facilitate the organization of and participation in fairs, exhibitions, seminars, symposia and other activities in the field of trade and technology in their own country, for enterprises and organisations of the other country.
ARTICLE 8
Either Contracting Party shall recognize trade documents and visas, as well as certificates of analysis and certificates of quality, issued by the competent authorities of the other Party, in compliance with its internal regulations.
ARTICLE 9
The Contracting Parties shall, in compliance with their laws and regulations, and under no less favourable conditions than those which are granted to other countries, permit imports and exports of:
a) Samples and advertisement materiais, including films;
b) Goods and articles for permanent and temporary fairs and exhibitions.
ARTICLE 10
Payments between the Republic of Portugal and the People's Republic of Bulgaria shall be effected in freely convertible currency in accordance with the foreign exchange regulations in force in the two countries.
ARTICLE 11
Trade between the two countries shall be effected on the basis of contracts concluded between competent physical and legal persons of both countries, authorized to engage in foreign trade activities.
ARTICLE 12
Either Contracting Party shall grant to the physical and legal persons of the other Party when carrying out trade activities, no less favourable treatment as regards access to courts and administrative bodies and as regards protection of their rights, than the one granted to physical and legal persons of any other country.
ARTICLE 13
To attain the aims of this Agreement, the Contracting Parties shall establish a Mixed Commission, consisting of representatives of the two Governments.
The Mixed Commission shall hold plenary sessions once a year in Portugal and Bulgaria alternately, at a date mutually agreed upon.
The Commission shall have the following tasks:
To supervise and facilitate the practical implementation of the present Agreement;
To assist in and facilitate the development of trade and of the economic, industrial and technological cooperation, as well as to make recommendations to both Governments for taking steps aiming at the increase of mutual trade;
To work out annual trade protocols and indicative commodity lists attached to them.
ARTICLE 14
The provisions of this Agreement shall apply to current contracts which have not been executed as at the date of expiration of the validity of the Agreement.
ARTICLE 15
The present Agreement shall come into force on the date of receipt of the second of notes by which the Parties inform each other about its approval in compliance with the constitutional procedures of both countries. The Agreement shall remain valid for a period of five years and shall be automatically prolonged thereafter for each subsequent year, unless either Contracting Party gives, through diplomatic channels, a written notice to the other, three months before the expiration of the respective one year period, about its desire to terminate the Agreement.

In connection with the Long Term Trade Agreement signed today between the Government of the Republic of Portugal and the Government of the People's Republic of Bulgaria, I have the honour to state on behalf of the Government of the Republic of Portugal, that the provisions of articles 2 and 3 of the above-mentioned Agreement shall not apply to the advantages granted or which may be granted in future by Portugal to the territories under Portuguese administration, as well as to the independent countries formerly under the same administration.

