Decreto n.º 77/77

de 24 de Maio

O Governo decreta, nos termos da alínea c) do artigo 200.º da Constituição, o seguinte:

Artigo único. É aprovado o Acordo, por troca de notas, entre os Governos de Portugal e da Noruega sobre a continuação, a título transitório, da pesca por navios portugueses na zona económica norueguesa das 200 milhas, celebrado em Lisboa no dia 8 de Fevereiro de 1977, cujo original em inglês e respectiva tradução acompanham o presente decreto.

Excellency:

I have the honour to refer to the negotiations which have taken place between our two Governments in connection with the establishment of a Norwegian economic zone of 200 nautical miles. During these negotiations, agreement was reached on the continuation, for a transitional period, of Portuguese fishing within waters over which Norway exercises sovereign rights in respect of living resources, subject to the terms and conditions laid down below:

1. The Government of Norway undertakes to permit Portuguese fishing vessels to fish within Norway's economic zone North of Latitude 62º N beyond a distance of 50 nautical miles from the applicable base lines for a period up to and including 31st December 1980.

Such fishing shall be limited to such allotments as may be allocated to Portuguese fishing vessels by the Government of Norway in the exercise of Norway's sovereign rights in respect of living resources.

2. Portuguese fishing vessels shall obtain licenses from the competent authorities of the Government of Norway to fish allotments pursuant to the above provisions. They shall comply with the conservation measures and other terms and conditions laid down by the Government of Norway and shall be subject to Norwegian laws and regulations in respect of fisheries.

3. The Government of Portugal shall ensure that vessels flying the Portuguese flag observe the provisions in this Agreement and other Norwegian regulations in force.

The Government of Norway may, within Norway's economic zone, adopt such measures, in conformity with international law, as may be necessary to ensure that the vessels flying the Portuguese flag observe the provisions in this Agreement.

4. The Parties will consult as appropriate on questions that may arise relating to the proper functioning of this Agreement.

If the foregoing is acceptable to your Government, I have the honour to propose that this Note, together with your reply thereto, shall constitute an Agreement between our two Governments to enter into force provisionally upon the date of the exchange of Notes and to take permanent effect when the two Governments have informed each other that their respective constitutional requirements have been fulfilled. The Agreement shall expire on the date given in paragraph 1 above, provided that the Norwegian Government may suspend the operation of paragraph 1 above in the event of failure to comply with the provisions in paragraph 3 above.

Tenho a honra de me referir às negociações havidas entre os nossos Governos relativas ao estabelecimento de uma zona económica norueguesa de 200 milhas náuticas. Durante as referidas negociações foi acordada a continuação, por um período de transição, da pesca portuguesa nas águas sobre as quais a Noruega exerce direitos soberanos respeitantes aos recursos vivos, nos termos e condições a seguir estabelecidos:

1. O Governo da Noruega compromete-se a permitir que os navios de pesca portugueses pesquem na zona económica norueguesa de 62º de latitude norte para além das 50 milhas náuticas, a contar das linhas de base aplicáveis, até 31 de Dezembro de 1980, inclusive.

As capturas deverão limitar-se às quotas atribuídas aos navios portugueses pelo Governo Norueguês, no exercício dos direitos soberanos da Noruega sobre os recursos vivos.

2. Os navios de pesca portugueses deverão obter das competentes autoridades do Governo da Noruega as licenças para a pesca de quotas, em conformidade com as disposições anteriores. Deverão respeitar as medidas de conservação e demais termos e condições prescritos pelo Governo da Noruega e, no respeitante a pescas, sujeitar-se-ão às leis e regulamentos noruegueses.

3. O Governo de Portugal deverá assegurar a observância pelos navios sob bandeira portuguesa das disposições do presente Acordo, bem como dos demais regulamentos noruegueses em vigor.

Dentro da zona económica norueguesa, o Governo da Noruega poderá adoptar, em conformidade com o direito internacional, as medidas necessárias para assegurar que os navios sob bandeira portuguesa observem as disposições do presente Acordo.

4. As Partes consultar-se-ão, quando conveniente, sobre as questões relativas ao correcto funcionamento do presente Acordo.

Se o que precede for aceitável para o Governo de V. Ex.ª, tenho a honra de propor que a presente nota e a nota de resposta de V. Ex.ª constituam um Acordo entre os nossos Governos a entrar provisoriamente em vigor na data da sua troca e a vigorar efectivamente quando ambos os Governos comunicarem ter completado as respectivas formalidades constitucionais. O presente Acordo expirará na data referida no parágrafo 1, podendo o Governo Norueguês suspender o funcionamento do mesmo parágrafo no caso de não cumprimento das disposições do parágrafo 3.