ACORDO DE COMÉRCIO A LONGO PRAZO ENTRE A REPÚBLICA PORTUGUESA E A REPÚBLICA POPULAR DA BULGÁRIA.
O Governo da República Portuguesa e o Governo da República Popular da Bulgária, animados do desejo de estimular e facilitar o desenvolvimento do comércio e a cooperação económica, industrial e tecnológica entre os dois países na base da igualdade e benefício mútuo, acordaram no seguinte:
ARTIGO 1
As Partes Contratantes contribuirão, dentro da estrutura da legislação e dos regulamentos vigentes nos dois países, para um incremento harmonioso e substancial do volume de comércio e para a expansão da cooperação económica, industrial e tecnológica no sentido de aproveitarem do modo mais completo as possibilidades resultantes do seu desenvolvimento económico.
ARTIGO 2
No sentido de assegurar as condições de benefício mútuo requeridas para a expansão do comércio entre os dois países, cada uma das Partes Contratantes concede o tratamento da nação mais favorecida às mercadorias originárias e importadas do território da outra Parte Contratante, assim como às mercadorias provenientes do seu próprio território e exportadas para o território da outra Parte Contratante, em tudo o que diz respeito a direitas aduaneiros, taxas e quaisquer outros encargos fiscais, incluindo taxas e encargos internos, assim como processos e formalidades associados aos certificados alfandegários e licenças de importação e exportação.
As mercadorias originárias do território de uma das Partes Contratantes não serão sujeitas, sempre que importadas para o território da outra Parte, ao pagamento de direitos aduaneiros, taxas e outras encargos fiscais de qualquer tipo, incluindo taxas e encargos internos, mais elevados do que os aplicados a mercadorias similares importadas de qualquer outra Parte.
Qualquer benefício concedido por uma das Partes Contratantes às mercadorias originárias de terceiro país será imediata e incondicionalmente extensivo a mercadorias similares originárias do território da outra Parte.
ARTIGO 3
Não serão estabelecidas ou mantidas por uma das Partes Contratantes quaisquer proibições ou restrições quanto à importação ou exportação de quaisquer mercadorias originárias do território da outra Parte Contratante ou a ela destinadas, assim como à sua circulação, transporte e distribuição nos territórios respectivos, a não ser que tais medidas sejam também aplicáveis a mercadorias similares com origem ou destino a qualquer outro país.
O mesmo tratamento será aplicado a pagamentos e transferências resultantes do comércio entre os dois países.
ARTIGO 4
As disposições dos artigos 2 e 3 não serão aplicadas a:
a) Benefícios concedidos ou que o possam vir a ser por qualquer das Partes Contratantes a países limítrofes, a fim de facilitar o comércio fronteiriço;
b) Benefícios concedidos ou que o possam vir a ser por qualquer Parte Contratante a outros países, nos termos de acordos sobre uma união aduaneira ou uma zona de comércio livre.
ARTIGO 5
As Partes Contratantes tomarão as medidas adequadas, dentro dos limites das suas legislações, para facilitar os transportes ferroviário, rodoviário, marítimo e aéreo entre ambos os países.
As condições para a resolução das questões no domínio dos transportes deverão ser objecto de negociações directas entre as autoridades portuguesas e búlgaras, devidamente autorizadas a levarem a cabo tais actividades.
ARTIGO 6
As Partes Contratantes, de acordo com os objectivos e necessidades do seu desenvolvimento económico, incentivarão e facilitarão a conclusão e implementação de contratos e programas de cooperação comercial, industrial e tecnológica, a longo prazo, entre empresas e firmas comerciais interessadas de ambos os países e proporcionarão todas as facilidades possíveis para a realização de projectos de interesse mútuo.
ARTIGO 7
As Partes Contratantes devem:
Facilitar as visitas de grupos e delegações com fins comerciais e em relação com o estabelecimento e cooperação industrial e tecnológica entre empresas e firmas dos dois países;
Incentivar e facilitar organização e participação em feiras, exposições, seminários, colóquios e outras actividades no domínio do comércio e tecnologia, no seu próprio país, de empresas e organizações do outro país.
ARTIGO 8
Cada uma das Partes Contratantes reconhecerá os documentos e vistos comerciais bem como os certificados de qualidade e de análise emitidos pelas autoridades competentes da outra Parte em conformidade com a sua regulamentação interna.
ARTIGO 9
As Partes Contratantes, de acordo com as suas leis e regulamentos e sob condições não menos favoráveis do que as concedidas a outros países, devem permitir as importações e exportações de:
a) Amostras e material publicitário, incluindo filmes;
b) Mercadorias e artigos destinados a feiras e exposições, permanentes ou temporárias.
ARTIGO 10
Os pagamentos entre a República Portuguesa e a República Popular da Bulgária serão efectuados em moeda livremente convertível, de acordo com os regulamentos cambiais em vigor nos dois países.
ARTIGO 11
O comércio entre os dois países efectuar-se-á na base de contratos concluídos entre as competentes pessoas físicas e jurídicas de ambos os países, autorizadas a empreender actividades no comércio externo.
ARTIGO 12
Cada Parte Contratante concederá às pessoas físicas e jurídicas da outra Parte, na realização de actividades comerciais, tratamento não menos favorável no que diz respeito ao acesso a tribunais e corpos administrativos e no que diz respeito a protecção dos seus direitos, do que o concedido às pessoas físicas e jurídicas de qualquer outro país.
ARTIGO 13
Para alcançar o objectivo deste Acordo, as Partes Contratantes estabelecerão uma Comissão Mista, composta por representantes dos dois Governos.
A Comissão Mista realizará anualmente sessões plenárias, alternadamente em Portugal e na Bulgária, em datas a acordar mutuamente.
A Comissão terá as seguintes atribuições:
Supervisionar e facilitar a implementação prática do presente Acordo;
Auxiliar e facilitar o desenvolvimento do comércio e da cooperação económica, industrial e tecnológica, assim como fazer recomendações a ambos os Governos para tomarem medidas destinadas ao incremento do comércio mútuo;
Concluir protocolos comerciais anuais e listas indicativas de artigos a eles anexas.
ARTIGO 14
As disposições deste Acordo aplicar-se-ão aos contratos em execução que não tenham sido cumpridos à data do termo da validade do Acordo.
ARTIGO 15
O presente Acordo entrará em vigor na data da recepção da segunda das notas pelas quais as Partes se informam reciprocamente quanto à sua aprovação, em concordância com os processos constitucionais de ambos os países. O Acordo será válido por um período de cinco anos, e será automaticamente prorrogado daí em diante por períodos sucessivos de um ano, a não ser que qualquer Parte Contratante envie à outra, por via diplomática, uma nota escrita, três meses antes do termo do respectivo período de um ano, acerca do seu desejo de denunciar o Acordo.

Em relação ao Acordo Comercial a Longo Prazo assinado hoje entre o Governo da República Portuguesa e o Governo da República Popular da Bulgária, tenho a honra de declarar, em nome do Governo da República Portuguesa, que as disposições dos artigos 2 e 3 do Acordo acima mencionado não se aplicarão aos benefícios concedidos ou que o possam vir a ser, no futuro, por Portugal aos territórios sob administração portuguesa, assim como a países independentes, anteriormente sob a mesma administração.
